No. 1984-731ORDINANCE N0. 731 AN URGENCY ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA, REGULATING THE USE OF THE SKYLARK AIRPORT WHILE IT IS RECOGNIZED BY THE FEDERAL AVIATION ADMINISTRATION AS AN INACTIVE AIRPORT. WHEREAS, there exists unregulated use of the Skylark Airport; and WHEREAS, the Federal Aviation Administration recognizes the Skylark Airport as an inactive airport; and WHEREAS, it is necessary to protect the general health, safety and welfare of the people of the City of Lake Elsinore from the hazards associated with unregulated use of the Skylark Airport; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSLNORE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION ONE: The above recitals are true and correct. SECTION TWO: No person, firm or corporation shall use the Skylark Airport for the take off or landing of aircraft, except during emergencies, as defined by the Federal Aviation Administration, while the Airport is recognized by the Federal Aviation Administration (FAA) as being inactive. SECTION THREE: No person, firm or corporation shall use the Skylark Airport for any activity associated with flying or airplanes; those activities being flight control or flight lessons while the Airport is recognized by the federal Aviation Administration as being inactive. SECTION FOUR: No person, firm or corporation shall use the Skylark Airport for any sport or recreational purposes such as parachuting, ultra light flying and/or sailplane soaring, while the Airport is recognized by the Federal Aviation Administration as being inactive. SECTION FIVE: Any person, firm or corporation found to be in violation of any of the provisions herein described shall be found guilty of an infraction, with a penalty of $250.00 for the first offense; $500.00 for a second offense; and $1,000.00 for a third offense. SECTION SIX: The City's Law Enforcement Agency and Code Enforcement Officers are appointed inspectors to assure compliance with all provisions herein and shall investigate and determine compliance and/or to enforce and perform all the regula- tory provisions of this ordinance.. SECTION SEVEN: In the event that any provision of this ordinance is determined to be invalid by a court of competent jurisdiction, the remaining sections shall remain in full force and effect. SECTION EIGHT: This ordinance is determined to be an urgency measure. for the preserva- tion of the public health, safety and welfare of the City of Lake Elsinore, and will become effective immediately upon its adoption to reduce the possibility of injury or damage to persons or property due to unsafe operation of the Skylark Airport. SECTION NINE: This ordinance shall become effective upon adoption.
