PLEDGE OF ALLEGIANCE: Deputy City Attorney Santana led the Pledge of Allegiance ROLL CALL PRESENT: COMMISSIONERS O'NEAL, GONZALES, MENDOZA, ZANELLI ABSENT: COMMISSIONERS FLORES Also present were: Director of Community Development Preisendanz, Planning Manager Weiner, Deputy City Attorney Santana, Engineering Manager Seumalo, Associate Planner Carlson, Project Planner Coury, Planning Consultant Miller, Planning Consultant Donahoe, and Office Specialist Herrington. PUBLIC COMMENTS (Non-Aeenda Items) No requests to speak CONSENT CALENDAR Chairman O'Neal will be pulling item number's 5, 6, and 7 for separate review and requested a motion on the balance. MOVED BY GONZALES, SECONDED BY ZANELLI AND PASSED BY A VOTE OF 4-0, TO APPROVE THE BALANCE OF THE CONSENT CALENDAR ITEM NUMBERS 5, 6, AND 7. PAGE 2 -PLANNING COMMISSION MINUTES -FEBRUARY 6, 2007 5. Minor Design Review of aSingle-Family Residence located at 17981 Ryan Avenue (APN: 375-284-043) Director of Community Development Preisendanz provided a brief overview of the proposed project and requested that Planning Consultant Miller review it with the Commission and answer any questions. Planning Consultant Miller read the additional Conditions of Approval and stated that the applicant shall place a weather proof 3 foot by 3 foot sign at the entrance of the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the City of Lake Elsinore Code Enforcement Division at 951-674-3124. MOVED BY GONZALES, SECONDED BY ZANELLI, AND PASSED BY A VOTE OF 4-0 TO APPROVE 2007- 23, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A MINOR DESIGN REVIEW FOR A SINGLE FAMILY RESIDENCE AT 17981 RYAN AVENUE WITH A REVISED CONDITION OF APPROVAL. 6. Minor Design Review of a Residential Duplex located at 183 Chestnut Street (APN: 373-152-016) Planning Consultant Miller read the additional Conditions of Approval stating that the applicant shall place a weather proof 3 foot by 3 foot sign at the entrance of the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the City of Lake Elsinore Code Enforcement Division at 951-674-3124. MOVED BY MENDOZA, SECONDED BY ZANELLI AND PASSED BY A VOTE OF 4-0 TO APPROVE RESOLUTION NO. 2007-25, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A MINOR DESIGN REVIEW FOR A TWO STORY SINGLE- FAMILY RESIDENCE LOCATED AT 414 LOOKOUT STREET WITH A REVISED CONDITION OF APPROVAL. PUBLIC HEARING ITEMS Chairman O'Neal opened the Public Hearing at 6:11 pm. 8. Residential Design Review No.'s 2007-2 - "Capri", and 2007-03 "Sommerset" for Vesting Tract Map No. 28214 - 5 (Alberhill Ranch). Director of Community Development Preisendanz provided a brief overview of the proposed project and requested Project Planner Coury to review it with the Planning Commission and answer any questions. Project Planner Coury provided an overview of the project. He states that staff has reviewed the project and it is consistent with the Alberhill Ranch Specific Plan, and that the applicant has provided staff with the information and items necessary to process. Staff is in support of the project, the applicant is in attendance, and environmental clearance is provided through the Addendum No. 2 to the Alberhill Ranch Specific Plan Environmental Impact Report. With that, he states that staff recommends approval of the project subject to the resolutions of the attached Conditions of Approval. Applicant Mr. Tomlison states that the products they are bringing into Alberhill are consistent with the original Specific Plan and give the market-ability to go into a little different range than before. There were no requests to speak for or against the project Director of Community Development Preisendanz adds that the same condition must be added to this project regarding the 3 foot by 3 foot sign, and offers to read that into the Conditions. He states that the applicant shall place a weatherproof 3 foot by 3 foot sign at the entrance of the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the City of Lake Elsinore Code Enforcement Division, 951-674-3124. In addition there was one