PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Tom Weiner. ROLL CALL PRESENT: BOARD MEMBER: FAGAN PRESENT: PLANNING MANAGER: WEINER PRESENT: CODE ENFORCEMENT MANAGER: CHIPMAN Also present were: Code Enforcement Officer Shawn Slater, Officer Fred Lopez, Officer Irma Salazar and Office Specialist Joyce Teyler. Code Enforcement Manager Chipman stated for the record Loraine Watts was absent.. PUBLIC COMMENTS I None. CONSENT CALENDAR 1. The following Minutes were not approved. Minutes for November 18, 2008 PUBLIC HEARINGS Code Enforcement Manager Robin Chipman opened the Public Hearing at 4:35 p.m. 3. 16420 JOY STREET, APN 379-131-008, LAKE ELSINORE, CA Code Enforcement Manager Chipman asked Officer Lopez to speak regarding the case. Code Enforcement Officer Lopez indicated this case was initiated via citizen complaint on November 18, 2008. He stated the complaint alleged a large amount of debris was left over after some trees had been trimmed from the adjacent condominium complex. He commented there were six to eight units in the complex and approximately five full sized Eucalyptus trees which had been trimmed. He stated the trimmings were not removed from the property they were placed in a back vacant lot adjacent to Machado Elementary School. He noted numerous complaints from the residents of the complex as well as members of the School District had been received. He stated a Notice of Violation was sent ~I and no contact was made. He commented he had hand-delivered a Notice of Violation to Rick Estes who was the property manager for the complex. He said Rick Estes stated he would forward it to the property owner due to our records did not give an address for the property owner. He indicated after a re-inspection the debris had not been removed and no work had been done. He stated the only change he noticed was a fence was put up and it was locked. He commented he remade contact with Rick Estes who provided owner information wherein we resent the Notice of Violation with a Warning Notice giving them ample time to fix the problem. He indicated we received a message from an unknown individual who stated the work on the property had been done. He commented when he had done his recheck before the Nuisance Hearing last Thursday, the work had not been completed. He stated according to the phone message the work had been completed that day. He commented he had not been able to verify the work was completed so his recommendation would be to declare the property a public nuisance and he would re-inspect tomorrow to see if the work had been done and if it was done correctly. Code Enforcement Manager Chipman indicated he recognized the name on the case, William Olin. He stated it appeared a Lori Olin had signed for the certified letter, so they were obviously aware of the situation and if he remembered correctly these were the same property owners that owned the apartments in the front. Code Enforcement Officer Lopez agreed. He indicated the address we received from Rick Estes was somewhere in Northern California. Code Enforcement Manager Chipman stated it was San Luis Obispo. He indicated the property owners were to notify us forty-eight hours in advance since they failed to do so he felt they should go ahead and declare the property a nuisance. He indicated this would give Officer Lopez a chance to go re-inspect tomorrow. He asked Board Member Fagan if he had a change to get out there. Board Member Fagan indicated he had gone by there but had not looked over the fence. He stated if the stuff was behind the fence he would not have been able to tell. Code Enforcement Manager Chipman indicated the only access was to drive through the front of the apartments. Code Enforcement Officer Lopez indicated you would either have to drive through the ;front of the apartments to the back or had gone on the field of Machado Elementary. Planning Manager Weiner asked if the debris there had come from the condominiums. Code Enforcement Officer Lopez stated yes. He indicated there was approximately four to five full size Eucalyptus trees on property which had been cut down to the roots and the debris was dumped on that empty field. He commented it was quite a bit of debris. Planning Manager Weiner asked if the property manager from the condos was just wiping his hands clean of it even though they dumped it. Code Enforcement Officer Lopez commented he had stated nothing had materialized. until we started pushing the issue. Planning Manager Weiner stated we would let the property owner seek recourse with the condo people. Code Enforcement Manager Chipman indicated he believed it was one in the same people. He indicated the vacant property where the nuisance was, was j owned by the same person that owned the front units. Code Enforcement Manager Chipman stated it was intended to be a continuation of these units. Planning Manager Weiner commented he got it. Code Enforcement Manager Chipman asked if it had caught on fire. Code Enforcement Officer Lopez stated he was not sure. Planning Manager Weiner indicated he thought it was a different ownership. Code Enforcement Manager Chipman commented they were using it as an overflow lot and dumped their debris. Planning Manager Weiner asked if it was visible from the school. Code Enforcement Officer Lopez stated it was. MOVED BY CODE ENFORCEMENT MANAGER CHIPMAN, SECONDED BY BOARD MEMBER FAGAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE VACANT LOT AT 16420 JOY STREET, APN 379-131-008, LAKE ELSINORE, CA, A PUBLIC NUISANCE. 