The iayor and Council of the City of Elsinore~ do ordain as follows; Section l; Definiti.ons. (a). For the purpose of this ordinance~ the word "garUage" shall be held to include and rnean kitchen and taLle re£use, leavings, ozial, s~ill and every accumulation of animal, vegetable :r. and other mat.ter that attends or results from th~ preparation, consumption~ 3ecay~ dealing in or stora~e o£ meabs, £ish, £owls, £ruits, v?getab7.esand othe foo.d. (b). The term "waste matter'", and the term 16rubbisn'~ shall and ea~h of them shall~ £or the purpose o£ this ordinance, include and U~ held to mean, crockery, bottles, broken brick, tancans~ metal vessels~ trimiqings ~.nd prunings £rom lawns~ t.rees and gardens, oasteboard boxes, berry boxes, ra+~s, paper, straw, saw-~ust, packing material, shavings, boxes, ashes~ and all other matter corimonly discarded and not hereinabo~re included in the de~'inintion of the word ",~,arbage.° Secti:on 2; No person, f~rm~ or coxrooration, shall dump, p3ace or bury in any lot, land, street, alley or watercaay vithin the corporate limi.ts of the City of Elsinore, an~ garbage, ruboish, waste matter or sub- stance condemmed "ny the Health Cfficer, or any other deleterious or of£ensive substances. Section 3; No person, £irm, or corporation, shall burn or permit to be Uurned in the open air within the city o£ Elsinore, either npon private property or upon any street, alley, park, waterway or auolic pl.ace, any ~I garbsge or any ~*~ste matter which shall in burn:ng, cause or create an o£fensive odor or a dense or offensive smoke. Sc ction 1~; Every tenant~ lessee or occupant of any prer2ises _ ~rhere~arbage is produce3, shall prcvide upon such oremises in"a suitaLle place to be designated by the garbag~ collector, one or more ~alvanized metal garbage receptacles „~aith tight fitting galvanized metal cover~ an3 fitted with handles for receiving and holding all garbage prodiced unon such premises between the times o£ collection and removal. Every tenant~ lessee or occupant ofany~bremised where ruboish or waste mati;er is preduced, shall~ i£ necessary, i.n addition to th~ garbage receptacle, pro~i3~ unon such ~ramises, in a suitable place, one or more recentacles to contain all rubbish and haste matt?r v,~hich may a ccumulste upon such premises bett.reer. removals~ Al1 such receotacles shall at all times be located in such places as to be rea3ily accessibl.e for removing and ~mptying the sama~ and i.n such olaces as may be :3esi.gnated by the Supt, o£ Public ~Jorks, but shall not be placed Urithin the lirnits of any street or alley. Section 5; kll gar'ua~e and za.ste rnatter receptacles shall be kent in a clean and sanitary con3iti.on by t'r.e otimer or pe;son using the sarne, and gar~a~e receotacles shall be at all 'cimes k~,r,t tightly covered~ exceot tahen garbage is being deL~csited therein or removed therefrom, and shall at ~11 times be oroo£ Ggainst the access by flies to th~ contents thereo£, Section 6; There is hereby estaulished a Sanitation ~epartment ' of the City o~Isinore, whi.ch shall Le in charge of and under direct super- ~, vision of the Supt. of Public ~~ior'_~s who may be appointed an~ rernoved at the pleasure o£ the Council by resolution, It shall be the duty o£ tne garbage collector to: (a) Collect all garbage from the City o£ ~lsir:ore and. remove the s~me from all]boarding housPS~ restaurants, hotels,'eat.ing houses, markets~ gxroc°ry stores, £r;u t stores, stores sellin~; £ruits or vegetables, oublic camnl ing grounds and other places o£ business, ai least once each day and £rom all lv,relling houses at ieast three times in each week; 10? ~o~ . Section 8; Ordinances No. 155 and 213 of the City of Elsinor~ and othe ordinances or parts of ordicances ;n confl.ict herewith are hPreby repealed. iln3r person violating an;~ of the orovisidns oS thi.s ordinanc~ shall be deemed guilty o£ a mesdemeanor and unon conviction thero£ shall be l~unisl.ed by a fine not exceeding the sum o£ :~300.~'0 or by imprisonxnent in the cit;~ jail for a period net exce~ding three months or by both such iine and i;nprisonment.
