NUISANCE ABATEMENT HEARING

CALL TO ORDER
The regular Nuisance Abatement Hearing was called to order by Building and Safety/Code
Enforcement Manager Chipman, at 5:03 p.m.

ABSENT:

Also present were: Building & Safety/Code Enforcement Manager Chipman, and
Senior Code Enforcement Officer Gordon.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Building & Safety/Code Enforcement Manager
Chipman.
PUBLIC COMMENTS
None.
CONSENT CALENDAR
1. The following Minutes were approved:
A. Nuisance Abatement Meeting - March 15,2005.
MOVED BY FAGAN, SECONDED BY CODE ENFORCEMENT
MANAGER CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF
THOSE PRESENT TO APPROVE THE CONSENT CALENDAR AS
PRESENTED.

PUBLIC HEARINGS
1. 1412 Lakeshore Drive - (Continued from March 15. 2005 Hearing
Building under rehabilitation - building under construction. progress is being made.
Board Member Watts indicated that Code Enforcement had a recommendation to dismiss
the property from the Nuisance Abatement. Board Member Watts asked Senior Code
Enforcement Officer Gordon to give an overview of the item. Senior Code Enforcement
Officer Gordon indicated that Code Enforcement placed this property in the Nuisance
Hearing Meeting last month because Code Enforcement had not seen any activity. Senior
Code Enforcement Officer Gordon indicated that the house was wide open and the weeds
had become overgrown. Senior Code Enforcement Officer Gordon indicated that since
the last hearing, the property owner indicated that he was going to start working on the
project again. Senior Code Enforcement Gordon indicated that if anyone has gone by the
property recently, that it looks completely different. The house has been extended, it has a
new roof, garage and really looks good. Senior Code Enforcement Officer Gordon
recommended dismissal because the Building Division will be making regular inspections
and will final the property when it is completed.
MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY
UNANIMOUS VOTE OF THOSE PRESENT TO DISMISS THE
PROPERTY AT 1412 LAKESHORE DRIVE.
Board Member Watts expressed how wonderful the property looks now.
Member Watts indicated that it did not look like the same place with
improvements.

2. 30223 Morton Street - Property has a big mess in yard areas. Storage of wall
construction material, pet store supplies. cement mixer. and much trash and debris.
Board Member Watts asked Senior Code Enforcement Officer Gordon to give an
overview of the item. Senior Code Enforcement Officer Gordon indicated that this was a
single family property in the hills of Chaney and Pottery Street. Senior Code Enforcement
Officer Gordon indicated that the owners are separated at this time although they seem to
be getting back together enough to argue who is responsible for the things that are on the
property. Senior Code Enforcement Officer Gordon expressed that there has been slight
improvement since the first time Code Enforcement went out. Senior Code Enforcement
Officer Gordon indicated that the owners have also tried to cover up some of the junk by
running a black cloth material around the items. Senior Code Enforcement Officer
Gordon indicated that this is not acceptable to the City. Senior Code Enforcement
Officer Gordon stated that they would have to put up a solid wood fence or a block wall.
Senior Code Enforcement Officer Gordon stated that since there has not been a

significant improvement on this property and there is some arguing on who is responsible
for this property, Code Enforcement is recommending that it be declared a public
Nuisance.
MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY
UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE
PROPERTY AT 30223 MORTON STREET, A NUISANCE.
INFORMATIONAL ITEMS
None.
CODE ENFORCEMENT COMMENTS
Senior Code Enforcement Officer Gordon commented on the property at 15410 Grand
Avenue that will be at the next Nuisance Abatement Hearing. Senior Code Enforcement
Officer Gordon indicated that because of the large accumulation of trash and debris, it
would be a good idea for the Nuisance Abatement Board Members to have a walk through
of the property before the next hearing.

NUISANCE ABATEMENT BOARD COMMENTS
Board Member Fagan commented on the property at 15410 Grand Ave. Board Member
Fagan went on a walk through of the property with Code Enforcement Officer Slater.
Board Member Fagan indicated that because of the conditions of the property and it being a
large spread out area, he felt unsafe. Board Member Fagan indicated that he noticed that
Officer Slater did not carry a weapon of any kind, only pepper spray. Board Member Fagan
felt that was inadequate. Fagan felt that the City Council should consider letting the Code
Enforcement Officers carry a weapon. Board Member Fagan felt that the Officers were
qualified to handle a weapon.
Code Enforcement Manager Chipman indicated that it was a subject that the council could
review but that there is quite a bit of liability that goes with the issue of carrying firearms
when you are not an actual sworn Deputy. Code Enforcement Manager Chipman also
indicated that the Officers should call the Sheriff's department if they feel threatened at any
time. Code Enforcement Manager Chipman also indicated that it is a good idea to conduct
these type of inspections with others Officers or with a Deputy from the Sheriff's
Department. Code Enforcement Manager Chipman stated that this would be up for
discussion with the Officers and himself and that he could understand both the pros and
cons of the matter.
