NUISANCE ABATEMENT MEETING

CALL TO ORDER
The Regular Nuisance Abatement Meeting was called to order by Planning/Code
Enforcement Manager Villa, at 5:10 p.m.

Also present were: Planning/Code Enforcement Manager Villa, Senior Code
Enforcement Officer Gordon, Code Enforcement Officer Scofield and Office
Specialist Staley.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Code Enforcement Officer Scofield.
PUBLIC COMMENTS
None.
CONSENT CALENDAR

UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE
CONSENT CALENDAR AS PRESENTED.
PUBLIC HEARINGS
1. 15170 Machado Street - Continued from October 19.2004 Nuisance Abatement Hearing.
Fire damaged house with accumulation of trash and debris.

Planning/ Code Enforcement Manager Villa deferred to Senior Code Enforcement Officer
Gordon. Senior Code Enforcement Officer Gordon gave a review of the item. Senior Code
Enforcement Officer Gordon indicated that the single family house was located in a rural
section near Machado Street and had suffered fire damage. She indicated that a Notice of
Violation was sent to the listed property owner who forwarded it to Corman-Leigh
Properties who intended to build houses on the site. Senior Code Enforcement Officer
Gordon indicated that the pictures taken on October 15, 2004 showed a significant
improvement to the property. She noted that the property had four dumpster on it; and
most of the trash and debris had been picked up, although the property owners were still in
the process of cleaning it up. Senior Code Enforcement Officer Gordon indicated that the
property owners still had some structures on the property along with ruble from the fire and
an old mobile home. Senior Code Enforcement Officer Gordon expressed that although the
property had been improved, Officer Gordon hesitated to recommend another continuance
because Code Enforcement expected the property to be cleared within the 30 day period of
time. Senior Code Enforcement Officer Gordon recommended the property be declared a
nuisance, which gave the property owners 10 more additional days to either finish cleaning
up the property or appeal the action. Senior Code Enforcement Officer Gordon indicated
that the City could pursue an abatement warrant and take bids to remove the rest of the
debris off the property.
MOVED BY FAGAN, SECONDED BY WATTS AND CARRIED BY
UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE
PROPERTY AT 15170 MACHADO STREET A NUISANCE.
2. 2088 Lakeshore Drive - Numerous inoperable vehicles behind business and in rear
parking area. banners. and items stored in public view.
Planning/Code Enforcement Manager Villa deferred to Senior Code Enforcement Officer
Gordon. Senior Code Enforcement Officer Gordon gave an overview of the item. Senior
Code Enforcement Officer Gordon indicated that the property involved one business called
"Canyon Battery". Officer Gordon indicated that when the first Notice of Violation was
issued in July 2004, it was owned by Mr. Alva who had since sold it to Cynthia Rowley who
was not present for the hearing, but a representative from her company was present. Senior
Code Enforcement Officer Gordon indicated that the reason Code Enforcement first issued
the Notice of Violation was because of a number of violations including sign and banner
violations, occupied RV behind the business, and for numerous inoperable vehicles that
were behind the building and on the lot next to the building for a total of about twenty-five
vehicles. Senior Code Enforcement Officer Gordon expressed that Mr. Anderson spoke to
the Board so that he could bring the new owners prospective to the hearing. Mr. Anderson
indicated that the vehicles on the property were left by the previous owner. Mr. Anderson
expressed that the new owner Cynthia Rowley would like to have the vehicles removed. Mr.
Anderson indicated that Cynthia Rowley was aware of the Abandoned Vehicle Abatement
Program that the City offers and would like to take advantage of it. Mr. Anderson has been
repairing/maintaining the property since owners obtained property. Mr. Anderson indicated
the owners would like an extension to complete work needed on the property. Senior Code
Enforcement Officer Gordon recommended that the Board continued the case to the

December 21,2004 Nuisance Abatement Hearing giving the owners approximately 30 days
to comply.
MOVED BY WATTS, SECONDED BY FAGAN AND CARRIED BY
UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE
FULL 30 DAY EXTENSION.
INFORMATIONAL ITEMS
Planning/ Code Enforcement Manager Villa explained the Abandoned Vehicle Abatement
Program to the Nuisance Abatement Board Members.
CODE ENFORCEMENT COMMENTS
Planning/Code Enforcement Manager Villa informed the Board Members that the Code
Enforcement Division had been working on the N.E.T. Program (Neighborhood
Enhancement Team). Code Enforcement notified and assisted more than 400 homes in the
downtown area in cleaning up their properties. Code Enforcement teamed up with CR&R,
Sheriffs Department and volunteers from the Youth Court to assist in the clean up. The
program was very successful in that 59 tons of trash and debris was hauled away.
NUISANCE ABATEMENT BOARD COMMENTS
Chairwoman Watts expressed how much better the City was looking these days since the
property owners were having to take the responsibility to maintain their property. Board
Member Fagan, also commented that the City was looking much better.

CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO ADJOURN THE
NUSIANCE ABATEMENT MEETING AT 5:32 p.m.
