RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LAKE ELSINORE, RIVERSIDE COUNTY,
CALIFORNIA, APPROVING AND AUTHORIZING
EXECUTION OF ACOUISITION AGREEMENT
WHEREAS, the City Council of the City of Lake Elsinore (the
"City") has received an agreement for acquisition of certain
public improvements qenerally described as follows:
Construction and acquisition of improvements
for streets, storm drains, water facilities,
sewerage facilities and mitigation fees for
fire, police and school facilities together
with appurtenances and appurtenant work and
acquisition of rights-of-way and/or fee title
to land, if necessary, and incidental expenses
in connection therewith
(the ~~Improvements~~); and
WHEREAS, the lands to be benefitted by the Improvements are
encompassed by and subject to the Development Agreement for
Canyon Lake Hills (including Tentative Tract No. 17413 -
revised), dated May 29, 1980; and
WHEREAS, the agreement for acquisition provides that the
Improvements will be constructed by the owners of the lands
within Canyon Lake Hills or their assignees and, upon completion
of construction, the Improvements will be acquired by the City
from the proceeds of bonds issued by the City, pursuant to
proceedings undertaken by either the Municipal Improvement Act of
1913, being Division 12 of the Streets and Highways Code, or
proceedings undertaken pursuant to the Mello-Roos Community
Facilities Act of 1982, being Chapter 2.5, Part 1, Division 2,
Title 5 of the Government Code; and
WHEREAS, the agreement for acquisition has been received
and reviewed the City:
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Lake Elsinore does hereby find, declare and determine as

Section 1. Recitals. The above recitals are all true and
correct.

Section 2. Execution of Agreement. The City Council
hereby approves and authorizes execution of the agreement
entitled:
Agreement for Acquisition
Canyon Lake Hills
(the "Agreement for Acquisition") in substantially the form on
file with the City Clerk.
Section 3. Filina. The Agreement for Acquisition shall be
filed with the transcript of proceedings for the financing of
acquisition of the Improvements and shall be open to public
inspection.
Section 4. EPfective Date. This resolution shall take
effect upon its adoption.
PASSED, APPROVED AND ADOPTED this 26th day of ~anuary ~
1988, at the regular meeting of the City Council by the following
roll call vote:
