NUISANCE ABATEMENT HEARING

CALL TO ORDER
The regular Nuisance Abatement Hearing was called to order by Board Member Loraine
Watts, at 5:00 p.m.

Also present were: Building & Safety/Code Enforcement Manager Chipman, Senior
Planner Harris, Senior Code Enforcement Officer Gordon and Office Specialist
Staley.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Senior Planner Harris.
PUBLIC COMMENTS
None.
CONSENT CALENDAR
1. The following Minutes were approved:
A. Nuisance Abatement Meeting - October 18, 2005
MOVED BY CHIPMAN, SECONDED BY SENIOR PLANNER HARRIS
AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO
APPROVE THE CONSENT CALENDAR AS PRESENTED.

PUBLIC HEARINGS
2. 1001 W. Heald Avenue
Board Member Watts asked Senior Code Enforcement Officer Gordon to glve an
overview of the property.
Senior Code Enforcement Officer Gordon indicated that the property involves a duplex
on the corner of Heald and Lewis Street.
Senior Code Enforcement Officer Gordon stated the concerns with this property are
related to tenants of the duplex storing there personal items in the driveway, and the rear
of the property. She also indicated that their have been complaints concerning inoperable
vehicles being stored in the driveway. She stated that Officer Slater who had been working
on this case was not available for the meeting. She indicated that Code Enforcement
Officer Slater submitted pictures and written documents for this meeting.
Senior Code Enforcement Officer Gordon stated that the owner of the property has asked
twice for an extension. She stated that Staff recommends that this property be declared a
Public Nuisance based on the lack of compliance.
Building and Safety/Code Enforcement Manager Chipman indicated that he had a chance
to visit the property. He observed the inoperable vehicle in the driveway. He asked Senior
Officer Gordon if the storage was off the alley.
She stated "Yes". She indicated that she has photos of the property in the year 2002, and
it appears to be in the same condition as it is today.
Building and Safety/Code Enforcement Manager Chipman asked if anyone wished to
speak for or against this action.
There being no comments from the public, Building and Safety Manager/Code
Enforcement Manger Chipman recommended to the Board Members to declare this
property a Public Nuisance.
MOVED BY WATTS, SECONDED BY HARRIS AND CARRIED BY
UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE
PROPERTY AT 1001 W. HEALD AVENUE A PUBLIC NUISANCE.
3. 18801 Dexter Avenue
Board Member Watts asked Senior Code Enforcement Officer Gordon to glve an
overview of the property.

Senior Code Enforcement Officer Gordon stated that this property was converted by a
new owner from a single family residence to a commercial business. She indicated the
business was not licensed or permitted. She stated that the property is currendy vacant.
She indicated that there are car parts being stored on the property, in addition to a pile of
debris. She stated that Staff has posted notices on the property.
Building and Safety/Code Enforcement Manager Chipman stated he was able to observe
the property, and indicated that the car parts are still on the premises. He stated that he
received a notice from Wayne Holland who has an interest in the property to be used as a
storage and or/office and requested Senior Planner Harris to comment on this new
information.
Senior Planner Harris indicated that this property went to the Planning Commission on
November 1, 200S, and was approved for Commercial Design Review for the use of a
mini storage facility. He indicated that it would be some time before the project would be
completed.
Chairwoman Watts indicated that in the interim she recommends that the property be
declared a Public Nuisance.
Senior Code Enforcement Officer Gordon concurred.
Building and Safety/Code Enforcement Manger Chipman concurred.

UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE A PUBLIC
NUISANCE AT THE PROPERTY AT 18801 DEXTER AVENUE.
4. 1403 Lakeshore Drive
Board Member Watts asked Senior Code Enforcement Officer Gordon to gwe an
overview of the property.
Senior Code Enforcement Officer Gordon indicated that this property is a single-family
home that is being used as a rental. She stated that there have been complaints with
regards to trailers in the rear alley, inoperable vehicles, jet skies and debris. She stated that
because of failure to bring the property up to compliance, Staff recommends this property
to be declared a Public Nuisance.
Building and Safety/Code Enforcement Manager asked Senior Code Enforcement Officer
Gordon if she has had the opportunity to speak with the owner on what it would take to
bring the property up to compliance.

Senior Code Enforcement Officer Gordon stated "Yes". She stated that the owner was
going to proceed with evIction notices for the tenant. She indicated that this was several
months ago, and the tenants should have been removed by now.
Chairwoman Watts asked Code Enforcement Officer Gordon when was the last time she
was able to reach the owner.
She stated sometime in August or September, and nothing has been done since then.
Chairwoman Watts recommended that this property be declared a Public Nuisance.
Building and Safety/Code Enforcement Manager Chipman concurred.

AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT
DECLARE THE PROPERTY AT 1403 LAKESHORE DRIVE A PUBLIC
NUISANCE.
5. 16871 Sannelle Street -Continued from October 18,2005 Nuisance Hearing
Board Member Watts indicated that this is a continuation from the October 18, 2005
Public Hearing. She requested Senior Code Enforcement Officer Gordon to give an
overview of this item.
Senior Code Enforcement Officer Gordon stated that this case involves a manufactured
home that was placed on a vacant lot without the proper building permits. She indicated
that the owner of the property has not submitted any plans to the City. She stated that the
owners of the property are being represented by an attorney who will be speaking tonight
on their behalf.
Stewart Wauld, Attorney for the owners at the 16871 Sannelle Street stated that the City
was to issue a letter to the applicant advising him to submit plans showing details of what
would be needed, however indicated that the owner never received the letter. He did
indicate however that the owner has intentions to submit a set of plans shortly. He also
indicated that at the last Hearing it was noted that the Notice of Violation did not specify
what was the code violation. He stated that the owners received a notice, advising them of
tonight's meeting, however did not mention any notice of violation.
Building and Safety/Code Enforcement Manager Chipman stated that the approved set of
plans have been located. He stated that they have been approved by the Planning and the
Building & Safety Division. He stated that all that is lacking for approval would be the
signing of the Engineering Division and to pay the school fees. He asked Mr. Wauld if a
thirty (30) day extension would be enough time.

Mr. Wauld stated ''Yes''.
Building and Safety/Code Enforcement Manager stated that in light of this new
information, he recommends to Staff and Board Members that this case be granted a thirty
(30) day extension.
Chairwoman Watts concurred.
Senior Planner Harris concurred.

AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO
GRANT A THIRTY (30) DAY EXTENSION FOR THE PROPERTY AT
16871 SANNELLE STREET.
INFORMATIONAL ITEMS
Senior Code Enforcement Office Gordon stated that Code Enforcement Officers Slater and
Lopez have completed their certification with CALBO. She stated that this include training in
Building and Safety codes.
