The. meeting was. called to order at the hour of ~ o'elocY. P.M. with P:4ayor C. A. Lovejoy in the chair_ Councilmen H. Gallagher, H. C. Langstaff, S. Phi. Rice, J. E. IJills and G. A. Love~.oy answered the roll call. Absent: None. Minutes of the. previous meeting held on May §th were then read by the clerk and there bei.r~u no corrections or emissions were approved as read. - The clerk then presented to .Council a copy of a Elesolution adopt- ed by the Civic Section of the Woman's Club placing itself an record as asking the City Council to take act ion. toward appointing a committee from their number as a street tree committee and that they establish a pro- tective policy Yor street. tree a; also noting that the club objects to and asks for 'the r~noval cf the sign. "Heald Park" now placed on Graham .Ave. Upon Council's due consideration of .said matters, it was agreed that the chair appoint a Street Tree Committee and that: it be authorized to remove the Haald Park .sign. Whereupon the chair appointed Councilmen Rice and Gallagher to serve cn.a Street Tree Committee. - - Thereupon the Clerk presented to Council the resignation of Paul Kuenzlm as a member of the City Library Board. Whereupon it eras moved byrCouncilman Mills and ;seconded by Coun- cilman Rice anat. the: resignation of Paul. Kuenzli as a member of the Library Board be accepted which motion-upon-vote was unanimously carried. The Clerk then reported to Gouncil that he was. in receipt off an endorsed copy of Council's Resolution X233 provsding for the execution of an agreement with the Coxinty for the assessment and collection of the City's taxes, vrhich was sealed and endorsed by the Chairman and Clerk of the County Board of .Supervisors but that a copy of the executed agree- meet was not received. thereupon-it was moved by ,Councilman P.:ills acid seconded by Coun- eilman Langstaff that the Cleric be instructed to request a copy of said agreement for the City's files which motion upon vote was carried. i The vrritten opinion of City Attorney Best vrith reference to the City's liability account of sewer line crossing the private property of H. B. King was then presented to the.Couhcil and, i.t vras.his opinion 4 that R4r. King would have no right of action egainst the~city for damages, . nor could he be able to .compel-the City to remove its line across his property. Whereupon it was moved by Councilman Mills and seconded by Coun- _ cilman Rice that the opinion of City Attorney Best be received and order- ~ ed placed on file i^:hich motion upon vote was carried. (Continued) City Engineer Graham's report on-test ode at the .City Water Pumping Plant eras then. submitted .to the Council, -showing that terms of the contract covering the recent installation of gas .engines and .pumping equipment had been fulfilled. Whereupon it was moved by Councilman P;Iills and seconded by Councilman Lang staff that the recently installed pumping equipment be approved and accepted and that all accrued installments now due on said contract be authorized paid in full to date, which motion upon vote v,~as unanimously carried. The Clerk then presented to the Council a communication from Geo: V~J..Crouch, Attorney for Brovm Crummer Bond Co. in regard to City of Elsinore delinquent Water Bonds, v/ith enclosure of a copy of notice forwarded to .the County Tax Collector requesting that he publish a Notice. of Sale, and a list'of the property delinquent under said assessment, as provided by laFi, and asking Council to kindly cooperate to see that these instructions are carried out. The C1erY, reported that he received word from the. County Tax .Collector expressing. his desire to hold a conference with the City Attorney and himself regarding to .the natter of Elsinore-Water delinquent assessments. Whereupon after Council's due consideration of the matter, it was moved by Councilman Rice and seconded by Councilman Gallagher that the Clerk be authorized to confer with the County Tax Collector and the City Attorney regarding to said delinquent water assessments and that he be instructed on behalf of Council to express their attitude as against he payment of any .money for the expense eE publishing a list. of the delinmuent assessments or the advahcerre:nt of money from any • other fund for the paSrnterrt of delinquent .bonds, which motion. was carried by the follocring vote: - Ayes: Councilmen Sallagher, Langstaff, P,ice, Idills and Lovejoy. Noes• .None. Absent: None.. - .Council then considered and discussed at length City Engineer Graham's bill for (52174.5'0 which he presented f or payment for wcrY, done under his contract in the matter of Acquisition and Improvement District #1 Sewer Improvement, after proceedings for said improvement had been abarrloned: Councilman Gallagher moved that Engineer Graham's bill for ~2174.5C be allowed and paid.. The motion receiving no second was-lost. Whereupon Councilman Langstaff moved tkiat City Engineer Graham be allowed a payment of 8~ figured on the accepted contract bid of W. C. Bills as audited by the Auditing Committee were then presented to the Council and on motion dulp made and on call vote carried, arere ordered paid, and the clerk was instructed to issue warrants in payment of same. Thereupon there being no further business to come before the Council on motion c.uly made and carried, Council adjourned to moat in regular session on Monday, June 2nd at the hour of 7 o'clock p.m. in the City Hall, the usual meeting place. ayor v Clerk. -~
