MEETZIYG HELD OH THE 14th DRY OF March 19 49
A regular meeting of the City Council of the City of Elsinore was held on
the above date. The meeting was called to order at the hour of 7:30P.M, with Mayor
Tarpley in the chair.
Councilmen: T. J. Hudson, Fred Penrod, J. J. Tavis, T. R. Yarborough and
Mayor Tarpley answered roll call.
Thereupon the Clerk read the minutes of the February 2bth meeting, also the
minutes of the Special Pleeting called £or canvassing the election, and there being no
errors or ommissions were approved as read.
CALENDAR No. l.L,
This being the time and place for the public hearing on the proposed amend-
ment of Ordinance No, 236 of the City of Elsinore, the City Clerk reported that notice
of said hearing has been published in the Elsinore Leader-Press once within the week
of the date set For the hearing.
All those present in favor of and against the proposed amendment were heard
by the Council,
~ '~~ereupon it was moved by Councilman ?Pudson, seconded by Councilman
Yarborough, that ali protests and objections thereto be overruled, and that the public
interest required the amendment o£ Ordinance No. 236 as follows:
To provide for a new subsection to be added to Section 1 of said Ordinance,
to be known as "Subsection R3A", reading as follows:
Subsection R3A: The following described portion of the City
of Elsinore shall be included urithin Zone R3A:
IgtS 7 to 11, both inclusive, in Block "E", and
Lots 24 to_'29, both inclusive, in Block °F" of
Jones Addition to Elsinore.
And to provide for the amendment of Subsection R3 by addition there-
to of the following paragraph:
Excepting therefrom the Following described property, to wit:
Lots '] to 11, both inclusive, in Block "E", and
Lots 24 to 29, both inclusive, in Block "F" of
Jones Addition to Elsinore.
And further to provide for a new section to be added to said Ordinance
No. 236 to be numbered 6~, and to read as follows:
Section 6;: In residential districts of Zone R3A no building,
structure or premises shall be erected, constructed, altered
or maintained, except as provided in Section 17, which shall
be used or designed for any purpose other than a use per-
mitted in Zones R1 or Zones R3, or for a parking lot, or for
retail sales in connection with other uses which are herein-
above specifically permitted in said 'Lone,

This being the time and place for the public hearing on the proposed amend-
ment of Ordinance No, 236 of the City of Elsinore, the City Cleric reported that notice
of said hearing had been published in the Elsinore Leader-Press once within the week
of the date set for the hearing.

by the Council.
~rJhereupon it was moved by Councilman Tavis, seconded by Councilman
Yarborough, that all protests and objections thereto be overruled, and that the public
interest required the amendment of Ordinance No. 236 as follows:
To provide for the amendment of Subsection B1 of Section 1 of said Ordinance
by the addition thereto of the following paragraph, to wit:
Together with all of Blocks 51, 56, and all of Block 22
except the Southerly 165 feet thereof; the Easterly 150 feet
o£ Block 57 excepting the Northerly 180 feet thereof; and
the Easterly 150 feet of Block 23 excepting the Southerly
165 feet thereof, all in the City of Elsinore.
To ilzrther provide for the amendment of Subsection R3 of Section 1 of said
Ordinance No. 236, bsr the addition of the follo~r.*ing paragraph:
Excepting therefrom such portion of the fallowing described
property as is now included in Zone R3, to wit:
A11 of Blocks 51, 56 and all of Block 2?_ except the Southerly
165 £eet thereof; the Easterly 150 feet of Block 57 excepting the .
Northerl;,> 180 feet thereof; and the Easterly 150 feet of Block 23
excepting the Southerly 165 £eet thereof, all in the City of Elsinore.
To provide £or the further amendment of Subsection B2 of Section 1 of
Ordinance No, 236, b~~ the addition thereto of the Following paragraph:
Excepting therefrom such portion of the following described
property as is now included in Zone B2, to wit:
All of Blocks 51, 56 and all of Block 22 except the Southerly
165 feet thereof; the Easterly 150 Feet of Block 57 excepting the
Northerly 180 feet thereof; and the Easterly- 150 feet of Block 23
excepting the Southerly lb5 feet thereof, all in the City of Elsinore.

Thereupon the clerk read Ordinance No, 309 for its first reading, an
Ordinance amending Ordnance ISo. 236, rezoning part of East Graham Avenue,
'nihereuoon it ~.aas moved by Councilman Yarborough, second-ed by Councilman
Hudson that Ordinance Ido, 309 be passed to its second reading ~,ahich motion was carried

Thereupon the Clerk read Ordinance No. 310, an Ordinance anending Ordinance
ATO. 236 of the City of Elsinore, rezoning property bounded by Spring Street, Craham
Avenue, Biley Street, and Pottery Street.
l~Ihereupon it was moved by Councilman Yarborough, seconded by Councilman
Tavis that Ordinance No. 310 be passed to its second reading, which motion was carried
by the following, vote:

Mr. H. H. Stewart being present stated to the City Council that he could
only pay u10.00 monthly for the City garbage and ~•ranted at least a years'contract.
Councilman Yarborough in charge of this department imformed him that he would let him
know in a few days as to letting same for a years' contract.
Councilman Tavis, Park Commissioner reported that the Arbor Day program at
the City Park was a success and a good many trees, sh'rub's, and plants were planted.
Armstrong's Nursery having donated two hundred roses in addition to what was bought
from Yungs Nursery. A ouantity of these Caere turned over to the Pdorth Park in charge
of Councilman Yarborough who had attended to the planting there. Also reported that
no water was available at the North Park where the planting had been done, and to get
water a tyro-hundred foot line would have to be laid.
i~lhereupon it was moved by Councilman Yarborough, seconded by Councilman
Hudson, that Mr, Harmon, Maintenance Superintendent, be authorized to install a water
line so that these plants could be watered, which motion upon vote was carried.
Thereupon the Clerk read the applications of Mr. Loback a_nd Mr. $urch for
position o£ Chief of Police for the City of Elsinore. Councilman Hudson, Police
Commissioner reconunending I~.r. Loback for said position. Councilman Yarborough sugg
that rTr. Bittle, a patrolman on tkie Force be promoted to the rank o.f Chie£, this
suggestion being backed by Councilmen Penrod- and Tavis.
Plhereupon Councilman Hudson made a motion that Ivlr. Loback be appointed Chief
of Police, which motion Failed for lack of a second.

