Recommendation 1. City Council Waive Lake Elsinore Municipal Code and approve purchase under LEMC Section 3.08.070F — Exception to bid procedures (When in the best interest of the City, the City Council may authorize the City Manager or Purchasing Officer to bypass the bid process required under this chapter for purchases greater than $15,000), and; 2. Authorize the City Manager to enter into an agreement with Pyro Spectaculars, Inc. for Fourth of July Fireworks Show in an amount not to exceed $35,000. Background On July 4, 2013, the City held a Fireworks Spectacular on Lake Elsinore, which included a "View by Boat" fireworks show over the lake. Services were provided by Pyro Spectaculars, Inc. located in Rialto, California. The 2013 Fireworks Spectacular on Lake Elsinore was a huge success due to a sizable donation offered to the City, which allowed for an enhanced show with custom fireworks, a radio simulcast through KOLA Radio 99.9, and a show time that extended to approximately 30 minutes. Discussion Staff proposes to continue providing a fireworks show to the community, and wishes to give boaters another opportunity to view the show while on the lake. Given the purchase of fireworks services is unique, staff bypassed the normal bid procedures and chose Pyro Spectaculars, Inc. for the City's 2014 fireworks show. Their quote, in the amount of $35,000, will include 1,287 shells ( #5 10- inch), a radio simulcast promoting the event, and approximately 18 — 20 minutes duration. Fourth of July Fireworks Show May 13, 2014 Page 2 For upcoming years, staff would like to consider soliciting for an RFP and have a pyrotechnic company on contract for three to five years. Fiscal Impact Approval of this item will result in an expenditure of $35,000 that will be appropriated from the City's FY 2014 -2015 Budget. Upon approval, a contract will be signed and a 50% deposit of $17,500 will be required. All these additional personnel and services shalt be fully insured and the sole responsibility ol'CLIENT. • Coordination and any applicable non - pyrotechnic permitting with the local, stale or federal government that may hold authority within the Production. • Costs of al I permits required for the presentation of the Production and the event as a whole. • Provision of a Safely Zone in accordance with applicable standards and all requirements of the authorities having jurisdiction throughout the entire time that the pyrotechnics are at the Site or the load site (if different) on the date of the Production and all set -up and load -out dates, including water security to keep unauthorized people, boats; etc, from entering the Safety Zone. • A professional grade Audio System including all necessary equipment, installation of such equipment and trained audio engineers for operation based on audio and communications requirements provided by PYRO. General Services including, but not limited to, Site and audience sectu ity, fencing, adequate work light, clutnpster accessibility, a secure office for PYRO personnel within the venue, secure parking for PYRO vehicles, access to washrooms, tents, equipment storage, hazmatstoiage, electrical power, fire suppression equipment, access to worksites, necessary credentialing, etc.; will be required as necessary.