4. 364 AVENUE 4, APN 373-192-046, LAKE ELSINORE, CA Code Enforcement Manager Chipman asked Officer Salazar to speak regarding the case. Code Enforcement Officer Salazar indicated she had opened an initial case on this property back in November 2007 wherein the overall maintenance of the property was not being kept, paint was peeling, bins of trash were overflowing, car parts, car seats and vehicles she based to be inoperable due to faulty registration with oil below them. She stated the few times she had tried to make contact she had never spoken with an adult. She commented it was always teenagers who told her the parents were not home. She stated all correspondence that was mailed to them had been returned. She indicated some mail was sent certified and some was sent first class all of which had been returned. She stated the last complaint was from a realtor on December 31, 2008 and the pictures involved were in the same way the property looked back in November of 2007. She indicated she was out there last Wednesday doing an inspection i adjacent to the property and the same kids she had spoken to in the past had their vehicles scattered over the property which was another violation. She commented they had come out and moved their vehicles. She stated before she could talk to them regarding the nuisance case they had scattered away. She commented she had never seen an adult at the property. She indicated every time she had tried to make contact it had always been teenagers who told her the parents were not home. Code Enforcement Manager Chipman indicated we had made a very reasonable attempt to contact them. He asked if notices had ever been posted at the property. Code Enforcement Officer Salazar stated no notices had been posted. She indicated the few times she had been out there she had only spoken to the kids or pit bulls had been running around who were not very friendly. She commented that was why she sent notices first class mail as well as certified and both had come back unclaimed. Board Member Fagan asked if she had ever taken an Animal Control Officer out there with her. Code Enforcement Officer Salazar stated she had not thought about that. Code Enforcement Officer Slater addressed the Board. He indicated there was a long history of issues going back prior to 2004 at this residence. He stated he had personal contact with the property owners both husband and wife, all the kids, law enforcement had been out there with him and they had been in meetings with the former Code Enforcement Manager Armando Villa. He commented they know what violations existed. He indicated he had personally spoken with them and handed them tickets. He stated he would knock and notice and they would move all their cars. He commented after the fourth or fifth time he would just start writing tickets and they would throw threats of violence. He said there was currently a standing order for any police officer who gets dispatched to the house they cannot go unless there are two cars available. He stated the family was very familiar with our Code Enforcement policy, procedures and codes. Board Member Fagan indicated he had gone by on Friday. He stated the garage door was open and cars were parked in the street as well as in the driveway. He commented there was a stream of people walking in and out. Code Enforcement Officer Salazar indicated there existed allegations that the guy was running an illegal car business. She stated she had never been able to prove the fact but there were always cars there. She commented she had towed Agenda Item No Page of PAGE 6 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 vehicles from the vacant lot at the end of Mill and Avenue 4. She stated she believed she had towed at least three different vehicles at separate occasions from that vacant lot and they were vehicles that would not fit in their garage, driveway or lawn that they had been working on. She said they would not take care of the vehicles and she had no other choice but to tow the vehicles. She stated another problem she had was the dad was a junk hauler and all the junk ended up at the property. She indicated he had a big pick up truck wherein he stored his trash in the back of the truck for weeks before he disposed of it. She commented she was not sure how he deposed of it. She stated it was a revolving door of trash and inoperable vehicles. She commented she had towed three cars from the vacant lot and they pertained to that case and more cars just kept coming: Code Enforcement Manager Chipman indicated he could not see any reason why not to declare it a nuisance. He commented if they did declare it a nuisance how would they get a contractor in there to do the work. He asked if there