NUISANCE ABATEMENT HEARING

CALL TO ORDER
Chairman Blake called the Nuisance Abatement Hearing to order at 4:35 p.m.
PLEDGE OF ALLEGIANCE
Board Member Tom Thomas led The Pledge of Allegiance.

PUBLIC HEARINGS
2. 522 N. RILEY STREET, APN 377 - 241 -001, LAKE ELSINORE, CA
Chairman Blake opened the Public Hearing at 4:37 p.m.
Chairman Blake stated we would hear from Code Enforcement Supervisor Lopez
regarding the case.
Code Enforcement Supervisor Lopez provided an overview of the case to the
Board. He explained the difficulties the City experienced with getting the
property owner to comply with the City's demands. He stated that the property

owner appealed to the City Council at the October 11, 2011, Council meeting at
which time she was given 120 days to comply. He stated that as of January 7,
2014, no work has been done on the property and the permits have expired.
Code Enforcement Supervisor Lopez indicated staff recommends the Board find
and declare the property located at 522 North Riley a public nuisance allowing
the City to proceed with the structure abatement process via a court appointed
receivership.
Chairman Blake clarified the Nuisance Abatement Hearing was for the severe
potential of a safety and health matter.
Community Development Director Taylor explained Lake Elsinore Municipal
Code Chapter 8.18 Nuisance Abatement. He stated the purpose of the Nuisance
Abatement was to bring long standing and /or significant code violations into
compliance to assure the public health safety and welfare.
Chairman Blake asked Director Taylor what the possible recommendations the
Nuisance Abatement Board could make.
Community Development Director Taylor indicated the Nuisance Abatement
Board has the authority to either declare the property a nuisance and set forth an
abatement date, they could declare the property not a nuisance, or they grant a
continuance of time.
Chairman Blake indicated he would like to hear from the owner.
Alisa Reyes introduced herself as the owner of the property. She gave a history
of her property and her overview of the case. Ms. Reyes explained her
difficulties she has had with the City during the process of compliance. Julian
Ramirez introduced himself as her General Contractor. Chairman Blake asked if
he was a licensed contractor in the State of California and looked at his license.
Mr. Ramirez stated he did business as JLR Development. Chairman Blake
asked Mr. Ramirez to describe what he wanted to do for Ms. Reyes.
Ms. Reyes explained to the Board the situation regarding the old plans to
rehabilitate her structure.
Board Member Thomas asked why work was not started if the plans were
approved in May of 2013. Ms. Reyes stated she did not know there was a time
limit.
Board Member Thomas asked Ms. Reyes if she currently had the financial
resources to move ahead with the plans. Ms. Reyes said yes, it was a
possibility.

Board Member Thomas asked Supervisor Lopez if the plans would take care of
the structural problems in the warehouse. Supervisor Lopez believed the plans
that were submitted were approved, but no work had been done. Board Member
Thomas stated that was the problem.
Chairman Blake confirmed Mr. Ramirez was to be the contractor. Chairman
Blake and Mr. Ramirez discussed the existing plans, the work that needed to be
done, and if it could be done in a timely manner.
Community Development Director Taylor asked Building Official Belvin to
comment on procedures regarding permits. Building Official Belvin explained
the problem with resubmitting the existing plans. He stated they could solve the
problem by renewing the expired permit at half fees and use the existing plans
going off the 2010 codes. Building Official Belvin and the Board discussed the
time it would take to get the work completed, if the work could be completed, and
what the consequences would be of not completing the work in a timely manner.
Chairman Blake suggested a bond be purchased by the owner insuring the City
will get a reimbursement if work is not completed. The Board continued to
discuss requiring a bond insurance from the property owner which would be
based on the project valuation. Mr. Ramirez stated it was possible to obtain a
bond on the project valuation. Building Official explained the project valuation as
$205,000 and he suggested a 5% bond.
Chairman Blake started a discussion of a timeline for pulling permits, demolishing
the interior and completing the work. Community Development Director Taylor
gave a timeline of work that need to be completed. He stated the bond in the
amount of 5% of the valuation of the work needed to be submitted and a building
permit pulled within ten days working days. He indicated this item would be
continued to the next meeting on February 4, 2014.
Ms. Reyes agreed to those terms.
Board Member Thomas opened a discussion regarding dates showing work is
being done within a certain time period. Building Official Belvin suggested
building inspections every fourteen days to see the progress.
MOVED BY COMMUNITY DEVELOPMENT DIRECTOR
TAYLOR, SECONDED BY BOARD MEMBER THOMAS AND
CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT THAT
THE APPLICANT SUBMIT A BOND AND OBTAIN A PERMIT NO
LATER THAN JANUARY 21, 2014, DEMOLITION TO START
JANUARY 24, 2014, DEMOLITION FULLY COMPLETED BY
FEBRUARY 21, 2014, AN INSPECTION TO BE DONE EVERY
FOURTEEN DAYS AND IF NO INSPECTION TO BE

COMPLETED IN THIRTY DAYS THE BOND IS FORFEITED.

Chairman Blake stated we would hear from Code Enforcement Supervisor Lopez
regarding the case.
Code Enforcement Supervisor Lopez indicated that the property owner Rodney
Burdett requested an extension to the February 4, 2014 agenda due to a death in
the family.

HEARING REGARDING THE PROPERTY AT 3392 DRIFTWOOD
LANE, APN 389 - 231 -012, LAKE ELSINORE, CA.
Due to clerical error item numbers 4 & 5 were omitted.

None.
7. Nuisance Abatement Board Comments:
Community Development Tech Joyce Teyler indicated a gentleman signed
the sheet to speak. Chairman Blake asked Mr. Andrew if he would like to
speak and he declined.
ADJOURNMENT
Chairman Blake adjourned the meeting at 5:14 p.m. to the next regularly
scheduled meeting to be held on February 4, 2014 at 4:30 p.m. at Lake Elsinore
Senior Center, 420 E. Lakeshore, Lake Elsinore, California.
