HomeMy WebLinkAbout03-15-2005 NA MINUTES NUISANCE ABATEMENT HEARING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CA 92530 TUESDAY, March 15, 2005 ******************************************************************* CALL TO ORDER The regular Nuisance Abatement Hearing was called to order by Building and Safety/Code Enforcement Manager Chipman, at 5:00 p.m. Building & Safety/Code Enforcement Manager Robin Chipman called the Nuisance Abatement Hearing to order and introduced himself as the new Code Enforcement Manager for the City. Building & Safety/Code Enforcement Manager Chipman then turned the Hearing over to Board Member Loraine Watts. ROLL CALL PRESENT: BOARD MEMBERS: WATTS, FAGAN ABSENT: NONE Also present were: Building & Safety/Code Enforcement Manager Chipman, Senior Code Enforcement Officer Gordon and Office Specialist Staley. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Building & Safety/Code Enforcement Manager Chipman. PUBLIC COMMENTS None. CONSENT CALENDAR 1. The following Minutes were approved: A. Nuisance Abatement Meeting - January 18, 2005. MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE CONSENT CALENDAR AS PRESENTED. PAGE 2 - NUISANCE ABATEMENT MINUTES - MARCH 15,2005 PUBLIC HEARINGS 1. 1412 Lakeshore Drive - Building under rehabilitation - permits issued. but work has stopped. Board Member Watts asked Senior Code Enforcement Officer Gordon to give an overview of the item. Senior Code Enforcement Officer Gordon indicated that this was a vacant single family house. Senior Code Enforcement Officer Gordon indicated that the owner, Mr. Whitfield who was present in the audience, had been issued a permit to rehab the building at 1412 Lakeshore Drive back in October 2004. Senior Code Enforcement Officer Gordon indicated that when it was obvious that no work had been done on the house and the weeds had become overgrown, Code Enforcement investigated the situation and was aware that with the building opened up it was being damaged by the elements and was accessible to anyone who wanted to go in and out. Code Enforcement decided to place the property in Nuisance Abatement Hearing to encourage the owner to continue the rehab of the property or give the City jurisdiction to board up the property and cut down the weeds so that the property did not deteriorate any further. Senior Code Enforcement Officer Gordon indicated that when Mr. Whitfield received the notice, he came to City Hall and explained that the rains had set him back about six weeks and that he had every intention of completing the project. Senior Code Enforcement Officer Gordon indicated that Mr. Whitfield was here and would like to state his intentions of the work to be done on the property. Board Member Watts then asked Mr. Whitfield if he would like to speak at this time. Mr. Whitfield indicated that he obtained the building permit on November 29, 2004. Mr. Whitfield indicated that he was in the process now of rehabbing the home and indicated that it would take about six to eight weeks to complete the rehabilitation. Board Member Fagan asked Mr. Whitfield questions about when the work began and when it would be done. Mr. Whitfield indicated the work would be done around the 15th of May, 2005. Senior Code Enforcement Officer Gordon recommended that the property at 1412 Lakeshore Drive be brought back to the next Nuisance Abatement Hearing, and if there is significant improvement on the property, then the recommendation would be to dismiss the case. Senior Code Enforcement Officer Gordon recommended that the Building Division go out and conduct their building inspections as well as a final inspection. Board Member Fagan asked that we take a vote at this time whether or not the property is to be given an extension to the next Nuisance Abatement Hearing. MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO GIVE THE PROPERTY AT 1412 LAKESHORE DRIVE AN EXTENSION TO THE NEXT NUISANCE ABATEMENT HEARING PAGE 3 - NUISANCE ABATEMENT MINUTES - MARCH 15,2005 2. 31065 Illinois Street - Property appears to be abandoned. High weeds, trash and debris on property. Board Member Watts asked Senior Code Enforcement Officer Gordon to give an overview of the item. Senior Code Enforcement Officer Gordon indicated that this was a vacant single family house. Senior Code Enforcement Officer Gordon indicated that the house is very small and that the weeds are very overgrown. Officer Gordon indicated that after Code Enforcement started the investigation on the property at 31065 Illinois, it was discovered that the owner is now deceased and it is unclear at this time who the actual owner is at this property. Officer Gordon indicated that because of the overgrown weeds and the dilapidated condition of the house, it was important for Code Enforcement to act on the situation. Officer Gordon indicated that there has not been any contact even after notification went out, so Code Enforcement still does not know who has jurisdiction to fix this property up. Officer Gordon expressed that there is concern that this property could be vandalized. Officer Gordon recommended that this property be declared a nuisance. Officer Gordon indicated that this would give the property owner ten days to appeal the action given by the City. Officer Gordon indicated that the City would obtain an abatement warrant that would allow the City to cut the weeds down and then have the Building Division conduct an inspection to look for any substandard conditions, and if necessary, the City would board up the house to keep intruders out. MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY AT 31065 ILLINOIS STREET, A NUISANCE. INFORMATIONAL ITEMS None. CODE ENFORCEMENT COMMENTS Building and Safety/Code Enforcement Manager Chipman committed on the property at 31065 Illinois Street. Building and Safety/Code Enforcement Manager Chipman indicated that the property looks to be in quite a bit of disrepair and indicated that the City would have a Building Inspector go out and inspect the building and possibly place the property in Structure Abatement at that time. NUISANCE ABATEMENT BOARD COMMENTS Board Member Watts commented on the illegal dumping behind the old K-Mart and Theater Building. Board Member Watts indicated that it had become a total dumping ground with couches, mattress and other junk. Senior Code Enforcement Officer Gordon stated that Code Enforcement would conduct a field inspection at the properties.
