HomeMy WebLinkAboutCC Reso No 1982-50RESOLUTION N0. 82-50 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE F.LSINORE APPROVING RESOLUTION OF INTENTION AND BOUNDARY MAP FOR AND CONSENTING TO THE WORK AND FORMATION OF ASSESSMENT DISTRICT N0. 79-1 (CANYON LAKE) OF ELSINORE VALLEY PNNICIPAL WATER DISTRICT WHEREAS, the Board of Directors of the Elsinore Valley Municipal Water District ("this Board of Directors") has initiated proceedings under the Municipal Improvement Act of 1913, Division 12 of the Streets and Highways Code of the State of California, to finance the construction, acquisition and installation of certain sanitary sewer improvements within a portion of said District known as the Canyon Lake area and to be designated for purposes of such proceedings as "Assessment District No. 79-1 (Canyon Lake), Elsinore Valley D4unicipal Water District, County of Riverside, California," and for the levying, collecting and enforcement of assessments to cover the expenses of such improvements and the issuance and enforcement of bonds to represent unpaid assessments; and WHEREAS, pursuant to Section 10103, 10104 and 5115 et seq• of said Code this Board of Directors has previously submitted to the Board of Supervisors of the County of Riverside for its approval a Resolution of Intention together with a map which indicates by a boundary line the extent of territory included in the proposed assessment district, and the Board of Supervisors has approved said Resolution of , Intention and map by its adoption of Resolution 80-265; and~ WHEREAS, the Board of Directors of the Elsinore Valley Municipal Water District wishes to obtain the consent of the City Council of the City of Lake Elsinore to the and to the inclusion of that territory proposed to be included within Assessment District No. 79-1 (Canyon Lake) ''which lies within the boundaries of the City of Lake Elsinore and the Elsinore Va11ey P4unicipal ~dater District and to the work described in the resolution of intention and to the assumption of jurisdiction thereover in order that it may adopt its resolution of intention and proceed with Assessment District No. 79-1 (Canyon Lake), " NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION ONE. That the resolution of intention entitled RESOLUTION OF THE BOARD OP DIltECTORS , OF THE ELSINORE VALLEY MUNICIPAL WATER DISTRICT DECLARING INTENTION TO ORDER THE j CONSTRUCTION OF CERTAIN IMPROVEMENTS TOGETHER WITH APPURTENANCES AND APPURTENANT WORK IN A PROPOSED ASSESSMENT DISTRICT PURSUANT TO THE MUNICIPAL It~ROVEMENT ACT OF 1913; DECLARING THE WORK TO BE OE MORE THAN LOCAL OR ORDINARY BENEFIT AND DESCRIBING THE DISTRICT TO BE ASSESSED TO PAY THE COSTS AND EXPENSES THEREOF; PROVIDING FOR THE ISSUANCE OF BONDS AND AMENDING RESOLUTION N0. 79-7 AND RESOLUTION N0. 79-12 and the map indicating by a boundary line the extent of territory included in the proposed assessment district and entitled, "PROPOSED BOUNDARIES OF ASSESSMENT DISTRICT N0. 79-1, ELSINORE VALLEY MUNICIPAL WATER DISTRICT, COUNTY OF RIVERSIDE, STATE OF CALIFORNIA," are hereby consented to and approved. SECTION TWO. That this resolution is adopted pursuant to Section 10104 of the Streets and Highways Code of the State of California to enable the Board of Directors of the -2- Elsinore Valley PSunicipal Water District to adopt said resolution of intention and therea£ter take each and every step required for or suitable for the formation of the assessment district, acquisition of necessary rights-of- way, consummation of the work and the levying, collecting and enforcement of the assessments to cover the expenses thereof and the issuance and enforcement of bonds to represent unpaid assessments. SECTION THREE. That the City Clerk is hereby directed to transmit a certified copy of this resolution to the Secretary of the Board of Directors of the Elsinore Valley Municipal Water District.