other change to Condition No. 34 which is located on page 23 of 99, it is the last PAGE 4 -PLANNING COMMISSION MINUTES -FEBRUARY 6, 2007 Condition on the page which identifies the construction with relation to the Noise Ordinances which should be lam - Spm not lam - 7pm. Commissioner Zanelli has no comments but says it's a great product and looking forward to seeing it get underway. Commissioner Mendoza thanked Planning Consultant's Miller and Coury for the changes and the quick response. Vice Chair Gonzales asks if Nichols Road is finished, because the back of the project covers Nichols Road and they had run into some problems with a bit of land in there. Applicant Tom Tomlinson says Nichols Road has been delayed due to land acquisition issues and also MSHCP issues and has currently been 85% graded. There will be about six (6) months worth of work before they can get it to complete state. There has been a delay in the development of Nichols Road (a two lane opening by April 1S` of this year and there will be at least a one year delay before it's completed). Vice Chair Gonzales asked if the applicant is looking at some other alternative because of what is happening with the environment. For example, astroturf for the front yards instead of grass in regards to water shortage programs. Applicant Tom Tomlinson explains they have included a program of solar energy within the project, as one of the larger efforts in recognizing the conditions of the environment. They are using a drought tolerant landscaping process. They have not looked at tank less water heaters due to higher price. Chairman O'Neal said that it is a fine project and compliments the partnership between the City of Lake Elsinore and Castle & Cooke. Chairman O'Neal closed the Public Hearing closed at 6:15 p.m. MOVED BY MENDOZA, SECONDED BY ZANELLI AND PASSED BY A VOTE OF 4-0 TO APPROVE RESOLUTION NO. 2007-26, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE ADOPT FINDINGS PROJECT IDENTIFIED AS RESIDENTIAL DESIGN REVIEW NO. 2007-03 IS EXEMPT FROM THE WESTERN RIVERSIDE MULTI- SPECIES HABITAT CONSERVATION PLAN WITH REVISED CONDITION. MOVED BY ZANELLI, SECONDED BY MENDOZA AND PASSED BY A VOTE OF 4-0 TO APPROVE RESOLUTION NO. 2007-28, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF RESIDENTIAL DESIGN REVIEW NO. 2007-03 FOR "SOMMERSET" THREE-PLAN MODEL HOME COMPLEX WITHIN TRACT MAP NO. 28214-5 WITH REVISED CONDITION. Chairman O'Neal opened the public hearing at 6:24 p.m. 9. Conditional Use Permit No. 2006-20 Sprint/Nextel Wireless Facility. Director of Community Development Preisendanz provided a brief overview of the proposed project and requested Planning Consultant Coury to review it with the Commission and answer any questions. Planning Consultant Court' provided an overview of the project. He stated the staff has reviewed the project and it is consistent with the code requirements as well as the Specific Plan, the applicant is in attendance this evening. Applicant is Tom Hanna, 29222 Hunter Road, Suite 105-166, states that he has read and understands the Conditions of Approval. Chairman O'Neal closed the Public Hearing at 6:21 p.m. COMMISSIONER'S COMMENTS Vice Chair Gonzales has no problems. MOVED BY MENDOZA, SECONDED BY ZANELLI AND PASSED BY A VOTE OF 4-0 TO APPROVE RESOLUTION 2007-29, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING FINDINGS THAT THE PROJECT IDENTIFIES CONDITIONAL USE PERMIT NO. 2006-20 FOR THE DESIGN, CONSTRUCTION AND ESTABLISHMENT OF AN UNMANNED WIRELESS COMMUNICATION FACILITY LOCATED ON THE CANYON HILLS WATER TANK SITE IS CONSISTANT WITH THE MULTI-SPECIES HABITAT CONSERVATION PLAN. MOVED BY GONZALES, SECONDED BY MENDOZA AND PASSED BY A VOTE OF 4-0 TO APPROVE RESOLUTION NO. 2007-30, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. 