would be issues getting access to the property. Board Member Fagan indicated there would have to be a patrol officer there. Code Enforcement Officer Slater stated it would have to be warrant with law enforcement support. F"i Code Enforcement Manager Chipman stated they would have the nuisance abatement warrant to enter the property before they went to bid. He commented it seemed to him the property had a few other issues. Code Enforcement Officer Slater indicated they had received letters from the City Prosecutor a number of years ago. He stated they still had a lot of the case documentation, outstanding citations and a lot of case work he had done with a hundred of photographs. He commented if it was in the City Budget to do so, if they were not in compliance within the date the Board determines, if you declare it a nuisance, forward it to the City Prosecutor for further action. Code Enforcement Manager Chipman stated to let them deal with it. Board Member Fagan indicated that would be a start to declare it a nuisance. Code Enforcement Officer Salazar commented she had run a property report on 364 Avenue 4 on January 5, 2009 and it showed a Notice of Default as of December 3, 2008 with a default amount of $17,000. She stated if they could take possession of the property once they default it we could require the bank to clean it up.; She said before that she would like to remove the inoperable vehicles with a warrant and law enforcement support. She stated that should be the first step in cleaning up the property. Agenda Item No Page of PAGE 7 -NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 Code Enforcement Manager Chipman agreed if they declare it a nuisance that would be the first step. Planning Manager Weiner indicated he had three quick things. He stated we needed to have Officer Burns stay on the property so as when it does foreclose we could contact the bank to get those people out. Code Enforcement Manager Chipman stated they already defaulted. Planning Manager Weiner indicated when it finally foreclosed, if they could expedite getting the notice to vacate or whatever they do to clear people from a property. He asked Code Enforcement Office Specialist Teyler to contact the realtor by email and advise them of our action. Code Enforcement Office Specialist Teyler indicated she would contact the realtor. Planning Manager Weiner indicated Sandy Keen. Code Enforcement Office Specialist Teyler indicated she was trying to sell a home in the neighborhood. Planning Manager Weiner indicated if we could let her know that this had been done hopefully it would satisfy her that action had been taken on the complaint. He commented he would also see if Animal Friends could send someone out there to start a case on the home as well if they have pit bulls running around. Code Enforcement Officer Salazar indicated there was a different story every time she went out there. She stated she talked to a different kid every time. She commented '.Officer Slater had received the stories and she had received the stories. Planning Manager Weiner indicated he understood there were kids in that neighborhood. Code Enforcement Officer Salazar stated they hang out and it did not look like they were the safest people so she was very cautious when she approached them. Planning Manager Weiner stated if they could do everything through mail notification from this point there was no need to go back onto the property. He indicated there was no need to jeopardize our officers if the bank was ~I foreclosing. i Agenda Item No Page of PAGE 8 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 Code Enforcement Officer Salazar concurred. VACANT LOT AT 213 N. LINDSAY, APN 374-143-012, LAKE ELSINORE, CA Code Enforcement Manager Chipman asked Officer Slater to speak regarding the case. Code Enforcement Officer Slater addressed the Board. He indicated the case involved a vacant undeveloped parcel of property. He commented there was once a single family residence located on the property addressed 213 North Lindsay Street. He stated there was a house fire last year and the property sat untouched for quite some time. He indicated it was right across the street from the school and a house very close to it on a neighboring property. He said the house was put into Structure Abatement and the property owners had at the bottom of the ninth decided to abate and demo the property on their own. He F11 indicated we had a warrant for that action but the property owners insisted they were capable of doing the demolition. He commented they made mention of their plan to develop the property immediately after demoing it. He indicated the property had sat vacant for quite some time and they had left piles of rubble, remaining fence and some slab work on the property. He stated there had been no communication from the property owners since the demo. He commented all the mail still. goes to 213 North Lindsay Street. He said the mail had been returned to sender. He stated during a conversation they had prior to the demo wherein they were advised to make sure their mail was forwarded to the appropriate location. He