HomeMy WebLinkAboutCC Reso No 1982-10RESOLUTION N0. 82-10 1 2 3 4 5 6 7 8 9 10 I, 11' 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ORDERING THE VACATION OF A CERTAIN ALLEY AND A PORTION OF POE STREET PURSUANT TO THE STREET VACATION ACT OF 1941 AS CONTAINED IN SECTIONS 8300, ET SEQ Of THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the Mayor and City Council of the City of Lake Elsinore, did on January 12, 1982, adopt a Resolution No. 82-2 declaring its intention to vacate an alley and a portion of Poe Street and fixing a time and place of hearing providing for the publication and posting pursuant to the Street Vacation Act of 1941 as contained in Sections 8300 et seq of the Street and Highways: Code of the State of California. WHEREAS, the hearing,was conducted on the 9th day of February, 1982 at the hour of 7:30 p.m. at the Council Chamber of the City of Lake Elsinore located 130 South Main Street, Lake Elsinore, California, at which time any and all persons interested in or objecting to the proposed vacation were heard. NOW, BE IT RESOLVED, by the Mayor and City Council of the City of Lake Elsinore, California, as follows: 1. That on January 12, 1982, the Mayor and City Council of the City of Lake Elsinore, California, did adopt Resolution No. 82-2 to which reference is hereby made. 2. That pursuant to Resolution No. 82-2 a hearing date was set on the 9th day of February, 1982 at the hour of 7:30 p.m. at the City Hall located at Lake Elsinore, California. 3. That notices of said street vacation were duly posted in the manner set forth in said Street Vacation Act of 1941, and the City Clerk caused said resolution to be published as provided for by law. 4. That the Mayor and City Council do find, from all the evidence submitted, that an alley and a portion of Poe Street, as hereinafter des- cribed, be vacated as portion of said street is unnecessary for present or prospective street purposes. 5. That the alley and the portion of Poe Street, hereby vacated, is all that real property located in the City of Lake Elsinore, California, and more particularly described as follows: ll 2~~ 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17' 1@'. 19 20 21 22 23 24 25 26 27 28 29 30 31 32 That portion of Poe Street and the alley located between Blocks 4 and 5, northerly of 60 foot Minthorn Street as shown on the map of Wall and Starbird's Resubdivision, recorded in Book 10 of Maps, Page 492 thereof, records of San Diego County, State of California. 6. The City hereby reserves and excepts from the vacation any existing easements and the rights provided for by Section 8330 of Streets and Highways Code of the State of California. 7. The City Clerk shall cause a certified copy of this order attested to by the Clerk under the Seal of the City, to be recorded in the office of the County Recorder of the County of Riverside, California.