2006-20 FOR THE DESIGN, CONSTRUCTION AND ESTABLISHMENT OF AN UNMANNED WIRELESS COMMUNICATION FACILITY LOCATED ON THE CANYON HILLS WITER TANK SITE. 10. Zoning Ordinance Text Amendment No. 2006-03; A request to amend Chapter 17:67 of the Lake Elsinore Municipal Code related to Telecommunication Facilities and Associated Antennas. Staff is recommending a continuance of this project off calendar. MOVED BY ZANELLI, SECONDED BY MENDOZA AND PASSED BY A VOTE OF 4-0 TO CONTINUE ZONING ORDINANCE TEXT AMENDMENT NO. 2006-03; A REQUEST TO AMEND CHAPTER 16:67 OF THE LAKE ELSINORE MUNICIPAL CODE RELATED TO TELECOMMUNICATION FACILITIES AND ASSOCIATED ANTENNAS. BUSINESS ITEMS PAGE 7 -PLANNING COMMISSION MINUTES -FEBRUARY 6, 2007 11. Conceptual Design of the Rosetta Canyon Fire Station, Park, and Community Center Project Director of Community Development Preisendanz provided a brief overview of the project and asks Planning Consultant Donahoe to go over the project with the Commission. Planning Consultant Donahoe provided an overview of the project. She states that the project will be going to the City Council next Tuesday to get concurrence on the conceptual design of the project, the architectural features and the floor plan. Director of Administrative Services Pressey is handling the contract for this project and available to answer questions. COMMISSIONER'S COMMENTS Commissioner Mendoza compliments the project, saying that it looks great, he has no questions. Commissioner Zanelli asks if the Fire Department had input into the physical layout of the stations. The applicant confirms that they had multiple meetings with the fire staff and the chief and they had a lot of input and expansion to make it more practical for their use. The design does include on site fueling for the fire vehicles. Vice Chair Gonzales has no questions. MOVED BY ZANELLI, SECONDED BY MENDOZA AND PASSED BY A VOTE OF 4-0 TO APPROVE CONCEPTUAL DESIGN OF THE ROSETTA CANYON FIRE STATION, PARK AND COMMUNITY CENTER PROJECT. Director of Community Development Preisendanz states that the project has gone through many changes and states that staff has had input into the project. STAFF COMMENTS Public Works Director Seumalo states that the CIP update for this evening will include the Ortega Highway and Grand Avenue project which is under construction although activity may not be seen on the roads. The City contracted with a separate paving contractor regarding the I-15 Railroad Canyon Road project and the asphalt should be put down later this week. The project should extend from the north bound ramps from the I- 15 and Railroad Canyon Road to the Carl's Jr. driveway and the construction may be delayed. The Lakeshore Drive Historic Lights project should see construction February PAGE 8 -PLANNING COMNIISSION MINUTES -FEBRUARY 6, 2007 20~' . He will be attending a meeting tomorrow to consider the Franklin Interchange for the Ultimate Interchange Project. There was a Federal Grant application called for and the City is $23,000,000 short if this Interchange is approved by Cal-Trans. Also, traffic will be open on Railroad Canyon Road during construction; however, delays can be expected. Commissioner Zanelli asked Public Works Director Seumalo why the lake re-alignment work stopped in that azea. Public Works Director Seumalo comments that the stoppage has to do with the annexation, and that a lot of the re-alignment is in the county area and although they have a good working relationship with county transportation staff, the work is still in their area, so initially they agreed to let the City inspect the project, however, since the annexation has been delayed, the work in that area has been stopped until the annexation continues. Planning Consultant Coury states that the annexation that Public Works Director Seumalo is referring to is the Pacific Clay Annexation and part of the conditioning for that was for "Running Dear Annexation". They are currently working on the environmental clearance. COMMISSIONER'S COMMENTS Commissioner Zanelli asks Planning Consultant Coury to inform the Commissioners of the dates of the neighborhood meetings. Planning Consultant Coury said yes. Commissioner Mendoza has no comments. Vice Chair Gonzales has no comments. Chairman O'Neal thanks the staff for the Joint Study Session that they had.