said they had not done that and we had done all we could to contact the responsible party to ask them to clean it up. He indicated all we wanted was for them to clean up the property and remove the slabs. He stated the neighbors in that community were very concerned and every time they drive by or they see one of the inspectors, they make their concerns known. He indicated that due to the community concerns was why he brought this action to the Board asking they declare this property a nuisance in order for us to remove the trash, debris, any remaining slabs or things that do not conform to our standards. Code Enforcement Manager Chipman indicated he was familiar with the owner of the property, Tracy Bell. He stated he believed she lived up in Northern California. He commented when they were going through the abatement process after the fire he had several conversations with her and discussed the Agenda Item No Page of I PAGE 9 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 development of the property. He said she was talking about moving a modular home on a permanent foundation onto the property. He commented she had a gentleman that represented her who was local but he could not remember his name. He indicated they dragged their feet regarding this property and like Officer Slater indicated we had gone all the way to getting the warrant for structure abatement before they finally pulled the permit to demo. Code Enforcement Officer Slater indicated it was on the same day. Code Enforcement Manager Chipman indicated it was at the last minute. He stated he felt there was no other recourse but to declare it a nuisance and get the rest of the property cleaned up. MOVED BY CODE ENFORCEMENT MANAGER CHIPMAN, SECONDED BY BOARD MEMBER FAGAN AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO DECLARE THE PROPERTY AT 213 NORTH LINDSAY, APN 374-143-012, LAKE ELSINORE, CA, A PUBLIC NUISANCE. 6. 312 NORTH SPRING STREET, APN 374-073-001, LAKE ELSINORE, CA Code Enforcement Manager Chipman asked Officer Slater to speak regarding the case. He noted Mr. Bashi had showed up. He asked if Mr. Bashi had a statement or would he like to field questions. Mr. Mubarak Bashi indicated no. He stated he had an application with the same thing as last time but he had visited his office so many times and he had given him a letter regarding the demolition. He stated after that the D.A. Box Company had given them lots of problems. He commented last week they gone there to move garbage and neighbor people told him that D.A. Box Company was taking money from people and telling them they could dump the garbage on his property. He indicated now the situation there was too much rubble and too much garbage. He stated him and son last week hired someone to try and move it but it was unbelievable. Code Enforcement Manager Chipman stated he would like Officer Slater to discuss the item, tell some background history and then they would go from there. Code Enforcement Officer Slater addressed the Board. He indicated they were looking at two cases, initially the case was written up by him, September 2007. He stated at that time there was a commercial building sitting on this very large parcel property nearly a block long and half a block wide. He commented the F11 Agenda Item No Page of PAGE 10 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 commercial property was once known as the location for the Glowfire. He noted the Glowfire plant was a historical place which was demoed. He indicated what remained was a metal structure and a fenced in yard with cement slabs. He stated the property had been sitting unmaintained for quite some time. He commented the exterior appearance or curb appeal appearance would be weeds up to six to eight feet tall. He indicated the building was repeatedly tagged with graffiti and piles of debris left in the rear lot visible from the backside of the properties that front Main Street. He commented the people who lived on Main Street looked out their back windows into this lot. He noted there was also an abandoned camper trailer in the lot for quite some time. He indicated the fence had begun to fall over due to it being only a temporary fence just propped up and not stuck in the ground. He commented the wind would constantly blow it over. He stated it had green mesh to block the view. He said he initially started with the Notice of Violation for the unsightly appearance, the graffiti, the trash, the rubble and the unsightly fence that did not conform to code. He commented there was never any response even after Warning Notices and citations. He stated as this property progressed to the status of Nuisance Abatement Mr. Bashi had come before City Council and due to that consideration he had backed off on the enforcement to give him the opportunity to do something with the property. He indicated after some time had passed and no visible action had been taken to either maintain the property or do something with it, he reinitiated the case on March 28, 2008 for the same conditions. He noted those conditions j were overgrown vegetation, graffiti, unsightly