HomeMy WebLinkAboutCC Reso No 1977-46RESOLUTION"N0. ] 7-46 A RESOLUTION OF THE CITY OF iAKE ELSINORE FINf1ING THAT PORTIONS OF A CERTAIN ALLEY ARE UN~dECESSARY FOR PRESENT OR PROSPECTIVE ALLEY PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE hereby ordains and resolves as follows: . SECTION ONE: The City Council of the City of Lake Elsinore having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets - and Highways Code of the State of California, ahd having held a public hearing as provided therein, hereby finds from all evidence submitted that portions of a certain a11ey described in this resolution are unnecessary for present or pros- pective alley purposes and that the public interest and conveniense require the closing of said portions of a certain alley. SECTION TWO: The City Council hereby orders the vacation of portions of certain alley in Mountain View Subdivision as follows: All of Lot D and that portion of Lot C lying easterly of the southerly prolongation of the westerly line of Lot 10 in Mountain View Subdivision, as shown on map recorded in Book 34 of Maps, Pages 15 and 16 thereof, records of Riverside County, California. SECTION THREE: In the proceeding herein adopted by this City Council for ~. the vacation of portions of a certain alley described in Section Two, the City of Lake Elsinore reserves and excepts from the vacation the permanent easement. and right at any time, or from time to time, to construct, maintain, operate, replace, remove and revew in, upon, over and across any alley or part thereof proposed to be vacated, pursuant to any existing franchises or renewals thereof, or otherwise, to maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of telegraphic and telephone lines, and for the distribution or transportation of electric energy, including access and right to keep property free from inflammable materials and wood growth, and to other- wise prctect the same from all hazards in, upon, and over the portion of the alley proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of portions of the alley described herein is required by public interest, con- venience, safety and welfare.
