RESOLUTION N0. 87-24 ' A JOINT RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ', ELSINORE, CALIFORNIA AND RESOLUTION OF THE ELSINORE UNION I HIGH SCHOOL DISTRICT APPROVING THE APPLICATION FOR LAND AND WATER CONSERVATION FUNDS TERRA COTTA PARK PROJECT I WHEREAS, the Congress under Public Law 88-578 has authorized the ; establishment of a Federal Land and Water Conservation Fund Grant-in-Aid ' Program, providing matching funds to the State of California and its political ' subdivisions for acquiring lands and developing facilities for public outdoor , recreation purposes; and, ~ WHEREAS, the State Department of Parks and Recreation is responsible I~ for the administration of the program within the State, setting up necessary , rules and procedures governing application by local agencies under the program; and, , ~ WHEREAS, said adopted procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the I'~I approval of applications and the availability of local matching funds prior to , submission of said applications to the State; and, ' WHEREAS, the proposed Terra Cotta Park Project is consistent with the Statewide Comprehensive Recreation Resources Plan: Recreation in California, Issues and Actions: 1981-1985; and, , ~ ' WHEREAS, the project must be compatible with the land use plans of '! , those jurisdictions immediately surrounding the project; and, WHEREAS, if the public agency applying for the grant funds does not ', own the project site, the State requires the public agency owning the site to co-sponsor the grant project; and, I WHEREAS, both agencies must agree to assume the compliance responsibilities for the LWCF assisted project in perpetuity; and, WHEREAS, the State requires that one agency be named as the lead agency for the purposes of undertaking and administering the project; NOW, THEREFORE, BE IT RESOLVED that the co-sponsors, the City ' Council, and the District Board of Directors hereby: 1. Approve the filing of an application for land and Water Conservation Fund assistance; and, 2. Acknowledge that local funds are available for completion of the project. The City certifies that it has matching funds from the following source(s): a) the Capital Improvement Program of the City of Lake Elsinore; b) the Capital Improvement Program of the Redevelopment Agency of , the City of Lake Elsinore and can finance one hundred ' percent (100%) of the project, half of which will be reimbursed; and, 3. Certify that the project is compatible with the land use plans of those jurisdictions immediately surrounding the project; and, , , 4. Certify that both agencies will co-sponsor the project and jointly execute a project agreement with the State if the project is selected by the State for funding assistance under the Land and Water Conservation Fund Program; and, 5. Certify that the City of Lake Elsinore is hereby designated as the lead agency and is responsible for submitting the grant application, plans and specifications, and other docu- , ments to the State for review and approval and is responsible for the day-to-day administration of the grant project; and, Resolution No. 87-24 - DENIED BY SCHOOL DISTRICT 6. Certify that in the event that one agency is unable or unwilling to continue its co-sponsorship of the grant project, the other agency will assume, in perpetuity, total responsi- bility for compliance with the terms and conditions of the Project Agreement, including the obligation to keep the site open and available for public outdoor recreation purposes and to maintain the property consistent with the requirements of the Land and Water Conservation Fund Act; and, 7. Appoint the Director of Public Services as agent of the City to conduct all negotiations, execute and submit all documents including but not limited to applications, agree- ments, amendments, billing statements, and so on, which may be necessary for the completion of the aforementioned project.
