Recommendation
1. Adopt Resolution No. 2013-po 6
3 Resolution of the City Council of the City of Lake
Elsinore, California, Approving General Plan Amendment Nos. 2013 -03 and
2013 -04, Cleanup Amendments as Part of the Consistency Zoning Project,
Phase III; based on the Findings and as shown on Exhibits 'A' through 'C.'
2. Waive further reading and introduce by title only: Ordinance No. 2013 -1326
Ordinance of the City Council of the City of Lake Elsinore, California, Approving
Zone Change No. 2013 -04, Known as the Consistency Zoning Project - Phase
III, Amending the Official Zoning Map, Changing the Zoning of Various Parcels in
the East Lake, North Peak and Lake View Districts of the City to Zones
Consistent with the General Plan Designations therein, by roll call vote.
Background
The City of Lake Elsinore adopted an update to its General Plan on December 13,
2011. On September 25, 2012, the City Council approved Phase I of the Consistency
Zoning Project for Mixed Use and High Density Residential properties City -wide. On
April 23, 2013, the City Council approved Phase II of the Consistency Zoning Project for
the Business District of the City.
Phase III of the Consistency Zoning Project proposes to bring the Official Zoning Map of
the City of Lake Elsinore into conformance with the adopted General Plan for the East
Lake, North Peak and Lake View Districts.
At the regularly scheduled Planning Commission hearing on October 1, 2013, no one
from the public wished to speak. The Planning Commission unanimously approved
Resolution No. 2013 -73, recommending that the City Council approve General Plan
Amendment Nos. 2013 -03 and 2013 -04; and unanimously approved Resolution No.
2013 -74, recommending that the City Council approve Zone Change No. 2013 -04. On
December 3, 2013, the Planning Commission unanimously amended these resolutions
by adding three (3) properties to the GPAs and ZC. The properties added by the
Planning Commission have been incorporated in the Resolution, Ordinance and
Exhibits prepared for the City Council.
Discussion
General Plan Amendments 2013 -03 and 2013 -04
Cleanup GPAs are necessary in the East Lake and Lake View Districts to correct the
inadvertent error in the East Lake Specific Plan boundary at its southeast corner, to
recognize property owned and preserved for open space by the Riverside County Parks
and Open Space District, and to recognize an existing well site owned by the Elsinore

