HomeMy WebLinkAboutCC Reso No 1963-1089 RESOLUTION NO. 1089 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NCYl'ICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, FEBRUARY 26, 1963, FOR THE PURPOSE OF SUBMITTING TO THE ~UALIFIED VCYl'ERS OF SAID CITY A PROPOSITION FOR THE ISSUANCE OF WATER REVENUE BONDS BY SAID CITY. The City Council of the City of Elsinore, California, DOES HEREBY RESOLVE, DErERMINE AND ORDER as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of Elsinore, California, on Tuesday, February 26, 1963, for the purpose of submitting to the qualified voters of said city the proposition of issuing water revenue bonds pursuant to the Revenue Bond Law of 1941 (Chapter 6, Part 1, Division 2, Title 5 of the Government Code of the State of California) in the amount and for the objects and purposes hereinafter set forth, including all expenses incidental thereto or connected therewith. Section 2. That the purpose for which said bonded indebtedness is to be incurred and revenue bonds issued therefor is as follows: The acquisition, construction and financing of extensions of, additions to and improvements of the water system of the City of Elsinore, 1n- eluding the construction of separate facilities to store, convey and supply mineral water, the construction of reservoirs, pumping plants, water transmission mains, pipelines and appur- tenances and appurtenant works, wells, the acquisition of all water rights, lands, rights of way, easements and other property necessary for any of the foregoing, and including all engineering, inspection, legal and fiscal agent's fees, costs of the bond election and of the issuance of said revenue bonds, bond reserve funds and working capital and bond interest to accrue during the construction period and for a period of not to exceed twelve months after com- pletion of construction, and other costs and estimated costs incidental to and connected with such acquisition, construction and financing. Section 3. That the estimated cost of such acquisition, construction and financing is $400,000. That the principal amount of the bonds proposed to be issued is $400,000. That the maximum rate of interest to be paid on said bonds shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable semiannually except that interest for the first year may be payable at the end of said year, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That if the proposition for the incurring of bonded indebtedness so submitted receives 20 the requisite number of votes, to wit, the votes of a majority of all the voters voting on the propoSition, revenue bonds as provided herein in not exceeding the principal amount stated in such proposition shall be issued and sold for the purpose set forth herein. Said bonds are to be revenue bonds payable exclusively from the revenues of the enterprise and are not to be secured by the taxing power of the City of Elsinore. Section 5. That the enterprise referred to herein is defined to be the entire water system of the City of Elsinore including all improvements and exten- sions later constructed or acquired. Section 6. That the polls for said election shall be opened at seven o'clock A.M., of the day of said election and shall remain open continuously from said time until seven o'clock P.M., of the same day, when said pOlls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California. Section 7. That on the ballots to be used at said special election, in addition to any other matter required by law, there shall be printed substantially the following: MARK A CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) 3. MUNICIPAL BALLOT SPECIAL MUNICIPAL ELECTIONS CONSOLIDATED CITY OF ELSINORE RIVERSIDE CO UNTY I CALIFORNIA Tuesday, February 26, 1963 INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the votin~ square after the word "YES" or after the word NO. II All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. PROPOSITION: Shall the City of Elsinore issue water revenue bonds in : the principal amount of $400,000 for the acquisition, construction and fi- nancing of extensions of, additions to and improvements of the water system of the City of Elsinore, including the : construction of separate facilities to store, convey and supply mineraI water, the construction of reservoirs, pump- ing plants, water transmission mains, pipelines and appurtenances and appur- tenant worlcs, wells -' the acquisition of all water rights, lands, rights of way, easements and other property necessary for any of the foregoing, and including all engineering, inspec- : tion, legal and fiscal agent's fees, costs of the bond election and of the issuance of said revenue bonds, bond reserve funds and 'trlOrking capital and bond interest to accrue during the construction period and for a period of not to exceed twelve months after completion of construction, and other costs and estimated costs inci- dental to and connected with such acquisition, construction and financing? . . . A cross (+) placed in the voting square after the word "YESu in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (+) placed in the voting square after the word tlNOu in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 9. That the manner of holding the election shall be as provided in this resolution and the manner of voting on the issuance of bonds shall be as provided in this resolution. That in all particulars not herein recited the election shall be held and the votes canvassed pursuant to law for general municipal elections held in the City of Elsinore. Section 10. That for the purpose of holding said special election there shall be and hereby are established four (4) consolidated voting precincts designated as herein- after stated. Each such consolidated voting precinct shall consist of regular election precincts in the City of Elsinore (of the numbers hereinafter stated) established for the hold- ing of state and county elections, as said regular election precincts exist on the date of adoption of this resolution. That the polling places for the respective precincts shall be the places hereinafter designated; and that the persons hereinafter named, being competent and qualified electors and residents of said City and of their respective voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. 5. Consolidated Voting Precinct No. I shall consist of regular election precincts Elsinore Nos. I and 8. Section 11. That the City Clerk shall certify to the passage and adoption of this resolution and shall cause said resolution to be pUblished once a week for two succes- sive weeks in the LAKE ELSINORE VALLEY SUN~ a newspaper of general circulation publiShed less than six (6) days a week in the City of Elsinore. No other notice of such election need be given. Section 13. This resolution shall take effect upon its adoption.
