HomeMy WebLinkAbout12-20-2005 NA MINUTES NUISANCE ABATEMENT HEARING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CA 92530 TUESDAY, DECEMBER 20, 2005 ****************************************************************** CALL TO ORDER The regular Nuisance Abatement Hearing was called to order by Building & Safety/Code Enforcement Manager Chipman at 4:30 P.M. ROLL CALL PRESENT: BOARD MEMBERS: FAGAN ABSENT: BOARD MEMBERS: WATTS Also present were: Building & Safety/Code Enforcement Manager Chipman, Senior Planner Harris, Senior Code Enforcement Officer Gordon and Office Specialist Porche. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Board Member Fagan. PUBLIC COMMENTS None CONSENT CALENDAR 1. The following Minutes were approved: None Board Member Fagan requested that the Minutes from the last meeting be postponed for approval until Board Member Watts has reviewed them. Agenda Item No Page of PAGE 2 - NUISANCE ABATEMENT MINUTES - DECEMBER 20, 2005 PUBLIC HEARINGS 2.16819 Hunt Avenue Board Member Fagan asked Senior Code Enforcement Officer Gordon to give an overview of the property. Senior Code Enforcement Officer Gordon stated the concerns with this property are inoperable vehicles along the side of the street, stockpiling trash in the yard, and storing furniture and other items in the public view. She indicated that the owner had made repairs to the septic system without permits and constructed an illegal deck on the back of the house. She indicated that the property has recendy been placed up for sale, and that the current occupants are moving out. She stated that the property continues to be cluttered with debris, and recommends that the property be declared a nuisance. Building and Safety/Code Enforcement Manager Chipman concurred. He recommended to Staff to follow through with the nuisance abatement procedures in a timely fashion, prior to the new owners moving into the home. Board Member Fagan stated that he drove by the property and indicated that no improvement has been made. He suggested to advise the real estate agent of the actions and concurred to have this property declared a nuisance. There being no further comments, Board Member Fagan moved that the property be declared a nuisance and requested a Motion. MOVED BY FAGAN, SECONDED BY CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY AT 16819 HUNT AVENUE A PUBLIC NUISANCE. 3. 17032 McBride Avenue Board Member Fagan asked Senior Code Enforcement Officer Gordon to gIve an overview of the property. Senior Code Enforcement Officer Gordon stated that this property involves a rented single family home that has an accumulation of personal items around the property and an inoperable van in the driveway. She indicated that several notices have been issued without any compliance. She recommended to the Board that this property be declared a nmsance. .- Agenda Item No Page of PAGE 3 - NUISANCE ABATEMENT MINUTES - DECEMBER 20, 2005 Board Member Fagan stated he was able to observe the property, and indicated that there have been no changes to improve the situation. He concurred with Staff's recommendation to declare the property a nuisance. There being no further comments, Board Member Fagan moved that the property be declared a nuisance and requested a Motion. MOVED BY FAGAN, SECONDED BY CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE AT THE PROPERTY AT 17032 MCBRIDE AVENUE A PUBLIC NUISANCE. 4. 17795 Strickland Avenue Board Member Fagan asked Senior Code Enforcement Officer Gordon to g1Ve an overview of the property. Senior Code Enforcement Officer Gordon indicated that this property is a single-family home in a rural area where the occupant has been running a construction business on the property and on surrounding vacant lots. She stated that the owner was given a Notice of Violation to stop operating his business from the residential area and to remove the equipment and supplies as well. She noted that the owner did participate in a recent Neighborhood Enhancement Team Project in November by hauling out some trash and debris; however the majority of the items still remain on the premises. She stated that no significant changes have been made to the property, and that Staff recommends this property be declared a nuisance. Board Member Fagan stated that he drove by the property today and concurred that no changes have been made. Based on this information Board Member Fagan concurred to have this property declared a nuisance. There being no further comments Board Member Fagan requested a Motion. MOVED BY FAGAN, SECONDED BY HARRIS AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY AT 17795 STRICKLAND AVENUE A PUBLIC NUISANCE. Agenda Item No Page of PAGE 4 - NUISANCE ABATEMENT MINUTES - DECEMBER 20, 2005 INFORMATIONAL ITEMS Building and Safety/Code Enforcement Manager Chipman indicated that with regards to the McBride residence that many issues remain on-going at the time and the owner has not complied not only with trash and debris issues, but also with the structure of the home. He indicated that property will more than likely be placed on the Agenda for the next Nuisance Abatement Hearing regarding the condition of the house as well.
