LAKE ELSINORE, CA 92530 TUESDAY, NOVEMBER 18, 2008 CALL TO ORDER The regular Nuisance Abatement Hearing was called to order by Robin Chipman, Code Enforcement Manager at 4:35 PM. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Robin Chipman. ROLL CALL PRESENT: BOARD MEMBER: FAGAN PRESENT: PLANNING MANAGER: WEINER I I' PRESENT: CODE ENFORCEMENT MANAGER: CHIPMAN Also present were: Code Enforcement Officer Shawn Slater and Office Specialist Joyce Teyler. PUBLIC COMMENTS None. CONSENT CALENDAR 1. The following Minutes were not approved. The following Minutes were continued until next session. A. Minutes for October 21, 2008 PUBLIC HEARINGS Code Enforcement Manager Robin Chipman opened the Public Hearing at 4:36 P.M. Agenda Item No Page of PAGE 2- NUISANCE ABATEMENT MINUTES -NOVEMBER 18, 2008 2. VACANT LOT AT ILLINOIS/PALM STREET. APN 375-041-024 LAKE ELSINORE, CA Code Enforcement Manager Chipman asked Officer Slater for a run down on the property. Code Enforcement Officer Slater indicated this was a partially developed parcel along Palm Drive and Illinois Street. He stated the property owner had begun the development of a structure, possibly a single family residence. He commented that some time during the development of the property a fire brought it down leaving only the foundation, walls and cement rubble. He indicated no visible improvements have been made since that time. He stated no building permits had been pulled in an attempt to rehab the property or to continue development. He commented he received a complaint on approximately May 8, 2008 from an adjacent property owner regarding trash and debris being illegally dumped. He stated he conducted a site assessment on the May 13, 2008 at that time he had noticed a lot of rubble and debris on adjacent properties including the one which had burned down. He commented he issued the property owner a Notice of Violation, received no response, mailed subsequent warning letters with no response from those, mailed notices certified mail which were signed for and received but again we received no response. He commented our office had not been contacted either by telephone, email or otherwise. He stated based on the condition of,the property and due to him having to respond as a component of Code Enforcement on more than one occasion regarding nuisance issues regarding trash and debris being dumped and graffiti, he requested the Board declare the property a nuisance in order to remove the remains of the building restoring the property to a clean, flat, vacant lot. Board Member Fagan asked if the City was in a position now after they restructured the complaint to pick up the rest of the rubble in the surrounding area. Code Enforcement Officer Slater indicated that was correct. Code Enforcement Manager Chipman stated we continued this over from the last hearing because they wanted to include the remainder of the fire damage instead of just cleaning up the little bit of rubble on the lot across the street. He asked if there had been any response from the owner of the property. Code Enforcement Officer Slater stated there had been no response. Code Enforcement Manager Chipman inquired if we ever had contact with the property owner. Code Enforcement Manager Chipman commented they all knew there was a certain person involved on this project but he was not the owner of the property, the owner was Archibald Umanah. Code Enforcement Officer Slater said under the tax records it was Archibald Umanah. Board Member Fagan indicated he could not pronounce it. Code Enforcement Manager Chipman stated he tried. He commented unless Planning Manager Weiner had any comments he did not see any reason they just did not declare the property a nuisance and get it cleaned up. MOVED BY BOARD MEMBER FAGAN, SECONDED BY CODE ENFORCEMENT MANAGER CHIPMAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE VACANT LOT AT ILLINOIS/PALM STREET, APN 375-041-024, LAKE ELSINORE, CA, A PUBLIC NUISANCE. 3.
