NUISANCE ABATEMENT HEARING

CALL TO ORDER
The regular Nuisance Abatement Hearing was called to order by Loraine Watts,
Chairwoman at 4:38 PM.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Associate Planner Justin Carlson.

Chairwoman Watts opened the Public Hearing at 4:39 p.m.

Chairwoman Watts asked Code Enforcement Officer Lopez to address this case.
Code Enforcement Officer Lopez stated this case was initially started in January
2007 for violations of Lake Elsinore Municipal Code Section 8.18.020 (21) which
was lack of landscaping. He commented since the original case date
approximately one year has passed. He indicated there had been no significant
changes and actually the property had gotten worse. He noted that prior to the
hearing he inspected the residence and some work had been done but until this
point all of our citations, approximately $3,500.00, some were claimed but the
majority went unclaimed. He stated the individual had knowledge the City had an
active case pending against him and had chosen to ignore it. He indicated his
only option was to take the individual before the Nuisance Hearing Board and
have the property declared a nuisance. He noted there was no foreclosure
activity on the property but he never had contact with owner so he does not know
if there were any circumstances that would prevent him from maintaining or
installing a front yard. He stated at one point in time it looked like foundations
were laid for concrete steps but no further activity. He indicated after that the
weeds started being a problem so he made a decision to bring the property
before the Nuisance Hearing Board to have the property declared a public
nuisance so he could submit it to the City Prosecutor's Office to put pressure on
the individual to maintain his property according to City standards. He indicated
his recommendations for the Board was to have the property declared a public
nuisance and from there he would turn it over to the City Prosecutor's Office.
Chairwoman Watts indicated she had inspected the property that afternoon and
she stated it looked like they started the porch. She stated in the front the weeds
had started to grow. She agreed with Code Enforcement Officer Lopez to
declare it a nuisance. She asked Planner Associate Carlson if he had inspected
the property.,
Planner Associate Carlson stated he had and he concurred.

ASSOCIATE CARLSON, AND CARRIED BY UNANIMOUS VOTE
OF THOSE PRESENT TO DECLARE 31023 LAUSANNE
STREET, APN 378-510-003, LAKE ELSINORE, CA A PUBLIC
NUISANCE.
3. 16400 Lakeshore Drive, APN 378-313-025, Lake Elsinore, CA
Chairwoman Watts addressed 16400 Lakeshore Drive.
Code Enforcement Officer Lopez indicated his attention was brought to this
property on December 20, 2007 from several complaints received from

neighboring properties regarding graffiti on the location. He stated the building
was vacant and not currently being used for habitation purposes. He noted it had
been vacant for quite some time. He stated in the past he had issues with graffiti
and landscaping issues regarding weeds. He commented up until this point the
issues had been dealt with by the registered owner of the property. He stated
the property owner lived a mile away on Cherry Blossom. He indicated he had
attempted several times to contact the property owner at the Cherry Blossom
residence. He stated he had left notes and sent letters. He indicated for some
reason this time everything had gone unclaimed and we had not been notified as
to why the property had not been maintained. He stated due to its condition
which had been getting worse his recommendation was to declare the property a
public nuisance and have our graffiti abatement crew along with our Public
Works crew abatement the graffiti and cut down the weeds. He noted this may
be something we would have to do on a regular basis due to lack of contact from
the property owner. He commented there was no foreclosure activity showing,
so he had no other remedies other than sending notices and attempting to make
contact periodically with the listed property owner. He indicated he would like
this propertydeclared a public nuisance so the City could clean it up.
Chairwoman Watts indicated Lakeshore was one of our main thoroughfares in
Lake Elsinore.
Code Enforcement Officer Lopez concurred.
Chairwoman Watts stated we wanted all our streets cleaned up but a
thoroughfare should always be kept clean. She indicated when you are taken on
a tour or trip they always show the best of the best so she concurred.
Associate Planner Carlson concurred. He indicated he had gone to the property
and noted the graffiti and weeds.

UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE 16400
