SUBJECT: A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, APPROVING
ADJUSTMENTS TO SCHEDULE OF LAKE USE PASS
FEES.
Recommendations
1. Adopt Resolution No. 2014 -013 approving adjustments to schedule of Lake
Use Pass Fees per Chapter 8.40 of the Lake Elsinore Municipal Code.
Background
During the Great Recession, the number of Daily Lake Use Passes sold decreased
from a peak of 31,441 passes (2007 calendar year) to an annual average of about
20,000 passes (2010 — 2013 calendar years). In response to lost revenue, the City
increased the Daily Lake Use Pass Fee on June 22, 2010, by one -third from $10 to
$15 in an effort to maintain revenue to support Lake maintenance. The Annual Lake
Use Pass Fee was also increased proportionately.
According to the National Bureau of Economic Research the trough of the Great
Recession occurred in June 2009. The trough marks the end of the recession that
began in December 2007 and the beginning of an expansion. The recession lasted
18 months, which makes it the longest of any recession since World War II.
Although the Great Recession is officially over, the number of Daily Lake Use
Passes sold by the City in 2013 is still down over one -third compared to 2007.

Discussion

The potential economic benefits of Lake Elsinore radiates out to the community and
local businesses much further than the point of purchase of a Lake Use Pass.
Visitors to Lake Elsinore may also spend money at local restaurants, hotels, gas
stations and retail shops. In an effort to increase tourism, economic development
and enjoyment of beautiful Lake Elsinore, City Staff is proposing to roll back the
"Daily" and "Annual" Lake Use Pass Fees to pre- recession levels.
Consistent with fostering economic development and widespread enjoyment of the
Lake, City Staff proposes eliminating fees for non - motorized vessels, except
sailboats over 8 -feet in length that are required to be registered by the DMV.
In addition, John Pecora, Flotilla Commander, and Pete Dawson, Boating Safety
Instructor, for the local flotilla of the United States Coast Guard Auxiliary are
requesting the City consider offering discounts on Lake Use Passes to boaters upon
successful completion of a Boating Safety Course or Courtesy Boat Inspection. It is
in the City's best interest to have boaters that are educated in boating safety on
Lake Elsinore. City Staff is supportive of the proposal based on the limitations
contained in the resolution.
Fiscal Impact
For motorized vessels, the City received about $320,000 from the sale of Daily and
Annual Lake Use Passes during the 2013 calendar year. If Lake Use Pass Fees are
reduced by one - third, then the number of boaters using Lake Elsinore must increase
by one -third to maintain equivalent revenue.
For non - motorized vessels, the City received about $3,200 from the sale of Annual
Lake Use Passes during the full 2012 calendar year. There are no records for the
sale of Daily Lake Use Passes to non - motorized vessels; however, City Staff
anecdotally believes the revenue is insignificant.
The proposed Boating Safety Discount Program would provide a maximum of
$13,500 of annual discount savings to boaters.

RESOLUTION NO. 2014 -013
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING ADJUSTMENTS TO
SCHEDULE OF LAKE USE FEES.
WHEREAS, the City of Lake Elsinore is required by the State of California to
maintain the Lake for public park and recreation purposes in perpetuity; and
WHEREAS, the City Council of the City of Lake Elsinore is desirous of
providing adequate services for operating and maintaining Lake Elsinore for the benefit
of the boating public; and
WHEREAS, the City Council is desirous of increasing tourism, economic
development and enjoyment of Lake Elsinore by boaters; and
WHEREAS, the fees collected pursuant to this resolution shall be used for
operating and maintaining the Lake for use by the public; and
WHEREAS, the City Council does now desire to modify the use fees for the Lake
by adopting the Schedule of Fees as set forth herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. Schedule of Pees for Daily Lake Use Pass. The following fee shall
be charged to City residents and non- residents for the use of Lake Elsinore for purchase
of a Daily Lake Use Pass for all motorized vessels and non - motorized vessels that are
required to be registered with the California Department of Motor Vehicles:
Day Use Pass
Daily Lake Use Pass $10.00 per day
SECTION 2. Schedule of Fees for Annual Pass. The following fees shall be
charged to City residents and non- residents for the use of Lake Elsinore for purchase of
an Annual Pass for all motorized vessels and non- motorized vessels that are required to
be registered with the California Department of Motor Vehicles:
Annual Pass (Standard & Lake Front)
Resident $100.00 per year per vessel
Non - Resident $150.00 per year per vessel

Senior Citizen Discount 10% on Annual Pass only.
SECTION 3. Exemption for Non - Motorized Vessels under Eight Feet in Length.
Non - motorized vessels under eight feet in length that are not required to be registered with the
California Department of Motor Vehicle shall not be required to have a Lake Use Pass.
SECTION 4. Boating Safety Discount Program. The City shall provide an equivalent
price discount on Annual Lake Use Pass to boaters voluntarily taking a local (Flotilla 114 -11 -05
Tri Lakes) USCG Auxiliary Boating Safety Course and receiving a certificate of completion.
The Course fee is $75. This discount would be available to individual boaters once every three
(3) years. This program shall be capped at 100 discounts passes at $75 each or $7,500 per year.
a. Court ordered boaters taking the Boating Safety Course are NOT eligible for this
discount; however, the City will provide them one FREE Daily Lake Use Pass. This
program shall be capped at 100 FREE Passes per year. The City will issue a
maximum of 100 FREE Daily Lake Use Passes to the USCG Auxiliary Boating
Safety Instructor for distribution to boaters passing said course.
The City shall provide one (1) FREE Daily Lake Use Pass to boaters who consent and
pass an annual courtesy Boat Inspection conducted by the USCG Auxiliary. This program shall
be capped at 500 FREE Passes per year. The City will incrementally issue a maximum of 500
FREE Daily Lake Use Passes to the USCG Auxiliary for distribution to boaters passing the
inspection. The USCG Auxiliary shall maintain a record of Boater CF #s passing the inspection.
SECTION 5. Effective Date. The City Clerk of the City shall certify the adoption of
this Resolution, with all sections effective immediately.

What is a Vessel Safety Check (VSC)?
A Vessel Safety Check is a no cost courtesy examination of your
boat (Vessel) to verify the presence and condition of certain Safety
Equipment required by State and the Federal regulations. The
Vessel Examiner is a trained specialist and is a member of the
United States Power Squadrons or the US Coast Guard Auxiliary.
They will also make certain recommendations and discuss certain
safety issues that will make you a safer boater.
'' ° This is not boarding or a law enforcement issue. No citations will be given as
a result of this encounter. We will supply you with a copy of our evaluation so
that you may follow some of the suggestions given. Vessels that pass will be
able to display our distinctive VSC decal. This does not exempt you from law enforcement boarding, but you
can be prepared to make this a positive encounter.

If a vessel meets all of the Vessel Safety Check (VSC) requirements it is awarded
a VSC decal.
