SUBJECT: Historic Main Street Pole Sign — Contract with Harbinger, LLC
for the Fabrication and Installation of a Historic Main Street Pole
Sign to be collocated on the 7- Eleven Freeway Pole Sign
Located at 515 N. Main Street
Recommendation
1. Approve the proposal from Habinger, LLC. for the fabrication and installation of a
Historic Main Street Pole Sign to be co- located on the 7- Eleven Freeway Pole Sign
located at 515 N. Main Street.
2. Authorize the City Manager to enter into a contract with Harbinger, LLC in an
amount not to exceed $24,770.00 for the custom fabrication, shipping and sign
installation per SVE2257 -R9 attached specification (proposal #1551).
The subject Historic Main Street sign before the City Council is related to the
development of a new 7- Eleven convenience store and gas station that is currently
under construction at 515 North Main Street directly adjacent to the southbound 1 -15
Freeway off -ramp.
The 7- Eleven project was approved by the City Council on July 9, 2013. In connection
with this approval, the applicant proposed updating the existing freeway pole sign to
feature the 7- Eleven logo. Space was also provided for separate "City of Lake Elsinore
Historic Downtown" sign. Following much discussion, the proposed sign was approved
subject to Condition of Approval No. 21 that provides in pertinent part:
The "City of Lake Elsinore Historic Downtown" sign located on the existing
freeway pylon sign shall be redesigned by the City with final approval by
the Planning Commission. The applicant shall without charge to the City

provide space on the existing freeway pylon sign as depicted by the
placeholder "City of Lake Elsinore Downtown Historic District" sign and
shall provide electrical conduit to and utilities for such "City of Lake
Elsinore Historic Downtown" sign. The rights and responsibilities of the
applicant and the City as to the design, fabrication, installation,
maintenance, repair and utility costs shall be set forth in a License
Agreement to be prepared by the City Attorney and approved by the City
Council."
On December 10, 2013, the City Council approved a Sign License Agreement with 7-
Eleven, Inc. implementing the above Condition of Approval No. 21. The approved
License Agreement provides the City a perpetual and irrevocable license to utilize a
portion of the existing pole sign for the purpose of a City identification sign.
Under the terms of the License Agreement, the City is required to design and deliver the
finished manufactured sign to 7- Eleven. 7- Eleven will install the City sign and provide
electricity at no cost to the City.
At its December 10, 2013 meeting the City Council approved the wording of the City
sign to be "Historic Main Street ".
Discussion
Selection of Harbinaer. LLC
Harbinger is designing, manufacturing and installing signage for 7- Eleven at the Main
Street location. For this reason, staff contacted Harbinger and received a quotation for
the manufacture of the City's pole sign. Upon receipt of the Harbinger $24,770 price
quote, staff conducted an informal survey and consulted with George Bloomfield, who
designed the City's sign. Based on that inquiry, staff determined that the Harbinger bid
is reasonable and likely represents a cost savings over other vendors who are not
already onsite.
Pursuant to Paragraph F. of Lake Elsinore Municipal Code Section 3.08.070, the
purchase procedures set forth in Chapter 3.08 of the Lake Elsinore Municipal Code,
bidding procedures for the purchases of supplies, services and equipment shall not
apply: "When in the best interest of the City, the City Council may authorize the City
Manager or Purchasing Officer to bypass the bid process required under this chapter for
purchases greater than fifteen thousand dollars ($15,000)."
Based upon Mr. Bloomfield's response and the projected installation cost savings, staff
determined that it is in the City's best interest to bypass the bid process and directly
enter into an agreement (see Attachment 1) with Harbinger, LLC.

City Entry Monument Sign Program
On October 23, 2012, the City Council approved a City Entry Monument Sign Program,
authorized the expenditure of $180,000 for the fabrication and installation of signs, and
authorized staff to move forward with the design of two decorative entry monument
signs that would be attached to freeway overpass fences on the north side of the
Nichols Road and on the south side of the Franklin Avenue overpass. The City Council
also approved five ground monument entry signs to be located at:
*Ortega Highway & Grand Avenue Intersection
.Main Street & 1 -15 South Off -Ramp
*Diamond Drive & 1 -15 South Off -Ramp
.Central Avenue & 1 -15 South On -Ramp
*Railroad Canyon & Canyon Hills Road Intersection
Since most of the ground monument signs are within Caltrans right -of -way, the
proposed monument locations as originally planned do not meet the Federal Highway
Administration Policy and such encroachment would require FHWA approval and
preparation of federal environmental documents. Based on several meetings with
Caltrans representatives, it was recommended that the City pursue easements from
private property owners abutting the proposed locations to avoid any work within
Caltrans right -of -way.
Based on Caltrans' comments and further review of the proposed monument locations,
staff is currently working to secure an easement from the private property owners along
Grand Avenue across from Ortega Highway (SR -74) and is pursuing completion of the
design for:
• Two freeway overhead signs
• Monument sign owners along Grand Avenue across from Ortega Hwy
• Monument sign along Railroad Canyon Center Median southerly of Canyon Hills
Road facing Southbound direction
• The Diamond Drive and Central Avenue monument signs will be incorporated
into future capital improvement programs, as appropriate.
Because the pole sign will achieve the same objective as the ground monument entry
sign, the subject Historic Main Street Pole Sign on the 7- Eleven property will be
installed instead of the ground monument entry sign at the Main Street & 1 -15 South off -
ramp.

