SUBJECT: COMMERCIAL RELOCATION SERVICES FOR 156
AND 158 MAIN STREET
Background
In September, 2008, the Redevelopment Agency purchased 154, 156, and 158
Main Street from the Trujillo Family Trust. At the time, the Agency acquired the
property as part of the land assemblage for the Lake Elsinore Technology Center
(business incubator). Due to the fact that the Agency was not ready to move
forward with the business incubator, the Agency entered into lease agreements
with the existing tenants.
As part of the executed lease agreements, the existing tenants requested a
reduction in monthly rental payments. In exchange for a reduced rent, the existing
tenants agreed to offset any future relocation benefits to which the tenants would
be entitled to.
On October 27, 2010 the Agency circulated a `request for proposal' (RFP) for the
design and construction of the Lake Elsinore Technology Center (LETC). The
LETC is proposed to be constructed in the location of the existing building,
therefore the Agency must start the relocation process in order to prepare the
building for demolition.
Discussion
Agency Staff requested a proposal from Overland, Pacific, and Cutler (OPC) for
consulting services for the relocation of the two (2) existing businesses located at
156 and 158 Main Street. Relocation services for 154 Main are not warranted as
the existing tenant vacated the building on November 1, 2010.
As part of the "Scope of Services ", OPC will provide relocation services in
accordance with the California State Relocation Guidelines as well as Spanish

speaking translation services where applicable. OPC provided a total estimated fee
for both businesses of $9,000 for relocation services.
Fiscal Impact
As the funds for the Lake Elsinore Technology Center are budgeted through the
Agency budget as well as a matching grant from the Federal Economic
Development Agency (EDA), there will be no significant impact to the Agency's
budget that is not already accounted for.
Recommendation
Approve the relocation assistance services proposal and authorize the City
Manager to execute the applicable contract.

Project
Dear Mr. Carlson:
Overland, Pacific & Cutler, Inc. (OPC) is pleased to submit this proposal to provide relocation
consulting services for two (2) nonresidential occupants ( "businesses ") located at 156 and 158
Main Street for the Business Incubator project (the `Project "). It is our understanding the City
acquired the property in June 2009. The 2 businesses to be displaced are a retail store and video
rentalstore.
Relocation services shall be provided in accordance with State Relocation Guidelines and the
attached Scope of Services. The business occupants are Spanish speaking and the City's desire is
to provide a Spanish speaking relocation consultant. Also, pursuant to an agreement with the
existing tenants, the City has allowed tenants to pay reduced rents until they are required to be
relocated with an understanding the accumulated reduced rent amounts will be offset against any
eligible relocation payments.
Based on our project understanding and the attached Scope of Services, the following is our
proposed fee to provide the necessary Relocation Assistance and Project Management services:

OPC may submit monthly invoices for the relocation services rendered based on the
hourly rate schedule provided below. Additional cases identified during the
implementation of the Project, delays in the project which take the relocation process past
six months, uncooperative occupants or those being represented by legal counsel or
relocation representatives requiring extraordinary time, substantial changes in the
required scope of work are items which may result in the revision of the proposed fee.
Project Management
Project Management services may be necessary to provide general consulting services
relative to the relocation program with Client, as well as, status reports and meetings with
Client, attorney and or Agency Board. OPC proposes these services, as needed and
requested, on an hourly basis. We are estimating a budget of
Three Thousand Dollars
($3,000.00)

Any consulting services or advice necessary for an appeal, or to support litigation, such as
depositions, pre -trial research and, court testimony, is not part of the estimated fee and shall be
billed hourly at 150% of the above rates.

Conduct the following activities necessary for the effective relocation of non - residential
occupants:
1. Conduct personal, on -site interviews of prospective displacees to ascertain relocation
needs and special requirements.
2. Inform displaced businesses of available relocation assistance services and benefits,
and explain relocation process.
3. Prepare and distribute Informational Statements, Notices of Displacement, 90 -Day
Notices to Vacate, and other notices, as may be required.
4. Assist displacees in locating replacement business sites and provide written referrals to
same, if any. Provide with any referral, an evaluation form which requests feedback as
to the suitability of the site referral, and attempt to secure response from claimant.
5. Provide on -going advisory assistance to business displacees, including lists of
qualified movers and vendors.
6. Assist with the preparation of specifications for the move and inventory of personal
property, insuring thorough coordination with Agency staff and/or legal counsel, that
no real property is included on the personal property inventory list.
7. Coordinate the walk - through for a minimum of two bids and move estimates with
movers and the displaced business.
8. Monitor the actual move to replacement site and re- establishment activities, as
necessary.
9. Determine eligibility for and proposed amount of relocation benefits, including actual
and reasonable moving payments, re- establishment payments, and fixed payments.
10. Prepare up to 2 benefit claim forms, secure claimant's signatures on claim forms, and
submit claim forms to Agency for processing and payment.
11. Deliver benefit checks and other appropriate payments to claimants.
12. Verify vacation of the displacement site and secure a certificate of abandonment.
