HomeMy WebLinkAboutPC Reso No 2013-81RESOLUTION NO. 2013 -81 (AMENDED) RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVE GENERAL PLAN AMENDMENT NOS. 2013 -03 AND 2013 -04, CLEANUP AMENDMENTS TO THE EAST LAKE AND LAKE VIEW DISTRICTS, AS PART OF THE CONSISTENCY ZONING PROJECT, PHASE III, CORRECTING THE BOUNDARIES OF THE EAST LAKE SPECIFIC PLAN AS SHOWN ON THE GENERAL PLAN LAND USE MAP; AND CORRECTING VARIOUS LAND USE DESIGNATIONS TO ACCURATELY REFLECT EXISTING USES AND DENSITIES IN THE LAKE VIEW DISTRICT WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on December 13, 2011; and WHEREAS, Government Code Section 65358 empowers the legislative body to amend all or part of an adopted general plan if to do so would be in the public interest and so long as no mandatory element of the general plan is amended more frequently than four times during any calendar year; and WHEREAS, General Plan Amendment Nos. 2013 -03 and 2013 -04 (the "project ") are part of the City's Third (3rd) Cycle amendments to the Lake Elsinore General Plan for the 2013 calendar year; and WHEREAS, public notice of the General Plan Amendments has been given and the Planning Commission of the City of Lake Elsinore has considered the evidence presented by the Community Development Department and other interested parties at a public hearing held on October 1, 2013 and December 3, 2013, with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has reviewed and analyzed the proposed General Plan Amendments pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §§ 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed General Plan Amendments are consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. SECTION 2. That in accordance with the California Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission hereby makes the PLANNING COMMISSION RESOLUTION NO. 2013 -81 (AMENDED) Page 2 of 5 following findings for the approval of General Plan Amendment Nos. 2013 -03 and 2013- 04: 1. The proposed General Plan Amendments will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendments or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed General Plan Amendments have been analyzed relative to their potential to have detrimental effects to ensure that the health, safety and welfare of surrounding residents will be protected. b. The proposed General Plan Amendments appropriately identify land uses on the General Plan Land Use Map. C. The proposed General Plan Amendments recognize viable existing development, and promotes their continued use. 2. The proposed General Plan Amendments will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. The proposed General Plan Amendments apply reasonable buffering of adjacent uses. 3. The proposed General Plan Amendments would establish a land use density, intensity and usage more in character with the subject property's location, access, and constraints. a. The proposed General Plan Amendments recognize residential land use densities that are compatible with surrounding development. 4. The proposed General Plan Amendments will not have a significant effect on the environment. The effects of the General Plan Amendments have been analyzed in the Recirculated Program Environmental Impact Report (SCH #2005121019) prepared for the City of Lake Elsinore General Plan and its related cases which was certified on December 13, 2011, and adequate mitigation measures have been prepared where necessary. SECTION 3. Based upon the evidence presented, both written and testimonial, and the above findings, the Planning Commission hereby recommends approval of General Plan Amendment Nos. 2013 -03 and 2013 -04, and incorporating these amendments into the General Plan as shown on the attached Exhibits `A' through 'C:' PLANNING COMMISSION RESOLUTION NO. 2013 -81 (AMENDED) Page 3 of 5 East Lake Specific Plan Boundary — Include within the boundaries of the East Lake Specific Plan, the following properties: Assessor's Parcel Nos. 370 - 120 -045, and -067 thru —075 from R Recreation, LMR Low Medium Density Residential, and MDR Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 - 411 -005 thru -011; 370 - 412 -001 thru —014; 370 - 413 -001 thru -010, -015 thru -026; 370 - 414 -001 thru -020; and 370 - 415 -001 thru -005 and -021 thru -024 from LMR Low Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 -412 -015 thru -021 and 370 - 415 -006 thru -015 from MDR Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 - 520 -001 thru -021; 370 - 521 -010 thru -028; 370 - 522 -001 thru -014; and 370 - 523 -001 thru -024 from LMR Low Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 - 521 -001 thru 007, -030, -034 and -036 from MDR Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 - 530 -001 thru -067; and 370 - 531 -001 thru -016 from LMR Low Medium Density Residential to SP Specific Plan; and Assessor's Parcel Nos. 370 - 540 -001 thru -018; and 370 - 541 -001 thru -036 from MDR Medium Density Residential to SP Specific Plan; As shown on Exhibit 'A.' Lake View District — Change the Land Use Designation in the General Plan as follows: Assessor's Parcel Nos. 391 - 560 -005, -008, -009, -010, -012, and -013; 391 - 571 -001 through -035; and 391 - 790 -004 from HR Hillside Residential to LMR Low Medium Residential; and Assessor's Parcel No. 391 - 790 -006 (Riverside County Parks and Open Space District) from Hillside Residential to Open Space; As shown on Exhibit 'B.' Assessor's Parcel Nos. 379 - 111 -010, 011, and -012 (Lake View Apartments); 379 -111- 015 and -016 (North Lake Apartments); 379 - 111 -002 (Sierra Vista Apartments); 379- 111 -001; 379 - 131 -018 (Walnut Grove Apartments); 379 - 050 -035 and -036 (Harbor View Apartments); 379 - 050 -039 (Grand Oaks Apartments) from MDR Medium Density Residential and GC General Commercial to HDR High Density Residential; and PLANNING COMMISSION RESOLUTION NO. 2013 -81 (AMENDED) Page 4 of 5 Assessor's Parcel No. 379 - 111 -013 (Elsinore Valley Municipal Water District) from MDR Medium Density Residential to PI Public /Institutional; As shown on Exhibit 'C.' SECTION 4. This Resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED AND ADOPTED on this third day of December 2013.
