HomeMy WebLinkAbout06-15-2004 NA MINUTES -- NUISANCE ABATEMENT MEETING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CA 92530 TUESDAY, JUNE 15, 2004 Planning and Code Enforcement Manager, Armando G. Villa, called the Nuisance Abatement Board Meeting to order at 5:10 PM. Board Member Watts led the Pledge of Allegiance. ROLL CALL Planning & Code Enforcement Manager Villa indicated that it did not appear that Board Member Fagan would appear today, after confirming with the City Clerk. He clarified that we can still hold the meeting, and Planning & Code Enforcement Manager Villa can take the place of Board Member Fagan today, hoping that he will show up for the next meeting. Planning & Code Enforcement Manager Villa commented that his intent was to serve as Chairperson today and then have the two Board Members decide on who would be the Chairperson for the Board and also decide the term of _ the Chairperson. Planning & Code Enforcement Manager Villa stated that the decision would be postponed until the next meeting. PRESENT: BOARD MEMBER: WATTS ABSENT: BOARD MEMBER: FAGAN Also present were: Planning and Code Enforcement Manager Villa, Senior Code Enforcement Officer Gordon, Office Specialist Porche', Office Specialist Staley. PUBLIC COMMENTS None. CONSENT CALENDAR None. PUBLIC HEARINGS 1. 17331 Gunnerson St.- Numerous inoperable vehicles. carport used for auto repair. tools in carport. trash. debris and non-yard items. Planning and Code Enforcement Manager Villa asked Senior Code Enforcement Officer Gordon to review the case with the Board. PAGE 2 - NUISANCE ABATEMENT MINUTES - JUNE 15,2004 Senior Code Enforcement Officer Gordon stated that she observed the conditions of this property on April 5, 2004. She reported that she stopped at the property and talked to Clarence Johnson, one of the occupants of the home. She indicated that he was given a Notice of Violation to remove all the items that were stored in public view, which included: inoperable cars, inoperable motor home with windshield broken out, numerous items stored around the property, such as furniture and appliances. Senior Code Enforcement Officer Gordon reported that the carport is being used as a storage area, with items including washing machines, personal items, tools, etc., visible to the public. She stated that the tenant was mailed several tow forms to remove inoperable vehicles from the property at no cost to the tenant. She noted the tenant never returned the forms to City Hall. Senior Code Enforcement Officer Gordon conducted a field inspection before the hearing and noted that most everything was still visible with no change. She stated the tenant told her he felt he was pretty much done with the cleanup and all he had to do was build a fence with some of the material there and that he would be in compliance. Senior Code Enforcement Officer Gordon stated that a five-day warning notice was hand- delivered to the daughter of Mr. Johnson. She noted that a hearing notice was hand-delivered to tenant on June 6,2004. She indicated the property owner, Mrs. Walsh, is present today and Senior Code Enforcement Officer Gordon has spoken with her on the conditions of the property. Senior Code Enforcement Officer Gordon expressed that it would be the City's recommendation at this time to declare the property a nuisance. Planning & Code Enforcement Manager Villa asked if the owner of the property would like to speak to the Board. Betty Vandervalk Walsh, owner of the property located at 17331 Gunnerson Street, indicated "Yes." Mrs. Walsh reported that she was unaware of the violations on the property until she received notice of the hearing. Mrs. Walsh noted that she has been trying for three months to evict the tenants. Mrs. Walsh agrees that the property is a nuisance. Mrs. Walsh indicated that an eviction is in process now and until the tenants are out, Mrs. Walsh stated that she could not do any work on the property at this time. Mrs. Walsh is willing to pay the City to abate the property. Planning & Code Enforcement Manager Villa requested comments from Board Member Watts. Board Member Watts replied "Yes," she had comments. Board Member Watts reported that she did go by the property last Friday and looked at the property from both sides of the street. Board Member Watts indicated from the pictures that she received in the packet, that she could not see any improvements. Board Member Watts felt that the property needs to be abated. Villa, called the Nuisance Abatement Board Meeting to order at 5:10 PM. Board Member Watts led the Pledge of Allegiance. Planning & Code Enforcement Manager Villa advised the Board of the need to select a Chairperson to preside over the hearings. Board Member Fagan nominated Board Member Watts who accepted the position and asked for the position to be for one year, allowing other Board Members the opportunity to be the Chairperson. ROLL CALL PRESENT: BOARD MEMBER: WATTS AND FAGAN ABSENT: NONE. Also present were: Planning and Code Enforcement Manager Villa, Senior Code Enforcement Officer Gordon, Office Specialist Staley. PUBLIC COMMENTS None. CONSENT CALENDAR A Motion to Approve the Minutes of June 15, 2004 was made by Board Member Fagan and seconded by Chairperson Watts. PUBLIC HEARINGS 1. Lots on Graham Avenue APN#374-171-018 & 019 - Numerous items stored on vacant lot. including construction equipment and supplies. mobile home and office trailers. Planning and Code Enforcement Manager Villa asked Senior Code Enforcement Officer Gordon to review the case with the Board. PAGE 2 - NUISANCE ABATEMENT MINUTES - AUGUST 17,2004 Senior Code Enforcement Officer Gordon stated that after receiving complaints about activity on the properties, she inspected them and found what appeared to be a work yard operating on the vacant lots without benefit of permits or a business license. A Notice of Violation was mailed to the property owner and a copy posted on the gate. While driving by about two weeks later, Senior Code Enforcement Officer Gordon saw people working in the yard and made contact with Charlie Alexander who admitted the items stored on the lots belonged to him. Mr. Alexander stated he had contacted the Planning Division at an earlier date and was not aware of any problems with using the properties as a work yard. Senior Code Enforcement Officer Gordon stated she told Mr. Alexander she would contact the Planning Division to see if this activity would be allowed and when it was determined it was not, Senior Code Enforcement Officer Gordon posted a notice on the gate stating all items had to be removed from the lots. After Senior Code Enforcement Officer Gordon had spoken to Mr. Alexander on several occasions and finding the lots were still being used for a business, the case was scheduled for a Hearing. Chairperson Watts asked Mr. Alexander if he would like to speak. Mr. Alexander indicated that he had contacted the Planning Division and believed he was able to use the properties as a work/ rental yard. Mr. Alexander stated he had been using the lots since around 1990 and that only recently were complaints made against him. Mr. Alexander added that the lots had been improved. - Planning & Code Enforcement Manager Armando G. Villa explained to Mr. Alexander that the property was zoned for commercial use only and that the property is also located in the downtown historical area of the City, and that all items on the property were in violation. Planning & Code Enforcement Manager Armando G. Villa also stated that if Mr. Alexander would make an appointment with Mr. Villa he would sit down with Mr. Alexander and explain what the City would approve on the lots. Senior Code Enforcement Officer Gordon expressed that it would be the City's recommendation at this time to declare the property a nuisance. A declaration of a nuisance would give the property owner 10 days to either remove all the items from the lots or to appeal the action of the City. The Board could also allow an extension to the Hearing or ask for the owner to be cited for code violations.
