HomeMy WebLinkAboutCC Reso No 1986-54. _ _ , . ___ ~ _ RESOLUTION N0. 86-54 , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CALLING AND GIVSNG NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 4, 1986, FOR SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY A PROPOSED MEASURE RELATING TO THE FORMATION OF A CITY POLICE DEPARTMENT AND ITS FUNDING THROU6H A BENEFIT ASSESSMENT DISTRICT, AND REQUESTING RIUERSIDE COUNTY BOARD OF SUPERVISORS CONSOLIDATE THIS SPECIAL ELECTION WITH THE STATE- WIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 4, 1986. WHEREAS, the City Council of the City of Lake Elsinore desires to submit to the qualified electors of said City at a Special Municipal Election, a proposed measure relating to the formation of a City Police Depart- ment and the funding thereof through a Benefit Assessment District; and WHEREAS, the City Council of said City is thereupon authorized an~ directed by statute to submit said measure to the qualified voters; NOW, TNEREr'ORE, BE IT RESOLVED that the City Council o` the City of Lake Elsinore does hereby resolve, determine and order as foliows: SECTION 1. That pursuant to the requirements of the laws of the State ef California relating to cities within said State, there shail be and there is hereby called and ordered held in the City of Lake Elsinore, County of Riverside, State of California, on Tuesday, November 4, 1986, a Special Municipal Election of the qualified electors of said City, and requesting the County Board of Supervisors consolidate this Special Election with the Statewide General Election to be held on November 4, 1986, for the purpose of submitting the following quesiion(s), to wit: (ADVISORY VOTE ONL1) Shall the City of Lake Elsinore cease to ~S nontract with the County o£ Riverside ior police services and instead form and ~ implement a City Police Departsnent? NO (ADVISORY VOTE ONLY) Would you suoport the formation o£ a benefit assessment district and the levying of a special tax to fund increased police services? YES NO _ _ ._ . . ~ - - ---_.._~. ~ SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as e re uired b law to be used thereat. ma b q Y Y SECTION 3. That the polls for said election shall be II! open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p•m• II of the same day when said polls shall be closed, except as provided in Section 14301 of the Elections Code of the State of II California. SECTION 4. That all Councilmembers are hereby authorized, but not required, to file written arquments either in II ~ favor of or in opposition to this measure. SECTION 5. `Fhat said written arguments shall be in dance with Article 4, Chapter 3, Division 5 of the Elections accor II Code of the State of California and said written argument may be ~I changed until and including the date fixed by the City Clerk after I which no arguments for or against said City measures may be I submitted to the City Clerk. I SECTION 6. That the City Council directs the City Clerk i II to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure I showing the effect of the measure on the existing law and the I operation of the measure. The impartial analysis shall be filed I I by the date set by the City Clerk for the filing of primary i, I arguments. SECTION 7. That in all particulars not recited in this resolution, said elections hall be held and conducted as provided I by law £or holding municipal elections in said City. I SECTION 8. That notice of the time and place of holding I of said election is hereby given and the City Clerk is hereby I authorized, instructed and directed to give such further or I ' additional notice of said election in time, form and manner as II required by law. SECTION 10. 'I'hat this resolution shall take effect immediately.