Valley Municipal Water District. Furthermore, the cleanup GPAs recognize an existing
R -1 single - family residential development east and north of the Rice Canyon
Elementary School, as well as currently zoned R -1 property adjacent on three -sides to
developed and undeveloped R -1 zoning. Lastly, the proposed GPAs recognize the
existing viable multiple - family housing (namely the Lake View Apartments I and Il,
Walnut Grove, Sierra Vista, North Lake, Grand Oaks, and Harbor Grand) as the highest
and best use in the Lake View area.
Zone Change No. 2013 -04
The proposed zone changes to make zoning compatible with the General Plan
designations in the East Lake, North Peak and Lake View Districts are shown in four
exhibits. These exhibits show existing zoning, the General Plan designation, and
proposed zone change. All exhibits are within Attachment 3, Color 11" X 17" Exhibits.
Fiscal Impact
None. With the proper zoning in place consistent with the General Plan, development of
applicable projects is expedited, and may provide positive revenue to the City in the
future.
Environmental Determination
The City certified a Recirculated Program Environmental Impact Report (RP -EIR) for the
update to its General Plan. The proposed General Plan Amendment Nos. 2013 -03 and
2013 -04 and Zone Change No. 2013 -04 to the City's Official Zoning Map implements
the General Plan update, applying appropriate zoning districts compatible with their land
use designations. No additional environmental review is required.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING GENERAL PLAN
AMENDMENT NOS. 2013 -03 AND 2013 -04, CLEANUP
AMENDMENTS AS PART OF THE CONSISTENCY ZONING
PROJECT, PHASE III
WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on
December 13, 2011; and
WHEREAS, Government Code Section 65358 empowers the legislative body to
amend all or part of an adopted general plan if to do so would be in the public interest
and so long as no mandatory element of the general plan is amended more frequently
than four times during any calendar year; and
WHEREAS, General Plan Amendment Nos. 2013 -03 and 2013 -04 are part of the
City's Third (3rd) Cycle amendments to the Lake Elsinore General Plan for the 2013
calendar year; and
WHEREAS, General Plan Amendment No. 2013 -03 corrects the boundaries of
the East Lake Specific Plan on the General Plan Land Use Map, Figure 2.1A, in the
East Lake District, to include existing residential subdivisions south of Skylark Drive,
north of Corydon, east of Union Street and along both sides of Palomar Street; and
WHEREAS, General Plan Amendment No. 2013 -04, corrects various land use
designations on the General Plan Land Use Map, Figure 2.1A, in the Lake View District,
to accurately reflect existing single - family residential subdivisions and property currently
zoned "R -1 Single Family Residential" as "Low- Medium Residential'; property owned by
the Riverside County Parks and Open Space District as "Open Space'; property owned
by the Elsinore Valley Municipal Water District as "Public /Institutional;" and existing
apartment complexes (namely Lake View Apartments I and ll, North Lake, Sierra Vista,
Grand Oak, Harbor Grand, and Walnut Grove ) as "High Density Residential "; and
WHEREAS, on October 1, 2013 and December 3, 2013 at duly noticed public
hearings, the Planning Commission considered evidence presented by the Community
Development Department and other interested parties with respect to this item; and
made its recommendation in favor of General Plan Amendment Nos. 2013 -03 and
2013 -04 by adopting Planning Commission Resolution No. 2013 -73 recommending to
the City Council approval of General Plan Amendment Nos. 2013 -03 and 2013 -04; and
WHEREAS, on December 10, 2013 at a duly noticed public hearing, the City
Council has considered the recommendation of the Planning Commission as well as
evidence presented by the Community Development Department and other interested
parties with respect to this item.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1, The City Council has reviewed and analyzed the proposed General
Plan Amendments pursuant to the California Planning and Zoning Laws (Cal. Gov.
Code §§ 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore
Municipal Code and finds and determines that the proposed General Plan Amendments
are consistent with the requirements of California Planning and Zoning Law and with the
goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal
Code.
SECTION 2. That in accordance with the California Planning and Zoning Law
and the Lake Elsinore Municipal Code, the City Council hereby makes the following
findings for the approval of General Plan Amendment Nos. 2013 -03 and 2013 -04:
1. The proposed General Plan Amendments will not be a) detrimental to the health,
safety, comfort or general welfare of the persons residing or working within the
neighborhood of the proposed amendments or within the City, or b) injurious to
the property or improvements in the neighborhood or within the City.
a. The proposed General Plan Amendments have been analyzed relative
to their potential to have detrimental effects to ensure that the health,
safety and welfare of surrounding residents will be protected.
b. The proposed General Plan Amendments appropriately identify land
uses on the General Plan Land Use Map.
c. The proposed General Plan Amendments recognize viable existing
development, and promotes their continued use.
2. The proposed General Plan Amendments will permit reasonable development of
the area consistent with its constraints and will make the area more compatible
with adjacent properties.
The proposed General Plan Amendments apply appropriate zones that provide
development standards for reasonable buffering of adjacent uses.
3. The proposed General Plan Amendments would establish a land use density,
intensity and usage more in character with the subject property's location,
access, and constraints.
4. The proposed General Plan Amendments will not have a significant effect on the
environment.

The effects of the General Plan Amendments have been analyzed in the
Recirculated Program Environmental Impact Report (SCH #2005121019)
prepared for the City of Lake Elsinore General Plan and its related cases which
was certified on December 13, 2011, and adequate mitigation measures have
been prepared where necessary.
SECTION 3. Based upon the evidence presented, both written and testimonial,
and the above findings, the City Council hereby approves General Plan Amendment
Nos. 2013 -03 and 2013 -04, as shown on the attached Exhibits 'A' through 'C:'
East Lake Specific Plan Boundary — Include within the boundaries of the East
Lake Specific Plan, the following properties:
Assessor's Parcel Nos. 370 - 120 -045, and -067 thru —075 from R Recreation, LMR Low
Medium Density Residential, and MDR Medium Density Residential to SP Specific Plan;
and
Assessor's Parcel Nos. 370 - 411 -005 thru -011; 370 - 412 -001 thru —014; 370 - 413 -001
thru -010, -015 thru -026; 370 - 414 -001 thru -020; and 370 - 415 -001 thru -005 and -021
thru -024 from LMR Low Medium Density Residential to SP Specific Plan; and

