HomeMy WebLinkAbout08-16-2005 NA MINUTES NUISANCE ABATEMENT HEARING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CA 92530 TUESDAY,AUGUST 16,2005 ****************************************************************** CALL TO ORDER The regular Nuisance Abatement Hearing was called to order by Building and Safety/Code Enforcement Manager Chipman, at 5:04 p.m. ROLLCALL PRESENT: BOARD MEMBERS: WATTS, FAGAN ABSENT: NONE - Also present were: Building & Safety/Code Enforcement Manager Chipman, Office Specialist Porche and Senior Code Enforcement Officer Gordon. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Office Specialist Dana Porche. PUBLIC COMMENTS None. CONSENT CALENDAR 1. The following Minutes were approved: A. Nuisance Abatement Meeting - July 19,2005. MOVED BY FAGAN, SECONDED BY CODE ENFORCEMENT MANAGER CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE CONSENT CALENDAR AS PRESENTED. PAGE 2 - NUISANCE ABATEMENT MINUTES - AUGUST 16, 2005 PUBLIC HEARINGS 1. 29080 Gunder Ave. - (Continued from July 19.2005 Hearing) Board Member Watts asked Senior Code Enforcement Officer Gordon to give an overview of the property. Senior Code Enforcement Officer Gordon indicated that the property involves a single family house on Gunder Avenue. She stated that Code Enforcement had been working with the occupant of the property, Mr.Wucher who was present for the Hearing. Senior Code Enforcement Officer Gordon indicated that the occupant was working with Code Enforcement and making great progress. Officer Gordon indicated that on a recent inspection, a number of items still remained on the property. The occupant brought in photographs on the property to show the work that was performed on the Hearing day. Officer Gordon stated that she would be glad to look at the pictures, but indicated that an inspection would have to be conducted to determine whether the case be dismissed or not. Senior Code Enforcement Officer Gordon recommended that the property be declared a nuisance at this time until an inspection was conducted. Officer Gordon indicated that this would also give the occupant ail additional ten days to complete any work that may have to be done. Building & Safety/Code Enforcement Manager Chipman stated that he had conducted an inspection of the property the morning of the Nuisance Hearing. Mr. Wucher was present on the property and was at that time, cleaning up the property. Chipman indicated that there was still a significant about of items that needed to be removed from the property. The occupant, Mr.Wucher asked for an additional thirty day extension to have the property in compliance. Mr. Wucher stated that he would have the property cleaned up and all vehicles currendy registered. Building & Safety/Code Enforcement Manager Chipman indicated to the occupant that if the trash and debris were removed and cars were currendy registered that he would be in favor of the thirty day extension. Board Member Fagan agreed to give the owner a thirty day extension. Board Member Watts was in agree ace with granting the extension. MOVED BY CHIPMAN, SECONDED BY FAGAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO GRANT THE PROPERTY AT 29080 GUNDER AVENUE, A THIRTY DAY EXTENSION. PAGE 3 - NUISANCE ABATEMENT MINUTES - AUGUST 16, 2005 2. 3840 Adams St. / APN # 379-322-026 Board Member Watts asked Senior Code Enforcement Officer Gordon to give an overview of the property. Senior Code Enforcement Officer Gordon indicated that this was a single family property. It appeared to be vacant. However, Code Enforcement has heard from the neighbors that the owner is out of town taking care of a relative. Officer Gordon indicated that Code Enforcement has not been able to confirm that information. Officer Gordon indicated that the occupant has not responded to any of the notices either posted or mailed. Officer Gordon indicated that the weeds were extremely high in the front and back yard. Officer Gordon stated that there was also an inoperable vehicle in the drive way. Senior Code Enforcement Officer Gordon recommended that the property be declared a nuisance at this time. Board Member Fagan agreed to declare the property a nuisance. Board Member Watts concurred to declare the property a nuisance. Building & Safety/Code Enforcement Manager Chipman indicated that he had conducted an inspection of the property and felt that Code Enforcement would be doing a disservice to the neighbors in the area if Code Enforcement did not declare it a nuisance. MOVED BY FAGAN, SECONDED BY CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY AT 3840 ADAMS STREET, A NUISANCE. INFORMATIONAL ITEMS None. CODE ENFORCEMENT COMMENTS Senior Code Enforcement Officer Gordon commented that the City Council had approved the hiring of a fourth Code Enforcement Officer and that interviews would be held this coming week. NUISANCE ABATEMENT BOARD COMMENTS None.
