HomeMy WebLinkAboutCC Reso No 1963-1095 RESOLUTION 1095 "WHEREAS, 'the City Council of the City of Elsinore has long sought means to remedy the' faulty alignment of Chaney street at the Santa Fe tracks; paralleling the Collier street r@adway, and WHEREAS, to accomplish this work it is necessary to enter into agreements with the Santa Fe Railroad and the COu','lty Road Department of Riverside County, and Whereas, it is the Council' sintent to accomplish this much needed public works as soon as possible, THEREFORE, BE IT RESOLVED, that by the following signatures, the members of the City Council hereby authorize the :r-1~or or the City Administrator to execute the necessary agreements necessary for the completion of the subject project. W'IT1'UPe;lSE'fH: WHEREAS, City proposes a program of realignment, improvement and widening to width of 24 feet that portion of Chaney street between Minthorn Street and Old Highway 71, which program includes relocation and widening to said 24 feet the crossing of $antaFe' s track designated by Public Utilities Commission, state of California as Crossing No. 2T-20.6, and WBRUa, santa Fe andCi ty are in accord as to said program and crossing relocation and santa Fe is willing that City or City's contractor do all work under said program. except removal of existing crossing, preparation of Santa Fe's track to receive pa.ving, including the placing of header planks at new location, reloe8.tion of Santa Fe's communication line, and installation of two reflectorlzed crossing signs. NOW 'l'HEREFORE IT IS AGREliID: 1. City or City's contractor will do all work under said program including placing pavement within track area of said crossing, except tha.t work hereinafter specified to be done by Santa. P'e. .. 1 - 2. Cit,- or Cit,-'s contractor will comply with Santa Fe's rules and regulations and the instructions of Santa Fe's representatives in relation to the proper _Mer of protecting Santa Fe's track and traffic moving thereon, as well as wires, signals and other property of Santa Fe, or its tenants or licenssees, at or in vicinity of the work during the pe:t'iod of construction of said improVeIl1ent, and shall perform the work in a manner satisfactory to Santa Fe or its designated repre- sentative, and at such times as shall not enda.nger or interfere with the safe operation of Santa Fe IS track and. other facilities. :3. Santa Fe will, at expense of City: (A) Remove exuting crossing and prepare its tracks to receive paving at new crossing, in- cluding header planks for paved width of 24 feet. (B) Relocate Santa Fe's communication line to clearance, side and overhead, of relocated road:way, and (c) install two reflectorized crossing signs. 4. Work sp$cified 1n above Paragraph :3 to be done by Santa Fe shall be done as soon. as practicable, considering completion of said progrq, availability of material and manpower, and in consideration thereof City will pay to Santa Fe the actual cost thereof presently estimated by Santa Fe to be One Thousand Four Hundred Seven ($1.,40'7.00) Dollars. 5. That upon completion of the work specified in Paragra.ph :3 hereof, Santa Fe w111 render C1 ty a bill for costs thereof and Oi ty will promptly reimburse Sallta Fe for such costs. 6. Santa. Fe will, at its expense, maintain the street paving within the track area of said crossing and for two feet outside thereof so long as required to do so. -2- '1. City will, at its sole expense, maintain any street improvement within said erossingother than specified to be maintained by Santa Fe in Paragraph 6 hereof. 8. The material excavated for the relocated street and on each side thereof, within Santa Fe t s right of way J shall be placed within said right of way-as directed by Santa Fe's representative.