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING ZONE CHANGE NO.
2013 -04, KNOWN AS THE CONSISTENCY ZONING PROJECT —
PHASE III, AMENDING THE OFFICIAL ZONING MAP, CHANGING
THE ZONING OF VARIOUS PARCELS IN THE EAST LAKE,
NORTH PEAK AND LAKE VIEW DISTRICTS OF THE CITY TO
ZONES CONSISTENT WITH THE GENERAL PLAN
DESIGNATIONS THEREIN.
WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on
December 13, 2011, which established designations on various properties throughout
the East Lake, North Peak and Lake View Districts of the City, as presented on the
General Plan Land Use Plan; and
WHEREAS, Government Code Section 65103 empowers the legislative body to
implement the General Plan through actions including, but not limited to, the
administration of zoning ordinances; and
WHEREAS, Government Code Section 65860 requires that a city's zoning
ordinances be consistent with its general plan; and
WHEREAS, Resolution No. 2004 -11 of the City of Lake Elsinore, which
establishes procedures and requirements for implementation of the Western Riverside
County Multiple Species Habitat Conservation Plan, specifically exempts the adoption
or amendment of any land use or zoning ordinance in Section IV — Exemptions; and
WHEREAS, on October 1, 2013 and December 3, 2013 at duly noticed public
hearings, the Planning Commission considered evidence presented by the Community
Development Department and other interested parties with respect to this item; and
made its recommendation in favor of Zone Change No. 2013 -04 by adopting Planning
Commission Resolution No. 2013 -74 recommending to the City Council approval of
Zone Change No. 2013 -04; and
WHEREAS, on December 10, 2013 at a duly noticed public hearing, the City
Council has considered the recommendation of the Planning Commission as well as
evidence presented by the Community Development Department and other interested
parties with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1, The City Council has reviewed and analyzed the proposed zone
changes pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §65000
et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and
finds and determines that the proposed zone changes are consistent with the

requirements of California Planning and Zoning Law and with the goals and policies of
the Lake Elsinore General Plan and the LEMC.
SECTION 2. Pursuant to Section 21080 (c) (2) of the California Environmental
Quality Act (CEQA), the City Council determines that the Recirculated Program
Environmental Impact Report certified for the update to the General Plan is adequate
and prepared in accordance with the requirements of CEQA which analyzes
environmental effects of the Project. Because Zone Change No. 2013 -04 implements
the General Plan with the appropriate zoning districts for development within the East
Lake, North Peak and Lake View Districts of the City, no additional environmental
review is required.
SECTION 3. That in accordance with the State Planning and Zoning Law, the
City Council hereby makes the following findings for the approval of Zone Change No.
2013 -04:
1. The proposed zone
changes
will not be a) detrimental

the

a. The proposed zone change implements the adopted General Plan
Update of December 13, 2011, which was analyzed relative to its
potential to have detrimental effects.
b. The proposed zone change will eliminate inconsistencies with the
adopted General Plan Update.
C. The proposed zone change will be beneficial to the public health,
safety, comfort and welfare and will improve the property in the
neighborhood and the City by allowing a variety of residential,
commercial, recreational, public /institutional and open space uses to
be established in the East Lake, North Peak and Lake View Districts
within the City.
2. The proposed zone changes will permit reasonable development of the area
consistent with its constraints and will make the area more compatible with
adjacent properties.
a. The proposed zone change utilizes high density residential projects as
transitional areas between single family residential and commercial
uses.
b. The proposed zone change takes into consideration existing, active
development as well as vacant properties.
3. The proposed
zone changes would implement a land use density,
intensity
and
usage more
in character
with
the subject
property's
location,
access,
and

constraints consistent with the adopted General Plan Update and subsequent
text amendments to the zoning code.
a. The proposed zone changes provide a distribution of active recreation,
public /institutional, and open space uses throughout the affected
Districts, and in close proximity to neighborhood residents.
b. The proposed zone changes provide the City a variety of residential
densities and housing types for its citizens.
4. The proposed zone changes implement the goals of the East Lake, North Peak
and Lake View Districts to integrate land uses, to preserve the open space and
recreational character of the City, to enhance pedestrian circulation, and to
ensure that new growth respects the environmental sensitivity of the natural
wetlands, floodway and floodplain.
a. Floodways are appropriately zoned in these Districts in accordance
with FEMA maps.
b. Public uses are appropriately zoned and identified.
C. Properties surrounding the amended North Peak Specific Plan are
zoned to be harmonious and sensitive to the existing land forms,
topography and vegetation.
d. The proposed zoning allows for a revitalized and healthy mixed -use
corridor along Riverside Drive in accordance with the primary goal of
the Lake View District.
5. The proposed zone changes will not have a significant effect on the
environment.
a. The potential impacts of the General Plan update have been analyzed
in the Recirculated Environmental Impact Report (SCH #2005121019)
prepared for the City of Lake Elsinore General Plan ( "General Plan
EIR') and its related cases which was certified on December 13, 2011,
and adequate mitigation measures have been prepared where
necessary. Accordingly, the impacts of the proposed zone change
have been disclosed, analyzed and mitigated to the extent feasible in
the General Plan EIR. A copy of the General Plan EIR is available for
inspection in the City of Lake Elsinore Community Development
Department, 130 S. Main Street, Lake Elsinore, CA.
SECTION 4. Based upon the evidence presented, both written and testimonial
and such other matters as reflected in the record, and the above findings, the City
Council hereby adopts Zone Change No. 2013 -04, making the following zone changes

