A RESOLUTION OF THE CITY COUNCIL OF Tf~ CITY OF T,AT~
ELSINORE, CALIFORNIA, ESTABLISHING A POLICY FOR
DEPERDIINING THE TIME OF INSTALLATION OF PUBLIC II~4PROVE-
NNIENNTS WHICH ARE REQUIRID BY ORDINANCE N0. 572, AS A
CONDITION OF A BUILDING PERMIT.
Wf~REAS, the City Council has adopted Ordinance No. 572,
requiring the installation of public improvements as a condition of
issuing a building permit;
Wf~REAS, the City Council of the City of Lake Elsinore
desires to establish a policy for determuzing under what conditions the
installation of the public improvements should be deferred or the
installation thereof considered i~ractical;
Wf~REAS, Ordinance No. 572, requires construction of the
public improvements, or upon reco~ndation of the City Ehgineer and
concurrance of the City Manager, the City Council of Lake Elsinore may
authorize signing of an agreement between the City of Lake Elsinore and
the owner of the property delaying the installation o£ such improvements
that may be impractical to install at the time of issuing the building
permit. Such agreement would require the owner to install or cause to be
installed the required improvements at such time as the City of Lake
Elsinore requests such improvements.
NOW, THEREE'ORE, BE IT RESOLUID BY THE CITY COUNCIL OF
Tf~ CTTY OF LAI~ ELSINORE, that public improvem2nts required by Ordinance
No. 572, shall be installed prior to issuing a certificate of occupancy
~cept as follows:
The public improvements may be deferred and a recorded agree-
m~nt accepted to guarantee future installation thereof, only
when the improvetc~its cannot be installed due to existing
engineering problems associated with the site. Typical
engineering problems would be, but not l~mi.ted to, the
following:
a. The proposed alignment or grade would result in
vehicular or pedestrian safety problems.
b. The aligiunent or grade would not allow proper drainage.
c. The proposed aliyrn??tent or grade would not allow safe
ingress and/or egress.
BE IT FURTHER RESOLVID that the public improvements may be
deferred due to an~isting engineering ~roblem at the site upon the
recommendation of the City Ehgineer, concurrance of the City Manager,
and approval of the City Council of the City of Lake Elsinore.
ADOPTID this 8th day of February, 1983.
