HomeMy WebLinkAbout10-19-1959 City Council Minutes9~ COUNCIL MEETING OCTOBER 19, 1959 The City Council of the City of Elsinrre met in regular session on October 19, 1-959, and was called to order at 7:30 P,P4, v.*ith Mayor Bartlett presiding. Invocation was delivered by Rev. Easter, and the Pledge of yllegiance was led by Councilman Davidson. Roll call found all five councilmen present. The minutes of October 12, and the Planning Commission minutes of October 15, were approved and ordered filed.. Communications read were from Bertha & Jack Feinstein, Ben Miller and Mrs. Rose Bell supporting the sulphur water, Board of Supervisors _ resolution on mosquito abatement, which was tabled to next meeting on motion Councilman Yarborough, seconded Councilman Davidson, carried, The State Board of Public Health. Letter of Oct. 13 was read, to which Mayor Bartlett replyed that he had written to Dr. Merrill, requesting a complete transcript of the hearing held in Los Angeles on Oct. 9. On motion Councilman Lavidson, seconded Councilman Yarbcrough, the City Attorney was instructed t.o take the necessary steps to keep this alive. Request of Miriam Fischer to have the sideoaalk repaired on Ellis St. was referred to Councilman McAdams. Dr. Stallings request for clarification on the consent of the Council to purchase water and cups for the students ten & under was discussed with the following motion by Councilman Macy, seconded Councilman Davidson, carried, that the City purchase bottled water, cups and coolers for the exclusive use of students ten years of age and under, with a three month time-limit on this motion, renewable at end of throe month period. Councilman McAdams then addressed _~'lttorney Kegley as to the valic~ty of the action of the Council in not abiding by the letters received from the Board of Health. Attorney Kegley stated that the action being taken was net in defiance, that community Facing bankruptcy, and people have rights, & should token: advantage of them, Councilman Yarborough expressed his wish to see First things done first. Council should take steps to establish otm. wells to offset the need to use E.V.M,41, Would be quite a problem to run a loop line through town to motels ~ hotels to service them with mineral water. First consideration is to comply with State Law. s NIax Berg, Pres. of Property Owners Asso. read a report and then presented petitions favoring mineral water, signed v.*ith 568 signatures to the Mayor, who in turn filed them *.,ri.th the City Clerk. Stated that at next meeting, more petitions would be filed. The request of the P.T,A, to hold a bingo game at their Halloween Carnival, was granted en moticn Councilman Davidson, seconded Counci_lmar. Yarborough. Or. motion Councilman Macy, seconded Ccunci]man NidAdams, the Clerk's & ^l re asure nos reports for Sept. were accepted and ordered filed. Some question having arose, on the hi.ri.ng of J~snes Alspaugh, the following motion by Counci]man Davidson, seconded. by Councilman Yarborough, was passed: That the record show that at the time, July 20, 1959, wren motgp,- was made to hire expert opinion regarding quantity and quality of mineral' water, the person who was intended to be P:ired, and who was hired and who served thereafter, was James ellspach, Passed on the following roll call vote: Ayes: Davidson, Yarborough, Bartlett Noes: Ntacy, McAdams.
