MacHott, LEED Green Associate Planning Manager DATE: July 17, 2014 SUBJECT: Public Convenience and Necessity (PCN) Notification to State Department of Alcoholic Beverage Control Board for "El Vaquero Night Club" at 32310 Riverside Drive. APPLICANT: Hermila Soto de Casillas, 16628 Escavera Street, Lake Elsinore, CA 92530 OWNER: Johann Hendrick, 32310 Riverside Drive, Lake Elsinore, CA 92530 Recommendation 1. Deny applicant's request for a Finding of Public Convenience and Necessity. Background and Discussion The State of California Business and Professions Code mandates that on- premise and off - premise (consumption) alcohol sales establishments that are located within a census tract that is over concentrated with similar alcohol - related uses obtain a Public Convenience and Necessity (PCN) finding from the local jurisdiction. El Vaquero Night Club has requested that the Planning Commission make a Finding of Public Convenience and Necessity in order that it may obtain a Type 40 series license from the State Department of Alcohol Beverage Control (ABC) for on- premises sale of alcohol. (See attached letters from Applicant and from Property Owner.) The Night Club is located in a census tract which contains nine on- premise or (On Sale) alcohol establishment licenses. State Department of Alcoholic Beverage Control Planning Commission Staff Report PCN for El Vaquero Night Club June 17, 2014 guidelines only allows for four on- premise alcohol establishments within Census Tract No. 430.01. The Lake Elsinore Police Department has protested the issuance of a Type 40 on -sale license (see attached letter and e -mail) because of the following issues: 1. Close Proximity of Residences 2. Over - concentration of on -sale licenses 3. Will create or worsen the existing law enforcement problem in the area. However, the Police Department also stated that with the implementation of reasonable operating conditions, the Riverside County Sheriff's Department/Lake Elsinore Police Department will consider withdrawing its protest. Upon receipt of Police Department letter, staff contacted the applicant requesting the submittal of an operations plan that addressed the Police Department concerns. To date, staff has not received an operations plan from the applicant. Therefore, staff cannot support the request for a Finding of Public Convenience and Necessity. I believe that this location has a lot of potential for a successful business and that I can make a positive change that is needed and desired. If, I am given the opportunity and due to the experience that I have working in several restaurants for over ten years, including BJ's Restaurants for the last 7 years at several locations including, Escondido, Temecula, and now for the one in Menifee, for which I have just recently been promoted to Manager, I will make sure that every possible effort is made to make this location becomes a drug free environment and completely reduce and eliminate the concerns that have been presented by the Police Department. I am a very hard worker with big dreams and now, I believe that this is an opportunity to become my own boss and open my own business. I am a resident of the City of Lake Elsinore and as a resident I want to contribute to make our City more desirable location by establishing successful and respectable businesses. Also, I want to mention that I am single Mother raising two teenagers and as a mother I am very concern about their well -being and how easily someone can get involve with drugs. Therefore, I will provide security cameras throughout the site, and security guards who will patrol the location before opening the doors for business, during the operating hours, and of course at closing time. The provision authorizes the sale of beer for consumption on or off the premises where sold. No wine or distilled spirits may be on the premises. There are hundreds of calls for the address, but that includes the trailer park to the back of the bar.
