HomeMy WebLinkAboutCC Reso No 1982-47RESOLUTION NO. 82-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE~ CALIFORNIA MEMORIALIZING THE POLICY TO REQUIRE RESIDENTIAL DEVELOPERS TO REACH MITIGATION AGREEMENTS WITH THE SCHOOL DISTRICTS CONCERNING SCHOOL IMPACTION CAUSED BY THE CONSTRUCTION AND OCCUPATION OF RESIDENTIAL PROJECTS WHEREAS, the Elsinore Union School District and the Elsinore Union High School District provide educational services to the residents of the City of Lake Elsinore; and WHEREAS, the City Council finds and determines that there exist conditions of overcrowding in the Elsinore Union School District and the Elsinore Union High School District; and WHEREAS, by law all new residential subdivisions constituting "projects" must have their identified adverse environmental impacts either mitigated or avoided unless the City Council finds that specific economic, social, or other considerations make such mitigation infeasible; and BE IT THEREFORE RESOLVED that 1. The City Council hereby reaffirms its policy that no new tentative subdivision maps; new tentative parcel maps; or new conditional use permits providing for residential living units shall be approved until the owner and/or developer and the Elsinore Union School District and the Elsinore Union High School District have agreed in writing to a means by which the impaction caused by the construction and occupation of such project will be adequately mitigated; 2. The Planning Department and the Planning Commission are hereby directed to condition the approval of any new tentative subdivision map; any new tentative parcel map; or any new conditional use permit providing for residential living units upon the mitigation of school impaction by a written agreement between the bwner/developer of the project and the Elsinore Union School District and the Elsinore Union High School District; and 3. The City Council expressly declares that nothinq contained herein shall be construed as a delegation of the power and responsibility of the City Council to determine the issue of mitigation of adverse environmental effects, and the City Council specifically reserves to it all rights currently or hereinafter provided by law.