fence, trash, debris and rubble. He l indicated we mailed and posted the Notice of Violation, mailed citations for lack of response and shortly thereafter it was observed by our Department, including our Building Official Mr. Chipman, some type of operation existed in the building. He stated the building was deemed uninhabitable, sub-standard structure. He commented the property owners would sub-let the property out for storage. He noted one was storage for computers as they were packaged up and shipped over to China for recycling. He indicated after that it became a storage location for another individual for storage for furniture sales. He stated after we got them out, Mr. Bashi and his affiliates used it for an international spice business transferring spices to other counties and the US. He commented they issued criminal citations, Notice of Violations, Warning Notices, having the deputies out removing someone who had a warrant for their arrest and Health Department doing an inspection. He stated the photographs with the trailer and all the stuff was the Health Department who had seized everything regarding the business with the spices. He commented he was ordered to remove it all. He indicated on behalf of the City Management he had been given a break who allowed him the ability to haul the stuff off himself, photograph it and bring in the reports from Waste Managements. He stated he had done a good job on meeting our demands by following through with the demolition. He commented the City had put the property in structure abatement to demo the building and that took quite a long time with communications going back forth. He noted it had again come l down to the bottom of ninth, the twelfth hour, we had gotten the warrant to demo Agenda Item No Page of PAGE 11 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 the building ourselves. He indicated he was in negotiations with another demo contractor to. get the property demoed. He stated they demoed the building but conditions were to remove the building, the structure, the fence„the rubble, the debris, the foundations and basically leaving the property a clean flat lot. He commented we could see the building was gone but the lot still remained with the slabs, the walls, the fence and the rubble. He noted it now had become a common place for illegal dumping. He indicated our own City Manager had rolled up on somebody doing illegal dumping there two weekends ago, got a business card from that person who was D.A. Box. He stated D.A. Box was the same individual who was contracted by Mr. Bashi and family to demo the building. He commented there was a civil matter between the two so D.A. Box had taken it upon himself to use that property as a dumping ground. He indicated we were trying to locate him to forward that information over to the City Prosecutor to fine and prosecute him for illegal dumping. He commented that was a separate issue. He noted what remained was all the trash, debris, rubble and the fence. He indicated he would like to request to the Board to declare this property a nuisance so we could do Mr. Bashi a favor by removing all the stuff and removing the eye soreness from our City. Code Enforcement Manager Chipman addressed Mr. Bashi stating Mr. Bashi had known the history as well as anybody regarding this property. Mr. Bashi agreed. I Code Enforcement Manager Chipman indicated they had spoken six weeks ago wherein they talked about the City coming in and finishing the job that his demo contractor had not done. Mr. Bashi agreed. i Code Enforcement Manager Chipman stated they had talked about him doing it voluntarily allowing the City to go in there but after he had spoken to the City Attorney that was not a direction the City wanted to take. He indicated they wanted to take it to a formal hearing which was a Nuisance Abatement Hearing so they could formally declare it and that would give them the right of entry to obtain a warrant to go in and do what needed to be done. He commented he + had not wanted to be involved in the middle of his demo contractor and their dispute. He noted outside of what Officer Slater had just stated was there anything new that he would like to bring to the table. He commented he understood that he may be dumping illegally on his property. He stated they had spoken about securing the property and posting signs with no trespassing. He commented we really needed to get the property cleaned and get everything out of there. He indicated it would still be Mr. Bashi's responsibility to maintain it and keep it secured but at least the City would get it to that point. He asked if there were any comments from the Board. i Agenda Item No Page of PAGE 12 - NUISANCE ABATEMENT MINUTES - JANUARY 20, 2009 Board Member Fagan stated he had said him and his son were working on ~I cleaning it up. Mr. Bashi indicated they were thinking there was a little bit there but last weekend he had gone to check on it and there was a lot of rubbish. He stated they never thrown rubbish there or gave permission. Board Member Fagan indicated there was a pile of concrete. Mr. Bashi stated he was getting money