RESOLUTION NO. $2-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE DESIGNATING THE COUNTY OF RIVERSIDE
AS ITS AGENT FOR SERVICE OF PROCESS FOR ACTIONS
FOR REFUND OF CITY PROPERTY TAXES AND FURTHER
PROVIDING FOR SUCH ACTIONS TO BE DEFENDED BY THE
COUNTY COUNSEL OF THE COUNTY OF RIVERSIDE
WHEREAS, Revenue and Taxation Code Section 5149 was
amended effective January 1, 1982,
WHEREAS, the City Council of the City of Lake Elsinore,
upon recommendation of the City Attorney, desires to have property
tax refund actions defended by the County Counsel, and
WHEREAS, to accomplish that end, it is necessary to
designate the County of Riverside as its agent for service of
process,
BE IT THEREFORE RESOLVED that:
1. The City of Lake Elsinore, a Municipal Corporation,
hereby designates the County of Riverside as its aqent for service
of process for any and all actions brouqht against the City of Lake
Elsinore under Article 2, Part 6, Division 1 of the Revenue and
Taxatiori Code.
2.~~~;r`BX reason of such designation, it shall be the duty
of the County Couirsel of the County of Riverside to defend such
actions, unless the City of Lake Elsinore provides that one, some
or all of such actions shall be defended by its own counsel.
