PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Code Enforcement Officer Fred Lopez ROLL CALL PRESENT: BOARD MEMBER: FAGAN PRESENT: PLANNING MANAGER: WEINER Also present were: Code Enforcement Officer Lopez, Code Enforcement Officer Burks and Office Specialist Teyler. PUBLIC COMMENTS None. CONSENT CALENDAR 1. The following Minutes were approved: None Board Member Fagan indicated the Minutes would not be approved due to the absence of the regular board members and would be rolled over to the next hearing. PUBLIC HEARINGS Board Member Fagan opened the Public Hearing at 4:39 p.m. Agenda Item No Page of PAGE 2 - NUISANCE ABATEMENT MINUTES - MARCH 18, 2008 2. 190 North Torn Ranch Road. APN 389-260-002. Lake Elsinore. CA Board Member Fagan asked Code Enforcement Officer Lopez to address this case. Code Enforcement Officer Lopez stated this property had come to his attention through neighbor complaints. He indicated the home was currently in foreclosure and it appeared the tenants left an accumulation of junk, trash and debris in the rear and side setbacks. He commented on the trash that had been discarded was household trash which over time will create a rodent problem which had neighbors on both sides extremely concerned. He stated due to the severity of the trash left in the backyard, it was his duty to have this property declared a public nuisance as soon as possible so City crews or contract crews could get in there and clean it up. He indicated he did not want to wait on this property any further. He stated all attempts to locate bank information had come up negative. He indicated he was unable to locate any responsible parties for the property. He recommended this property be declared a public nuisance to allow the crews to abate said nuisances. Board Member Fagan inquired as to if this property was brought before the Board several months ago. Code Enforcement Officer Lopez indicated it was not. He stated this property was occupied until approximately one month and a half ago. He indicated he had a previous case on this property regarding various inoperative cars, junk, trash and debris at which time it was cleaned up. He noted the house is unsecure at this time indicating the back door is open and accessible. Board Member Fagan indicated again this property had come before the Board the middle of last year. Code Enforcement Officer Lopez stated he had an address of 136 Torn Ranch Road which was further south that was brought before the Nuisance Board approximately a year and a half ago. Board Member Fagan noted that was the property. MOVED BY BOARD MEMBER FAGAN, SECONDED BY PLANNING MANAGER WEINER, AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE 190 TORN RANCH ROAD, APN 389-260-002, LAKE ELSINORE, CA A PUBLIC NUISANCE. 3. 31548 Sagecrest Drive. APN 363-342-009. lake Elsinore. CA Agenda Item No Page of PAGE 3 - NUISANCE ABATEMENT MINUTES - MARCH 18,2008 Board Member Fagan asked Code Enforcement Officer Burks to report this case. Code Enforcement Officer Burks stated this property had been a constant complaint from neighbors regarding fire hazards. She indicated there had been numerous complaints regarding trash, illegal storage of furniture, construction equipment, appliances on the side rear yard of the property. She noted upon inspection today it had progressed to the rear yard and to the other side of the rear yard. She indicated there now was overgrown brush and weeds. She said she had her first inspection May 1, 2007, she had warned them several times and she had tried to work with them but they had refused to work with her. She stated nothing had been done except to create a walkway and stacking the trash, debris, furniture and appliances on the side rear fence line. She indicated nothing had been removed and there was a concern of rodents and rats along the fence line. She commented pest control had been out to verify the rodents and rats. Board Member Fagan inquired if she had been able to get on the property. Code Enforcement Officer Burks indicated she had not been able to get on the property but the neighbors who had to look down on the rear yard had allowed her entry to take photos and to do inspections. Board Member Fagan stated based on the photos he would recommend it a nuisance. Code Enforcement Officer Burks agreed. Planning Manager Weiner indicated he had no questions. He indicated he had visited the property. MOVED BY BOARD MEMBER FAGAN, SECONDED BY PLANNING MANAGER WEINER, AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE 31548 SAGE CREST DRIVE, APN 363-342-009, LAKE ELSINORE, CA A PUBLIC NUISANCE. 5. Code Enforcement Comments: None. 6. Nuisance Abatement Board Comments: None.