tiwhereupon Councilman Hudson made a motion that Mr. Burch be appointed Chief
of Police, which motion failed for lack of a second.
Whereupon it was moved by Coupcilmau Tavis, Seconded by Councilman
Yarborough, that Patrolman 'rdalter C: Bittle be appointed as Ctiief of Police of the
City of lsinore, c~ciich motion was carried by the following vote:

whereupon it was moved by Councilman Yarborough, seconded by Councilman
Tavis that Nir. Robert Copeland be appointed as a regular patrolman unless otherwise
objectable by new Chief of Police, which motion was carried by the following voter

Mr. Burch,an applicant for the Chief's position was called on and he stated
that if there was a vacancy he would be willing to zwork as a patrolman as he had not
been specially after the Chief's position, but could have qualified if appointed.
Dr. ~:destphal, County Health Officer, being present was called on and he
complimented the City Council for their coroperation with the health department in
carrying out the suggestion of the health departments ;n regard to sewer disposal
plant and other improvements. He also answered a number o£ questions asked b~* t'rbse
present.
Mr. Smith and others asked the Council again as to what was being done to
get sewer connections for their property. P~Ir. Crane, City &ngineer, answered the .
question by stating that they could pay the City for this improvement or the City
could form sanitary districts and have it done that way.
;whereupon it was moved by Councilman Penrod, seconded by Councilman Hudson
that the City Clerk have the City Attorney draw up the proper forms for commencing
the proceeding of Sanitary Districts where needed, which motion was carried by the
following vote:

Mr. Eyre,a local contractor, made a complaint that all persons in the same
business as he ware not paying a City License. ,~1as unformed by Councilman Hudson,
Police Commissioner, that this matter wou]_d be taken care of.
STr. Auerback asked the Council regarding a sign he wishes to install and
had been refused a permit. Builaing Inspector DiGiacomo unformed him that the type
he wanted ti~ras illegal and some changes should be made in the present Ordinance.

Council reouested him to draw up changes as he thought best and present to the Council
for approval.
T hereupon the Clerk reported the following recomendations of the Planning
Commission to the Council:
That the request of the High School for the closing of Silver Street be
granted at such a time when they were actually starting work on their im-
provements. That Mr. John Di Giacomo be asked to help in drawing up a map
for the proposed new zoning ordinance,
Whereupon it was moved by Councilman Penrod, seconded by Councilman Tavis,
that the matter of the closing of Silver Street as requested by the High School be
tabled, which motion upon vote caas carried.
Whereupon it was moved by Councilman Hudson, seconded by Councilman
Yarborough, that 24r. John Di Giacomo be instructed to draw up a map for the proposed
zoning ordinance if it could be done without taking up too much of his time as
inspector, which motion upon vote was carried,
Thereupon the Clerk read Ord-finance No. 308 for its second reading, an
Ordinance for a garbage and waste-matter collection fee and the collection of same.

that Ordinance No. 308 be passed and adopted as read and clerk instructed to have
same published once in the Elsinore Leader Press, which motion was carried by the
following vote:

Thereupon the Clerk read Ordinance IQo. 311 for its first reading, an
Ordinance amending Ordinance No. 282, making Peck Street from Spring Street to the
alley East o£ Main Street, a tiro-hour parking zone.
t~Jhereupon it was moved by Councilman Yarborough, seconded by Councilman
Hudson, that Ordinance P7o. 311 be passed to its second reading, which motion upon vote
was carried.
Mayor Tarpley imformed the Council that the Seven Day Adventist Church w
to put up a banner accross East Graham just Eadt of Main Street and as the members
of the Council vranted to know what wording was to be on said banner Mayor Tarpley
appointed Councilman Penrod and himself to investigate same.
James Truiett of the City Garbage Department imformed the Council that he
could not keep up with the work during this cleanup month and asked for an extra hel
for the balance of this month of March, which was grarrted. He to get a Mr. Lewis to
help out.
Mr. Truiett also reported that the City dwnp needed to be worked on with the
dozer and reported some streets in need of grading.

i^>hereupon it was _aoved by Councilman Yarborough, seconded by Councilman
Tavis, that Councilman Yarborough, Street Commissioner, be authorized to employ Joe
Alflen to operate the Motor grader on what work was needed, which motion upon vote
was carried,
Whereupon it was moved by Councilman Tavis, seconded by Councilman
Yarborough, that the bills be allowed as audited by the auditing Committee and the
Clerk instructed to issue warrants for same, :which motion upon vote was carried.
ijrhereupon it was moved by Councilman Hudson, seconded by Councilman Penrod,
that the City Treasurer and City Clerks report be accepted as audited by the Audit-
ing Committee and ordered filed, which motion upon vote was carried.
Whereupon it was moved by Councilman Yarborough, seconded by Councilman
Penrod, that the report of the City water and License clerk be accepted as read and
ordered filed, which motion upon vote was carried.
~Riereupon it was moved by Councilman Yarborough, seconded by Councilman
Hudson, that the meeting adjourn to meet again on Monday, March 28th, 191+9, at the
regular time and place, which motion upon vote was carried,
