The meeting was called to order at the hour of ~ o'clock p.m. with. F~ayor- A. G. Keck in the- chair. Councilmen: H. Gallagher, H. 0. Langstaff, C-. S. Merrifield and A. G. Keck answered the roll call. Absent: • A:;cS. Burnham. Pdinutes of the previous meeting held on April ']th were then read by the Clerk and on motion duly made and carried were approved as read. The clerk then presented to the Council a communication from J. F. Reimer, Deputy Clerk of the County Board of Supervisors enclosing an agreement for execution b~tvreeh the .City and County providing for certain compensation to be paid to the County for assessment and collection of the City's taxes.< Whereupon it was moved by Councilman Gallagher a rrl seconded by Councilman Lahgstaff that said communication and agreement be laid over for consideration by ihe_i.ncoming Council which motion eras carried by the follow- ing vote: Ayes: Councilman .Gallagher, Langstaff, Merrifield and Keck. Noes: None. Absent: Councilman A. S: Burnham: Thereupon the. Clerk presented to Council a communication from W. C. Seccombe who was acuarded the work in Acquisition and Improvement Dis- trict y-~1, enclosing therewith an opinieri by Attorneys Crouch and Crouch on -:the validity of the proceedings and in consideration of the findings in said opinion, gave Council notice that he declined to sin said contract and re- quested that certified check for 2000.00 deposited cith his bid, be returned to him. Whereupon after Council's due consideration of the matter, Peso- lution #231 was introduced and read being a Resolution of the City Council providing that Resolution of; Intention #224-adopted on Mahe 10th day of Feb. !1930,and all subsequent proceedings had in the above entitled matter, be, and the same are hereby repealed and set aside. Whereupon it was moved by Councilman Langstaff and seconded by Councilman_Gallagher that Resolution 231 be passed and. adopted which motion was. carried by the follo~:ing vote: - Ayes: Councilmen --Gallagher, Langstaff, Merrifield and Yeck. Noes: None. Absexrt: Councilman Burnham. - Thereupon the Clerk presented to tYie Council a communication from City Engineer Glenn-Graham with enclosed statement for X2194.50 to cover wort, done under the Acquisition and Improvement District ~1, City of Elsinore Sewer job, uihich amount erould be due him in the event that-said work eras en- tirely abandoned and requested that Council examine said statem azt and pass upon it and make their findings of record in the minutes, Whereupon after Council's due consideration of the matter it was moved by Councilman Gallagher and seconded by Councilman Langstaff that the statement submitted by City Engineer Glenn Graham for $2194.50 to cover work Page ~2. Absent: Councilman Burnhaxa. ..Council then considered the matter. of starting new pro- . ceedings in the matter of Acquisition and Improvement District ~1 and the adoption of the Resolution of Intention. 4Yherenpon it was moved by Councilman LaxLgsta.ff and second- ed by Councilman R~errifield-that the matter of ordering new pro- ceedings and the adoption of the. Resolution of Intention in the ,matter of Acquisition and Improvement Dist. #1,.be laid over for consideraticn by the incoming Council which motion was carried by the follovd.ng vote: .Ayes: Councilmen - Gallagher, Langstaff; Perrifield and Keck. A?o es: None, Absent: Councilman Burnham. The chair then appointed Councilman Langstaff to serve on the auditing committee in the absence of Councilman Burnham. "Bills as audited by the auditing co:mnittee were, then pre- serrted to the Ccuncil and on .motion duly made and on call vote un- animously carried were ordered paid and the Clerk was instructed to issue, warrants in payment of same. The retiring Council thereupon made a ca~ivas of"the votes cast at the ?viunicipal el ection held in the City of Elsinore, Cal if. on the"14th day ;of April 1930.. T9hereapon Resolution:#232 t~ras introduced and read, being a Resolution of the City Council declaring the result of election. The following persons were declared elected by said Resolution: C. A. Lovejoy - Councilman - Full Term 4 years. J. E, Mills - Councilman -.Full Term. 4 years. S. Pd. Rice - Councilman -,Short Term 2 years. A, E, Gustafson -.Treasurer- Short.Term 2 years. 9~hereupon it wa.s moved by Councilman Langstaff and second- " ed by Councilman Merrifield that Resolution 232 be 'passed and adopted. Upon roll ,call said Resolution 232 was passed and"adopted by the following vote: - -Ayes: Councilmen Gallagher, Langstaff, Merrifield and Keck. `" Nces: None. I / The retiring Council" then adjourned sine- die, and the new officers took charge of their respective offices when .the .following proceedings vvere had. Upon roll call the following Councilmen were found present: H. Galla- gtser, H. 0. Langstaff, S. Ph, Rice, J.. E. IIRills and C. A. Lovejoy.. S. M. Rice then nominated C. A. Lovejoy for the position of It4aydr of the City. and presiding officer of the. City Council. Plhereupon Councilman Langstaff moved that nominations be closed and that. Councilman C. P., Lovejoy be, unanimously declared elected to said office, rJhich motion was seconded by Councilman Piills, and upon vote said motion was unanimously carried. Mayor Lovejoy then took the chair and in a few well chosen vrords, paid fitting tribute to :the retiring councilmen and expressed his apprec- iation of `tke honor conferred upon him by the new Council. The appointment of standing commmittees by the Pdayor were delayed to the next meeting of tYs Council. Upon the request of the chair the Clerk then presented to the Council the Treasurer's last monthly report of the City's finances. The clerk then presented to the Council a communication froia-J. F. Reimer, Deputy Clerk of the County Board of Supervisors c+~.th an enclosed agreement to be executed between the City and the County procri.din~ for cer- tain compensation to be paid to the County for assessment and collection of the City's taxes, which matter had beat laid over by the retiring Council for consideration by the new Council. Tpon due consideration of said matter it was moved by Councilman Lard;staff and seconded by Councilman Rice that the P4ayor and City Clerk be authorized to execute the agreement providing for certain compensation to be paid to the County for assessment and collection of the City`s taxes, which motion was carried by the follova.ng vote; Ayes: Councilmen - Gallagher, Langstaff, Rice, PSills and Lovejoy. Noes: None. Absent: None. _/ The Clerk then reported to the Council that the retiring Council had passed and adopted Resolution }f'231, thereby repealing and setting aside Resolution of Intention 224 and all subsoquerit proceedings in the matter of Acquisition and Improvement District ~1, because of a certain omission in the publication of the Resolution of Intention, which invalidated the proceedings and that the retiring Council had laid over for consideration by the incoming Council, the natter of ordering new proceedings or aban- donirig the work.