SECTION 5. If any provision, clause, sentence or paragraph of this Ordinance or

carrying costs on the project and they are obligated to some investors and there
is interest pending on the property. Therefore, he would like to expedite the
project as soon as possible, and noted that the City has deposited their check.
Commissioner Morsch asked the applicant if they will revise the plans for the
frontage, parking and the driveway. Ms. Gottlieb agreed to revise and indicated
that this wouldn't be a problem.
Chairman Blake confirmed that any changes will be corrected with staff prior to
being submitted to City Council.
Planning Manager MacHott read into the record the new Condition of Approval
No. 9a in accordance with requirements of Section 17.148.100 from the Lake
Elsinore Municipal Code to read as follows:
9(a). In accordance with the requirements of Section 17.148.100 of the Lake
Elsinore Municipal Code, a 5 -foot wide landscape planter shall be
incorporated into the site design along the southern and eastern
property lines of project site. A revised site plan showing the
landscape planter shall be submitted to the Planning Division prior to

Commissioner Jordan requested landscaping plans with colored renderings to be
included with the design review projects, and also requested that all design
review projects be consistent. She also thanked staff for all of their hard work.
Commissioner Morsch welcomed Interim Public Works Director Eskandari
aboard, and looks forward to working with her. He also thanked all of the
volunteers that participated at the City's Community Garden on Sunday, and
noted that the Oktoberfest will be held at the Storm Stadium, on October 4
through October 6, 2013, and will hold many events.
Commissioner O'Neal welcomed Public Works Director Eskandari to the City.
He commented that it has been 12 months, and WYROC still hasn't paid $48,000
that is owed to the City, and has not paid the State Fees.
Vice Chairman Gray welcomed Public Works Director Eskandari to the City. He
asked what the status is of the Cultural Center rehabilitation. Planning Manager
MacHott stated that the Cultural Center retrofit is scheduled to be completed by
January 2014,
Chairman Blake requested an update regarding WYROC. City Attorney Leibold
updated the Commission regarding the status of WYROC.
ADJOURNMENT

Background
The City of Lake Elsinore adopted an update to its General Plan on December 13,
2011. On September 25, 2012, the City Council approved Phase I of the Consistency
Zoning Project, for all Commercial and Residential Mixed Use parcels, and all High
Density Residential parcels in the City. On April 23, 2013, the City Council approved
Phase II of the Consistency Zoning Project for the Business District.
Project Description
The City now proposes to undertake Phase III of the Consistency Zoning Project,
bringing the Official Zoning Map of the City into conformance with the adopted General
Plan for the East Lake, North Peak and Lake View Districts.
Discussion & Analysis
Notification and Community Meeting
On September 5, 2013, Staff mailed 609 notifications to property owners of the 632
parcels affected by this zone change. There were a handful of duplicative owners. The
notification invited property owners to attend a Community Meeting on September 18,
2013 at the Senior Center to meet Staff and hear about the Consistency Zoning Project,
to obtain detailed information on the zones proposed, and to voice their concerns and
ask questions. The notification /invitation letter is Attachment 4 to this Staff Report.
Subsequent to the mailing, Staff received approximately 20 phone and e-mail inquiries
and front counter visits. Approximately 25 people attended the Community Meeting, and
Staff addressed all questions that were asked.
Existing Apartment Buildings
Staff spoke with Charles Pearson, owner of the Walnut Grove Apartments on Joy
Street. At the Community Meeting, he indicated that he did not want the existing R -3
(High Density Residential) zoning changed on his already constructed and occupied
apartments. Staff agrees with Mr. Pearson and recommends that General Plan
Amendment No. 2013 -04 include changing the Land Use Designation on his property to
HDR (High Density Residential).
In a similar instance, Staff is recommending that the Lake View Apartments on
Riverside Drive retain its existing R -3 (High Density Residential) zoning, by changing
the General Plan Land Use Map to HDR instead of retaining the existing "General
Commercial' designation.
In both instances Staff believes that existing viable housing should be recognized and
supported as the highest and best use of property along Riverside Drive in the Lake
View District.

