Council of the City of Elsinore was held on the above date. The meeting was called to order at the hour of 7:30 P.M, with Mayor / Tarpley in the chair. Councilman; Samuel Farber, Fred Pecrod, J. J. Tavis, T.R. Yarborough and Mayor Tarpley answer roll call. Thereupon the clerk read the minutes of the regular meeting held May 23, 1949, and were approved as read. Thereupon the clerk read letters from Senator Dillworth and Assemblyman Babbage in answer to letters written by the City in regards to help on the Lake Park District, these letters stating they would do all in their power to help get the lake question settled. Letters ordered Filed. Thereupon the Clerk read a referendum petition signed b~= approximately 139 legal registered voters for the City Council either to repeal Ordinance No. 315 (sales tax) or call an election on said matters. Mr. Ganaull, Attorney for the petitioners at this time asked for the floor and asked that the City Council do put this matter before the voters of the City and let there decide as to whether they wanted a`sales tax in Elsinore or not. He also stat- ed that he was ai~rare of the fact that under the State laws the City Council could reject the petition as recommended. by City Attorney Best and deputy City Attorney Gediman of the City of Elsinore. Attorney Ganaull answered different questions put to him by menbers of the Council and said that if the Council did reject this petit- ion an initiative petition might be circulated and if it got the required signatures that would have to go to an election. Beputy City Attorney Gediman spoke on the matter and again recommended the re- jection of the petition as the Council was undere their full rights in doing so. Councilman Yarborogh spoke on the subject telling, those present the various needs of improvement that could be made thoughout the City with the funds required by the sales tax. ~ Whereupon it was moved by Councilma., Farber, seconded by Councilman Penrod that tie City Council reject the referendum Petition for the repeal or calling an election on Ordinance No. 315, Sales Tax Ordinance, which motion was carried by the following vote. Kellogg protested in regards to the fee charged for garbage and waste matter disposal, he being the only. protestant, no action was taken. T+Ir. Puller and Mr. Hastings o£ the Riverside County Health Dept. were present and spoke on the questions of the Lake; Lake gnats, Park District, stating that they were getting fine cooperation from the City Council in all matters that had come up as to health problems. Esplained the yearly agreement the city had with the County for Health service within the City on City Ordinances. He also answered questions asked by persons present. Page #2. Whereupon it was moved by Counci].~nan Yarborough seconded by Councilman Farber that resolution No. 568 be passed and adopted as read, ,which motion was carried by the following vote. Councilman Farber Yes ~~ Penrod Yes n Tavis Yes Noes None ~~ N`ay°r Yarborough Yes Tarpley Yes Absent None Mr. Holmes Chairman of the Elsinore Park district was called on at this time and he stated that they had confidence that they were going to get something done about the Lake, possible having three camp grounds one on the South side, North side and on the City O~+med beach if a deal could be made with the City. There also was a possibility that a dam would built with a highway on top, this keeping lake at a certain level. Asked that a meeting of the Park Boark and City Council be called to make plans and discuss the lake problems of both the City and Park District. Whereupon it was moved by Councilman Tavis seconded by Councilman Yarborough that June 20th at 5:00 p.m. be set as the time for this meeting of the Council and Park Board, which motion upon vote was carried. Councilman Farber -Yes ~~ Penrod Yes ~~ Tavis Yes Noes None ~~ Yarborough Yes liayor Tarpley Yes Absent None Thereupon the Clerk read a letter from the State Department of Public Health, in reference to the permit to be issued to the City for the proposed sewer disposal plant for which bonds had been sold. Also received a notice of publication to be published two times in the local paper, which was to be published June 16th and 23rd. Clerk instructed to take care of this matter. Rev. L^7ebb again asked the Council for a little help to build a tennis court at North Park, enough funds had been donated for the wire wetting but the heavy equipment would have to do about three hours of grading. Whereupon it was moved b y Councilman Penrod .seconded by Councilman Farber, that Dean Fletcher be anployed with equipment to do .this grading at a cost of Approximately `~p`20.00, which motion upon vote was carried . Beach asked if the City had a curfew law and if so why wa nit it enforced as school being out the children were quite a problem, was informed