from people, the neighbors told us. He commented he would tell them it was his property, this was my place, you dump here, give me some money and he was doing the business. He indicated the second thing was three times he put locks on the property and he cut off the locks even his property on Sumner he never asked him to demolish it. He stated he demolished it and took all the machinery inside such as forklift worth $200,000, he had stole it and had sold it. He commented three times he had stolen his big gates. He stated people had told him he had sold them to the junk yard people. He indicated he was a civilian and legally we could give him a citation. He stated he was giving him a lot of troubles. Code Enforcement Manager Chipman agreed. He stated he understood there was a dispute between him and D.A. Box Company. Mr. Bashi stated he could give him the document. Code Enforcement Manager Chipman indicated as Officer Slater stated earlier we were trying to find out his location and we would go after him for the dumping. Mr. Bashi indicated his appreciation. Code Enforcement Manager Chipman stated we could not get involved in the civil matter. He commented if he was stealing his property that was a civil matter and he needed to file a claim for that. Board Member Fagan indicated there was no way him and his son was going to be able to move those blocks of concrete. Mr. Bashi concurred. Code Enforcement Manager Chipman indicated the Board's intent was to strictly get the lot completely cleaned and then it would be his responsibility to secure the lot, get some fencing up, post it and then that would give us the right as Code Enforcement if we see someone dumping we could go after them. Mr. Bashi indicated he would fix up the fence and lock up the property. He stated his handyman was working and showed him where the locks were cut on Saturday. He asked for protection. Code Enforcement Manager Chipman stated we could not provide him protection that was not what the Board was for. He indicated we were here to determine whether or not it was a nuisance and if so, declare it and try to get it cleaned up. He commented we could not protect him from the people out there. He stated it was his responsibility to protect his property by securing it with temporary fencing or whatever was necessary. He noted we were not the police department. Mr. Bashi indicated he understood. He stated we were the City Authority and we had laws to uphold and to issue any citation or suspend it or send a warning. He commented he was ready to comply with all of our instructions, him and his son one hundred percent ready. Code Enforcement Officer Slater indicated to Mr. Bashi that all the efforts were made. He stated he researched all the phone numbers on the business cards he had for D.A. Box Company and they were all disconnected. He commented they ~I were trying to find other resources to track down who D.A. Box was by checking the State Contractors Board, any business license documents and all the above. He said once they located them, they would bring litigation against him for his illegal activities but that was the City going after him for illegal dumping. He indicated he could say to the Board that he thought he had caught someone illegal dumping last Saturday but it was Mr. Bashi and his son with a trailer out there hauling a couch, mattresses and a lot of trash away. He stated he did not catch an illegal dumper. He commented he had called Mr. Chipman last week regarding a building being dismantled. He indicated it was Mr. Bashi's building but it was D.A. Box Company who allegedly paid someone to remove the building without Mr. Bashi's approval. Mr. Bashi stated he had not given anyone the approval. Board Member Fagan indicated they should declare the property a nuisance. Code Enforcement Manager Chipman stated it was an attractive dump site right now. Code Enforcement Manager Chipman indicated he had bid on projects in the past. He stated he had not received any of the work. He commented the last project which he believed was this project he did bid on. Code Enforcement Officer Slater stated it was. Code Enforcement Manager Chipman indicated he was never awarded the bid because we never got to that point. Planning Manager Weiner stated we should not consider those bids if he was out doing illegal dumping in the City. Code Enforcement Manager Chipman commented if he was to come back into the door we would try to get hold of his address. Mr. Bashi indicated under that contract there were two clauses, plus he was to get insurance which he never had. He stated one clause he would get the demolish permit from the City which he never got. He commented he never called, he never called my son, he was always gone, all of our property was gone ~I and they were looking. Planning Manager Weiner indicated to Mr. Bashi that it was a civil matter between him and D. A. Box and as a City we would do whatever was in our power to make sure they have their business license and they are doing things that require permits that they had their permits. He commented we would take care of that on our end.