Fiscal Impact
The cost of the Historic Main Street pole sign is $24,770.00, which will be funded from
the existing appropriation for the City Entry Monument Sign Program.

3. BOTH PARTIES HERETO AGREE THAT THE TITLE TO SAID DISPLAY SYSTEM SHALL REMAIN THE PROPERTY OF THE COMPANY UNTIL PAID FOR IN FULL. OUT AFTER
DELIVERY TO THE CUSTOMER, ANY DAMAGE FROM FIRE OR OTHER CAUSES AFTER SAID DELIVERY SHALL BE ASSUMED BY SAID CUSTOMER AND WILL NOT AFFECT
THE RIGHTS OF THE COMPANY TO ENFORCE THE THEN UNPAID PURCHASE PRICE.

5. ALL TERMS AND CONDITIONS OF THIS CONTRACT SHALL BE BINDING UPON ANY SUCCESSORS, ASSIGNEES OR OTHER LEGAL REPRESENTATIVES OF THE RESPECTIVE
PARTIES, BUT NO ASSIGNMENT SHALL BE MADE BY THE CUSTOMER WITHOUT THE CONSENT IN WRITING BY THE COMPANY UNLESS FULL PAYMENT OF THE TOTAL
CONSIDERATION HAS BEEN RECEIVED BY THE COMPANY.
G. HARBINGER SHALL SECURE ALL NECESSARY PERMITS REQUIRED BY MUNICIPAL AGENCIES FOR THE CUSTOMER REQUIRED FOR THE INSTALLATION OF THE SIGN.
CUSTOMER SHALL BE RESPONSIBLE FOR SECURING ANY OTHER PERMISIONS REQUIRED FOR INSTALLATION /MAINTENANCE OF SIGN OR SIGNS. CUSTOMER SHALL BE
LIABLE FOR ANY OBSTRUCTION OF DELIVERY DUE TO DELAY IN OBTAINING SUCH PERMISSIONS, AND IF CUSTOMER EXECUTES THIS CONTRACT OF SALES WITHOUT
EVER OBTAINING PERMISSIONS FROM THE PARTY OR PARTIES NECESSARY FOR THE INSTALLATION OF SAL D SIGN, THEN HE PURCHASES SAME AND IS BOUND TO THE
TERMS AND CONDITIDINS OF THIS CONTRACT AS THOUGH HE HAD OBTAINED SAID PERMISSION AND HE AGREES TO RELIEVE THE COMPANY FROM ANY LIABILITY
FOR ITS FAILURE WITHIN 30 DAYS OF DELIVERY TO ERECT OR INSTALL SAID SIGN.
7. CUSTOMER AGREES TO PROVIDE SERVICE FEED WIRE OF SUITABLE CAPACITY AND APPROVED BY NATIONAL ELECTRICAL CODE TO WITHIN FIVE FEET OF DISPLAY
LOCATION IN ADVANCE OF INSTALLATION. HARBINGER WILL MAKE FINAL CONNECTION THEREOF TO DISPLAY UNLESS OTHERWISE INSTRUCTED BY CUSTOMER IN
SUCH CASE HARBINGER IS NOT LIABLE FOR ANY RESULTING DAMAGE TO DISPLAY SYSTEM FOR ANY NON-HARBINGER FINAL CONNECTION.
8. WHEN PIER DRILLING IS NECESSARY, THE COMPANY WILL CONTACT DIG TESTS TO LOCATE PUBLIC UTILITIES. LOCATION OF PRIVATE UNDERGROUND UTILITIES IS THE
SOLE RESPONSIBILITY OF THE CUSTOMER. IN THE EVENT ROCK OR OTHER UNFORESEEABLE FOUNDATION CONDITIONS ARE ENCOUNTERED IN THE DRILLING
PROCESS, TO THE POINT WHERE SPECIAL EQUIPMENT OR ALTERNATE FOUNDATION REVISIONS ARE REQUIRED, ADDITIONAL MONIES MAY BE REQUESTED IN
WRITING BYTHE COMPANY.
9. LIMITED WARRANTY. HARBINGER WARRANTS THE DISPLAY SYSTEM AGAINST MATERIAL DEFECTS IN CONSTRUCTION AND ASSEMBLY OF GOODS MANUFACTURED
OR ASSEMBLED BY HARBINGER SOLELY TO CUSTOMER FOR A PERIOD OF ONE (1) YEAR FROM THE DATE OF SHIPMENT OR INSTALLATION. HARBINGER WARRANTS
THE DISPLAY SYSTEM AGAINST DEFECTS IN COMPONENTS MANUFACTURED OTHER THAN BY HARBINGER ( "THE LIMITED WARRANTY ") SOLELY TO THE CUSTOMER
FOR A PERIOD OF NINETY (90) DAYS FROM SHIPMENT OR INSTALLATION. THE LIMITED WARRANTY PROVIDED IN THIS SECTION IS EXPRESSLY CONDITIONED AND
CONTINGENT UPON CUSTOMER'S STRICT COMPLIANCE WITH EACH OF THE FOLLOWING:
A) INSTALLATION OF THE GOODS BY HARBINGER; AND
B) THE GOODS HAVE NOT BEEN ABUSED, MISUSED OR'MODIFIED AND WERE MAINTAINED IN ACCORDANCE WITH HARBINGER'S THEN IN PLACE INSTRUCTIONS
