MACHOTT, LEED GREEN ASSOCIATE PLANNING MANAGER DATE: DECEMBER 3, 2013 SUBJECT: GENERAL PLAN CONFORMITY DETERMINATION FOR PROPOSED SANTA ANA WATERSHED PROJECT AUTHORITY (SAWPA) INLAND EMPIRE BRINE LINE REACH V REPAIRS APPLICANT: SANTA ANA WATERSHED PROJECT AUTHORITY (SAWPA), 11615 STERLING AVENUE, RIVERSIDE, CA 92503 Proiect Request The Santa Ana Watershed Project Authority (SAWPA) has requested a General Plan Consistency Determination for their proposed relocation of a portion of its Brine Line (formerly known as the Santa Ana Regional Interceptor or SARI) within the City of Lake Elsinore. SAWPA intends to apply for a financing agreement from the State Revolving Fund Program and a General Plan Consistency Determination is one of the application requirements for that financing. Proiect Location That portion of the existing SAWPA Brine Line that is proposed for relocation consists of approximately 3,750 linear feet generally located along Pierce Street between Baker Street and Coal Avenue, along Coal Avenue between Pierce Street and Terra Cotta Road, and along Terra Cotta Road to Nichols Road. This segment of the Brine Line would be moved to a new location along Nichols Road (See attached Vicinity Map.) Proiect Description The Brine Line is a network of approximately 73 miles of pipeline located in Riverside and San Bernardino Counties to convey primarily high saline non - reclaimable PC December 3, 2013 Item No. 7 Page 1 of 3 PLANNING COMMISSION STAFF REPORT GENERAL PLAN CONFORMITY FOR BRINE LINE REPAIRS DECEMBER 3, 2013 wastewater to Orange County Sanitation District facilities in Huntington Beach. After treatment, it is discarded in the ocean. A brine line is necessary because industrial and commercial users are able to dispose only a limited amount of saline waste into wastewater plants due to the difficulty of removing salts and minerals from water. Users that produce a lot of saline waste can go through an application process to make a connection to the SARI line; the Santa Ana Watershed Protection Authority (SAWPA) establishes connection fees and monthly rates for using the SARI line. Businesses that do not generate a substantial flow and are not close enough to make a direct connection can haul the waste by truck to a SARI truck collection station. SAWPA has permit fees and fees based upon volume for indirect connection users. The proposed relocation reflects the preferred alternative considered as a potential settlement to any outstanding legal issues between SAWPA and Castle and Cook. This option would remove the existing 30 -inch pipeline from the area where Castle and Cook plans to develop the area and will construct the line along the recently completed section of Nichols Road. Analysis The current alignment of the Brine Line in the project area traverses an area with Limited Industrial, Residential Mixed -Use, Low - Medium Density Residential and Adopted Specific Plan (Alberhill Ranch SP — Commercial with Multi- family Option) general plan land use designations. (See attached Land Use Designations Map.) The proposed alignment of the affected 3,750 linear feet would principally be located adjacent to Nichols Road and traverses areas with Limited Industrial, Residential Mixed Use and Adopted Specific Plan (Alberhill Ranch SP — Commercial with Multi- family Option) general plan land use designations. Additionally, Section 3.3.2 in Chapter 3.0 (Public Safety and Welfare) of the Lake Elsinore General Plan provides background regarding the Santa Ana Regional Interceptor and General Plan Policy 3.5 requires the City to: "Evaluate new development on or adjacent to the Santa Ana Regional Interceptor (SARI) line requiring extensive subsurface components or containing sensitive land uses such as schools on a project -by- project basis to determine impacts if an accident occurs." As set forth in Section 3.3.2, the Brine Line "is necessary because industrial and commercial users are able to dispose only a limited amount of saline waste into wastewater plants due to the difficulty of removing salts and minerals from water. The City's General Plan recognizes the importance of the Brine Line in serving existing and future industrial and commercial users. The proposed realignment will traverse areas with general plan land use designations that are also traversed by the existing alignment in the project area. Therefore, it can be determined that the proposed realignment is consistent with the City's General Plan. Recommendation It is recommended that the Planning Commission make the finding that SAWPA's proposed Inland Empire Brine Line Reach V Repairs is consistent with the City of Lake Elsinore General Plan.