Northwest Portion of the Lake View District
Phase III covers three "cleanup" changes to the General Plan to recognize existing
residential subdivisions and their densities, existing zoning consistent with adjacent
properties, and property owned by the Riverside County Parks and Open Space District.
These changes are shown on Exhibit 'B.'
East Lake Specific Plan Boundaries
Phase III includes correcting the boundaries of the East Lake Specific Plan from that
shown on the General Plan Land Use Map that was adopted in 2011. The General Plan
incorrectly shows the developed residential area between Skylark Drive, Corydon,
Palomar and Union Streets as outside of the East Lake Specific Plan boundaries. This
amendment will correct this error and will change the "Low- Density Residential",
"Medium Density Residential" and "Recreation" land use designations of this property to
"Adopted Specific Plan."
Zone Change No. 2013 -03
The proposed zone changes to make zoning compatible with the General Plan
designations in the East Lake, North Peak and Lake View Districts are shown in five
exhibits, 'D' through 'H.' These exhibits indicate existing zoning, the General Plan
designation, and proposed zone change only. To view the entire Lake View District
proposed zones, please see the overall exhibit for Zoning Consistency Lake View
District. All color and enlarged 11 X 17 exhibits are provided as Attachment 3.
Environmental Determination
The City certified a Recirculated Program Environmental Impact Report (RP -EIR) for the
update to its General Plan. The proposed General Plan Amendment Nos. 2013 -03 and
2013 -04 and Zone Change No. 2013 -03 to the City's Official Zoning Map implements
the General Plan update, applying appropriate zoning districts compatible with their land
use designations. No additional environmental review is required.
Recommendation
Staff recommends that the Planning Commission take the following action:

The public hearing and my conversations with you at the hearing were informative.
As we discussed, when the Walnut Grove Apartments were built (approximately 23 years ago),
land must have been zoned R3 or equivalent. There are 63 units on 3.1 acres (approximately 20
units per acre). It should be zoned R3 to make the complex compliant with its zoning and I
assume the land we own adjacent to Walnut Grove for the last 25 plus years also has been R3
zoning or equivalent because when Walnut Grove Apartments was built, a sister project was
engineered to be built on our land adjacent to Walnut Grove Apartments but due to the economy
at that time, it was never built (we did not own Walnut Grove Apartments or the land at that
tune).
Our main concern at this time is APN 379131018 (Walnut Grove Apartments) being zoned as R3
to make its improvements compliant with zoning. APN 379131005, APN 379131006, APN
379131015 and APN 379131019 should be left as R3 zoning as it is presently zoned as shown on
the Zoning Consistency Plan. The reason we purchased the adjacent land was to allow us to
expand the size (number of units) of Walnut Grove Apartments in the future_ Based on previous
discussions regarding our adjacent land with the Planning Department approximately 3 -5 years
ago, Joy Street is a planned 24ane road with no major highway frontage and its building
improvements are mainly multi - family units and a school which makes our vacant land ideally
suited to be improved with more multi- family units. Because of many factors, its R3 zoning
would make it economically feasible to develop it in the future.

Background
On October 1, 2013, the Planning Commission unanimously approved Resolution No.
2013 -73, recommending approval of General Plan Amendment Nos. 2013 -03 and 2013-
04 (the GPA), cleanup amendments as part of the Consistency Zoning Project, Phase
III. Furthermore, the Commission unanimously approved Resolution No. 2013 -74,
recommending that the City Council adopt Zone Change No. 2013 -04 (the ZC) for the
same project.

Project Description
Staff recommends that the GPA add two existing apartment complexes on Grand
Avenue, north of Riverside Drive, in the effort to recognize and support existing viable
multiple - family housing as the highest and best use of property in this area of the Lake
View District. The Grand Oaks and Harbor Grand Apartments are recommended to be
changed from the "MDR Medium Density Residential' to "HDR High Density
Residential' designation, consistent with its existing zoning of "R -3 High Density
Residential."
Furthermore, Staff recommends that the GPA and ZC correct the General Plan
designation and zoning on property owned by the Elsinore Valley Municipal Water
District (EVMWD) on the north side of Riverside Drive between Lake Crest and Lincoln
Streets, from "MDR Medium Density Residential' and "R -3 High Density Residential'
respectively, to 'Public /Institutional' designation and zoning. The property contains an
active well site, and according to Paul Carver of EVMWD, they intend to use the well
site "for many years to come" and there are "no plans to sell nor allow development
near the well."
