A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE OPPOSING SENATE BILL 1270 REGARDING
SURFACE MINING OPERATIONS
WHEREAS, the City of Lake Elsinore is the lead agency for several mining operations
regulated under the Surface Mining and Reclamation Act ( SMARA) and has successfully
implemented its obligations under SMARA;
WHEREAS, Senate Bill 1270 proposes an amendment to SMARA that will divest the
City and all local government agencies from important responsibilities regarding mining
operations and reclamation and transfer those responsibilities to the State;
WHEREAS, local government is best suited to fulfill lead agency responsibilities over
mining operations and reclamation activities due to its understanding of local conditions and
interests, including zoning, land use and environmental concerns, and the ability of local
government to respond to and advance the current needs and long -range health and welfare
of local communities; and
WHEREAS, taking away local control and increasing the State's regulatory authority
over these matters will not be in the best interest of the City of Lake Elsinore.
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The City Council hereby opposes Senate Bill 1270.
SECTION 2. The City Council hereby authorized the Mayor to sign a letter opposing
Senate Bill 1270, substantially in the form approved by the City Council at the public meeting
held on April 8, 2014, and cause such letter to be delivered to State of California Senator
Fran Pavely.
SECTION 3. This Resolution shall take effect from and after the date of its passage
and adoption.

same was adopted by the following vote:

Hickman, Mayor Pro Tern Manos, and Mayor Johnson