by the Council that the police were trying to inforce the presenty City curfew ordinance and a new ordinance was being passed within the next month that would take care of this matter to everybody~s satisfaction. Coach Williams of the High School spoke oh the need of a summer recreation. program for the young people so as to keep them o£f the streets. The Legion was to have a summer ball team but it had been started°`too ffiate, so that was out. Thereupon the-clerk read resolution No. 569, a resolution employing Leonard ''. Cole as a regular employee of the City water and Street.. Department and setting I his salary I Whereupon it was moved by Councilman Yarborough seconded by Coundi]man Tavis that Resolution No. 569 be passed and adopted as read, w~nich motion was carried by the following Vote. Councilman Farber Yes Penrod Yes Noes None " Tavis Yes Yarborough Yes Absent None Mayor Tarpley Yes Councilman Yarborough Street Commissioner reported that Street Improvement Mork was going on and the started jobs progessin, but stated that on part of the work the men were loading and though this was not fair to the tax payers. Mr. DiGiacomo reported that some of the men had been laid off and that cerbtin vrork was to be done by equipma~t instead of hand labor. Mr. Phillips who had nought the Patterson lease on the City Beach asked that he be granted some kind of a lease as at present he had nothing and would like to keep his equipment stored there. Counci.JJnan Farber Park Commissioner suggest that he be given a lease on a monthly basis, Mr. Phillips to pay $$.00 per month. Whereupon it was moved by Councilman Farber seconded by Councilman Tavis that Mr. Phillips be granted a lease on a monthly basis, but not to be signed until after the meeting with the Park Board on June 20th, 1949, Phillips to pay X5.00 per month which motion was carried by the following vote. Barber be allowed to take his vacation at this time. Barber be given two weeks. vacation starting June 13th, 1949, which motion upon- wte was carried. Thereupon the Clerk read resolutioh No. 571, a resolution appointing Val Thrithart as a regular assistant to the City water and license clerk and setting his salary. 6+Ihereupon ifi was moved by Councilman Yarborough seconded by Councilman Penrod that resolution No. 571 be passed and adopted as read, which motion was carried by the folloil2ng wte. R.LEgay Co. Union Oil Dealer £or the installation o£ an electric gas pump at tYk: City yard, which motion upon vote was carried. Thereupon the clerk read a request of the General Petroleum Corporation that the lease on the water well and and they be canceled. Whereupon it was moved by Councilman Tavis seconded by Councilman Yarboroup~ that said lease be cancelled as the well was of no use to the City, which moticn upon wte was carried. Thereupon the Clerk reed ordinance No. 317 for its First reading on Ordinance pro$i.ding for issuing of permits and fixing the amount for sewer connections. Whereupon it was moved by Councilman Yarborough, seconded by Councilman Farber that Ordinance No. 317, be passed to its second reading, which motion was carried by the following vote. MEETING HELD ON THE June 13, 1949 DAY OF Z9 ~ during the months of July and August 1949, which motion upon vote was carried. With the consent of the members of the Council Mayor Tarpley appointed III Samuel Farber to act in his stead during his absence.. ' Fire Chief Brady asked the Council for a free permit to operate a refreshment ~ stand during the July Fourth holidays on .the Stokes lease on the City Beach. Whereupon it was moved by Councilman Tsvis seconded 6y Councilman Yarborough that the request of the Fire Chiefi be granted, which motion upon vote bras carried. Whereupon it was moved by Councilman Farber seconded by Councilman Yarborough that Mr. Robert Thompson be employed to clean up the City Beach, at the rate o£ X1.00 per hour and cost not to exceed $~150.U0, which motion upon vote was carried. Whereupon it was moved by Councilman Yarhorough, seconded by Councilman Farber, that the report of the City water and license clerk be accepted as read and ordered filed, which motion upon vote was carried. Whereupon it was moved b;• Councilman Farber seconded by Counci]man Penrod that the report of the City Treasurer and City Clerk be accepted as audited by the auditing Committee and ordered filed, which motion upon vote was carried. Whereupon it was moved by Councilman Tavis, seconded by Councilman Yarborough that the bills be allowed as audited by auditing committee and clerk instructed to issue warrants for same, which motion upon vote was carried. Whereupon it was moved by Councilman Yarborough seconded by Councilman Tavis that the meeting adjourn to meet again on Monday June 2q, 1949 at the regular time abd place, which motion upon vote ?aas carried. ` a5ro C rk
