HomeMy WebLinkAboutCC Reso No 1982-03RESOLUTION N0. 82-3 i , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2g 25 26 27 28 29 30 31 32 A RESOLUTION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DECLARING ITS INTENTION TO VACATE CERTAIN ALLEYS AND PORTION OF RILEY STREET, FIXING A TIME AND PLACE OF HEARING TO ALL PERSONS INTERESTED OR OBJECTING TO THE PROPOSED VACATION, PROVIDING FOR PUBLISHING AND POSTING PURSUANT TO THE STREET VACATION ACT OF 1941 AS CONTAINED IN SECTIONS 8300 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. BE IT RESOLVED by the Mayor and City Council of the City of Lake Elsinore, California, as follows: l. That pursuant to the street vacation act of 1941 and pursuant to Sections 8300 et seq of the Streets and Highways Code of the State of California, the City Council declares intention to vacate certain alleys and portion of Riley Street located in the City of Lake Elsinore, California, and more particularly described as follows: All of the alleys in Block 2 of Wall and Starbird's Resubdivision as shown on map recorded in Book 10 of Maps, Page 492 thereof, records of San Diego County, State of California, along with portions of public right of way in Blocks 2 and 3 of said Wall and Starbird's Resubdivision located easterly of 60 foot wide right of way of County Highway Route 11. 2. That a hearing is to be conducted on the 9th day of February, 1982 at the hour of 7:30 p.m. at the Council Chamber of the City of Lake Elsinore located at 130 South Main Street, Lake Elsinore, California, at which time all persons interested in or objecting to the proposed vacation I will be heard 3. Notices of said street vacation shall be posted conspicuously along the line of the street or part thereof proposed to be vacated at least ten (10) days before the date set for the hearing. Said notices shall state the passage of this resolution of intention and the time and place of the hearing. Said notices shall be posted by the superintendent of public works and thereafter he shall file an affidavit of posting with the City Clerk. 4. The city hereby reserves and excepts from the vacation any existing easements and the rights provided for by Section 8330 of Streets and Highways Code of the State of California. 5. The City Clerk shall cause this resolution tp be published within fifteen (15) days after the passage of this resolution at least once in a newspaper by general circulation published and circulated in the 1~~ 2 3 4 5 6 7 8 9 IO' 11 12 13 14 15 16 17 18 19 20 21 22 23 2g 25 26 27 28 29 30 31 32 city and the publisher of said newspaper shall cause an affidavit to be filed with the City Clerk showing compliance with Section 36933 of the Government Code of the State of California.
