HomeMy WebLinkAboutCC Reso No 1988-07RESOLUTION NO. 88-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ESTABLISHING POLICY RELATING TO CONSTRUCTION OF ACCESSORY STRUCTURES AND ADDITIONS, ALTERATIONS OR REPAIRS OF EXISTING STRUCTURES WITHIN FLOOD- PLAIN MANAGEMENT AREAS. WHEREAS, the -City -Council recognizes that a need exists to establish a policy which would permit the construction, rehabilitation, or remodeling of structures to serve permitted uses with Floodplain Management Areas; and WHEREAS, the City Council finds that current procedures for review and issuance of permits for certain minor structures does not provide expeditious review and decision making and induces an undue burden upon property owners; and WHEREAS, it is the Council's intent in adopting the policy contained herein to insure standards of aesthetic acceptability to the area, extend reasonable property rights to property owners in the affected area, and to provide expeditious handling and determination of applications for properties in the Floodplain Management Areas. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lake Elsinore, California, does hereby establish the policy relating to construction of accessory structures and additions, alterations or repairs of existing structures within Floodplain Management Areas, as follows: POLICY No structure within a Floodplain Management Area, as defined in Chapter 15.68 of the Lake Elsinore Municipal Code, may be constructed, altered rehabilitated or remodeled unless such improvements or construction is approved by the Community Development Director, City Engineer and Chief Building Official pursuant to Chapters 15.64, Flood Hazard Areas, and 17.82.100, Minor Design Review. The authority for such approval is limited to permit requests for items listed herein. Any construction requests in excess to the limitations contained herein shall be subject to City Council review and approval. Appeals from decisions of the Community Development Director, City Engineer, or Chief Building official may be appealed to City Council, subject to established appeal procedures. TYPES OF IMPROVEMENTS PERMISSIBLE 1. Pole styled temporary, shade structures not exceeding an aggregate of 1000 square feet for such structures upon any individual lot. Structures not exceed a height of ten (l0) feet. Structures shall be completely open and unenclosed on all four (4) sides and shall be permitted only in association with a primary structure. 2. For all structures, except temporary, shade structures, all structural members of the roof or deck shall be at least one (1) foot above the 100-year flood level.
