AI~1 ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ELSINORE RELE~TING TO DISASTLRS.
Whereas, experience during the wqr and peace has demonstrated the need
for adequate disaster plans and for mobilization of the resources oP the cotmnunity
to cope with such disasters; and~
Whereas, the State of California has created a:State Disaster Council to i-~
prepare a state disaster plan and to recommend mutual aid regions; and,
!dhereas~ munieipalities have legal authority (Constitution, Article XI,
Section 11, and Military and Veterans Code Section 1571; as amended by Statutes o£
1945, Chapter 1021~, to create disaster councils for the purpose o£ formulating local
disaster plans, including ciutual aid agreernents; now,-therefore~
The City Council of the City o£ Elsinore does ordain as £ollows:
Section L DISASTFR, As used in this ordinance, the term "disaster" shall
inolude, but is not limited to, any extraordinary fire~ flood, riot, storn, epidemic
or earthquake~ or anv enemy attack or sabotage, w hich causes or threatens to cause
loss of life or property and in which occurrences the responsiblit~r devolves upon
the regular constituted authorities for the maintenance o£ public peace and order and
the preservation of life and property. It shall not include an3r conditions resultin;
from a Iabor controversy,
Section 2. DISASTER COUNGIL. N1EMB~,RSHIP. The Elsinore Disaster Council
is hereby created and shall consist of the following:
A. The Mayor, who shall be chairman.
B, The Commander, who shall be vice-chairman.
C. The Vic-commander, appointed b5r the CitJ Council~ who in the absence'of--l
or at the direction of, the Commander, shall act on his behalf on matters within I
the purview of this ordinance. I
D. The Chiegs o£ Divisions as hereinafter provided. ~
E. Such other representatives of civic, business, labor , veberans, pro-
fessional or other organizations as ma~* be apnoint~d by the mayor with the advice
and consent of the City Council.
Section 3. DISASTE.R -0OUNCIL. PO;dERS AND DUTIES. I~ shall be the duty o£
of the.~lsinore Disaster Council, and it is hereby empowered:~
A. To develop a plan for meeting any disaster. Such plan shall provide
for the e££ective mobilization o£ all the resources of the comnunity, both oublic
and,private:

B. To,prepare and r$commend.for consideration by the.City Gouncil ordin-
ances necessary to implement the disaster plan:
C. To consider and recommend to the Cit,y Council for approval mutual,aid
plans and agreements:
D. Others. (as determined locally.)
` The Disasten Council shall meet upon call of the chairman.
Section 4. CONl~ANDER._:PD;+TERS AND DUTIES. There is hereby created the office
of Corr¢nander. Such oFficer shall be apgointed by the mayor with the advice and consent
bf the Cit~* Council.

A. To proclaim the existence or threatened exi.stence of a disaster and the
termination thereof: ;~
B. To request the Governor to proclaim a state of extreme emergency in the
area in and around. +?~e Ci.tv of El.sinore when in the opinion o£ the Commander the resources
of the cor~¢nunity are inadequate ~o isope ro~[ith the disaster:
C. To govern and direct the effort of'the Elsinore Disaster ~orps in the
accomplishment of the purposes of this ordinance:
D. To direct coordination and cooperation between the chiefs of:'divisions
and resolve questions of authority and responsibilit;~ that may arise between them:

E. To represent the Disaster Corps in all dealings with public or private
agencies pertaining to disaster preparedness.
It shall also be the dut;~ of the Commander,_and he is hereby empowered, during
a disaster or when a disaster is imminent:
A. To snake and issue rules a nd regulations on matters reasonably related
to the protection of life and property as affected by such disaster:
B. To obtain vital supplies, equipment and such other properties found
lacking and needed £or the protection of the life and property of the people, and bind
the city for the £air value thereof, and, if required inmediately~ to commandeer the
same for public use: ,
C. To require emergency services of zaiy'city o£ficer or employee:
D. To requisition necessary personnel or material of any City department o~
agency:
E. To execute all of the special powers conferred upon him by this ordinance
and all powers conferred upon him by any other lawful authority.
Section 5. EXECUTIVE OFPIGER. There is hereby created the position of
Executive Of£icer of the Disaster Corps. The Executive Of£icer shall be appointed by
the City Council. The Eacecutive Officer shall be the executive secretary of the Dis-
aster Couneil and shall be Chie£ o£ the Division o£ Personnel and Recruitment.
Section 6. DISASTER CORPS. GENERAL..Officers and employees of the City of
Elsinore~ together with those volunteer forces enrolled to aid them during a disaster, and
all groups~ organizations arid persons who ma5r by agreement or operation o£ law be charged
with duties incident to the protection o£ life and property in the Qity of Elsinore
during such disaster, shall cona~~tute the Elsinore Disaster Corps.
Section 7• DIVISIONS OF DISASTER CORPS. The functions and duties o£ the
Elsinore Disaster Corps shall be distributed among the £ollovring di¢isions of such corps,
each division to be under the direction o£ a Chief and, in his absence, the first deputy
and second deputy chief, respectively~ appointed by the Chief~ and said division to
consist of the following £orces, organizations and serviees, and such other £orces,
organizations or services as may be included pursuant to the provisions of this ordin-
ance. The chie£s of divisions shall organize and train volunteers assigned to such ,
division by the Personnel and Recruitment Division and shall Formulate the division
plan which, when approved by the Disaster Council~ shall become an annex to the disaster
:plan. The Chiefs of Divisions shall include in the division plans recommended mutual '
aid agreements. The Chiefs of Divisions shall be custodians of special equipment and
other property which may be obtained from any source and assigned to such division by
the Commander. ~
A. LAW AND ORDER,<DIVISION. This division sha11 be under and subject to
the control of the chief of police, who shall be chief of the Law and Order Division.
The division shall consist o£ police personnel and aw~iliary police,(volunteers)~
B. FIRE DIVISION. ThiS division shall"be under and subject to the control
of the chief of the Pire department, whoc shall be chie£ oi the Fire Division. The
division shalL consist of Fire department personnel and auxiliary fire £ighters (volunt
C. MEDICAL DIVISION. This division shall be under and subject to the control
of the county health officer~ who shall be Chie£ of the I~iedical Division. The division
shall consist of health department personnel and medical service volunteers.
D. PUBLIC WORKS DIVISION. This division shall be under and subject to the
control of the city engineer who shall be Chief of the Public ldorks Division. The
II ~, division shall consist of the department o£ pubLic works personnel and auxilary per-
___ sonnel (volunteers.):
E. UTILITIES DIVISION. This division shall be under and subject to the
control of the utilities department~ and the head of such department shall be chief
of the division. The division sha11 consist of utilities department personnel and
' auxiliary personnel (volunteers.)
F. TRANSPORTATION DIVISION. The chief oF this division shall be a citizen~
e~perienced and enga~ed in such industry~ appointed b,y the mayor with the advice and
consent of the City CounciL Tfie division shall consist of auxiliary personnel (
volunteers). '
G. COMMUNICATIONS DIVISION. The chief of this division shall be a citizen
experienced and engaged in such industry, app~inted by the mayor with the advice and

consent of the Cit;~ Couneil~ The divis-on shall consist of auxiliary personnel
(volunteers) and the city personnel engaged in commenications work.
H. PERSONNEL AND RECRUITMENT DIVISION, mhis division shall be under
and subject to the control of the Executive Officer. It shall be the duty of
this division to recruit all volunteer personnel, to enroll and register such
personnel, to keep adequate records thereof~ and to assign such personnel to other
divisions of the Dis~ster Corps. The Executive Officer may establish and operate
a volunteer office.
I. AMERIGAN RED CROSS. The American Red Cross in the City o£ Elsinore
will furnish food,: clothing, shelter, re~istration and in£orm~tion service,
supplementary medical service when requested, and rehabilitation to individuals
and families a£feeted by a disaster. The American Red Cross will provide funds
with which to finance all its xelie£ operations. The chie£ of this division will
be the chairman of the City Elsinore C~pter of the American•Red Cross, or a dele-
gated representative thereof.
J: OTHliR.S. (AS DETERMINED UJCALZY).
Sectiqn 8. .VOLUNTEERS. Al1 persons, other than of£icers and employees
o£ the city~ volunteering services pursuant to the provisions o£ this ordinance~
shall serve without compensaicion from the city. While engaged in such servies,
the,y shall have the same immunities as o£ficers and employees of the city performing
similar duties.
Section 9. PUNISI~IENT OF VIOLATIONS. It shall be raisdemeanor, punishable
b~ a fine o£ not to exceed ~500.00~ or by imprisonment for not to exceed six months~
ar both~ £or any person during a disaster:
A. Wiltlxlly to obstruct, hinder or delay any m~nber of the Disaster Corps
in the en£orcement of any lawFul rule or regulation issued pursuant to this ordinance,
or in the performance o£ any duty imposed upon hi.m by virtue of this ordinance:
B. .To do any act forbidden by any ~.awful rule or regulation issued
pursuant to this ordinance, i£ sueh act is of such a nature as to give,, or be lilcely,-I
to give t{ssistance to the enemy~ or to imperil the lives or property of o ther inhabit
ants of this city~ or to prevent, hinder or delay the deFense or protection thereof:' j
C. To wear, carry or display,'wit3~outau~hority, any means of identi£ication
speci£ied bZ* the Disaster CouneiL
Section l0. EFFECTIVE DATE. This ordinance is hereby declared to be an
emergency measure necessary for the immediate preservation o£ the public peace, health
and sa£ety, and shall take effect immediately. The following is a statement of the
facts showing its urgeney:
'' A complete and adequate disaster plan must be,£ormulated at once by the
Disaster'Council. The plan wi11 be based upon plans formulated by the chiefs of
diuisions and upon mutual aid agreements. To protect the lives and prnperty o£ the
citizens of the City o£ Elsinore, responsibility for the formulation of such plans
and agreements should be fixed immediately.
S~etioii:ll. That the City Clerk shall certify to,the passa~e of this
ordinance and shall cause the same to be published once in the Elsinore Leader-Press.
