HomeMy WebLinkAboutCC Reso No 1987-70_~ RESOLUTION N0. 87-70 A RESOLUTION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ORDERING THE VACATION OF A PORTION OF AVENUE SEVEN (7) PURSUANT TO THE STREET VACATION ACT OF 1941 AS CONTAINED IN SECTIONS 8300 ET SEQ OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA WHEREAS, the Mayor and City Council of the City of Lake Elsinore did on November 10, 1987, adopt a Resolution No. 87-60, declaring its intention to vacate a portion of Avenue Seven and fixing a time and place of hearing for the publication and posting pursuant to the Street Vacation Act of 1941 as contained in Sections 8300 et seq of the Street and Highways Code of the State of California; WHEREAS, the hearinq was conducted on the 24th day of November, 1987, at the hour of 7:00 p.m. at the Council Chambers of the City of Lake Elsinore located at 130 South Main Street, Lake Elsinore, California at which time any and all persons interested in or objecting to the proposed vacation were heard. NOW, BE IT RESOLVED, by the Mayor and City Council of the City of Lake Elsinore, California as follows: 1. That on November 10, 1987, the Mayor and City Council of the City of Lake Elsinore, California, did adopt Resolution No. 87-60 to which reference is hereby made. 2. That pursuant to Resolution No. 87-60 a hearing date was set on the 24th day of November 1987, at the hour of 7:00 p.m. at the City Hall located at Elsinore, California. 3. That notices of said street vacation were duly posted in the manner set forth in said Street Vacation Act of 1941, and the City Clerk caused said Resolution to be published as provided for by law. 4. That the Mayor and City Council do find, from all evidence submitted, that a portion of Avenue Seven as hereinafter described, should be vacated, as the portion of said street is unnecessary for present or prospective street purposes. __ ___ _ _ _ _ 5. That the portion of Avenue Seven, hereby vacated, is all that real property located in the City of Lake Elsinore, California, as shown on Exhibit "A", and more particularly described as follows: That portion of Avenue 7, in the City of Lake Elsinore, County of Riverside, State of California as shown on Elsinore Heights Tract Unit No. 3 as per map recorded in Book 13, Pages 39 and 40 of Maps in the office of the recorder of said County bounded on the North by the westerly prolongation of the south line of Mill Street (50'wide) as shown on said ' Elsinore Heights Tract Unit No. 3 and that portion of said Avenue 7 lying North of the followinq described line: BEGINNING at the centerline intersection of Avenue 6 (60'wide) and parkway (60'wide) as shown on said Elsinore Heights Tract; THENCE along said centerline of parkway north 89 24'44" east 234.48 feet; THENCE at right angles and leaving said centerline north 0 35'16 west 30.00 feet to a point on the north line of said parkway, said point also being the beginning of a curve concave to the north having a radius of 100 feet; THENCE easterly along said curve through a central angle 10 14'12" an arc length of 17.87 feet; THENCE tangent to said curve north 79 10'32" east 41.04 feet to the beginning of a curve concave to the southwest having a radius of 70 feet; THENCE along said curve through a central angle of 44 30'23" an arc length of 54.38 feet to a point on the west line of the northwest 1/4 of Section 9, T6S, R4W, SBBM, a radical line through said point bears north 33 40'55" east. 6. The City hereby reserves and excepts from the vacation any existing easements and the rights provided for by Section 8330 of Street and Highways Code of the State of California. 7. The City Clerk shall cause a certified copy of this order, attested to by the City Clerk under the Seal of the City, to be recorded in the Office of the County Recorder of the County of Riverside, California.
