HomeMy WebLinkAboutRDA Reso No 2009-07 RESOLUTION NO. 2009- 07 Fill RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING THE ACQUISITION BY THE AGENCY OF CERTAIN TAX-DEFAULTED REAL PROPERTIES AND AUTHORIZING THE EXPENDITURE OF AGENCY FUNDS FOR SUCH PURPOSE WHEREAS, on February 26, 2008, the City Council of the City of Lake Elsinore approved Resolution No. 2008-38 objecting to the sale of certain tax-defaulted properties in the City; applying to the County Board of Supervisors, County Tax Collector and Treasurer, and State Controller to purchase the tax-defaulted properties; and authorizing and directing the City Manager to execute the Purchase Tax-Defaulted Property Agreement; and WHEREAS, since, February 2008, the City Council and Redevelopment Agency have continued to evaluate which properties are suitable for acquisition by the City or the Agency for public purposes; and WHEREAS, in accordance with Resolution No. 2008-38, the City Manager executed the Purchase Tax-Defaulted Property Agreement on February 3, 2009 (the "Agreement") identifying 12 parcels for acquisition for a total purchase price of $110,462.32; and WHEREAS, of the 12 properties, 2 are being acquired by the City for right-of-way Fill purposes, 2 are being acquired by the Redevelopment Agency for downtown public parking, and 8 are being acquired by the Redevelopment Agency for low and moderate income housing; and j WHEREAS, in order to fulfill the purpose and intent of the acquisition of these properties, the Agency desires to formally approve the expenditure of Agency funds for such purposes. NOW, THEREFORE, the Redevelopment Agency of the City of Lake Elsinore does hereby resolve, determine, and order as follows: SECTION 1. The Agency hereby approves the expenditure of not to exceed $106,725.85 for the purchase of 10 tax-defaulted properties which sum includes the expenditure of $58,123.23 of unencumbered funds from the Agency's Low and Moderate Income Housing Fund (LMIHF) for affordable housing purposes, $47,887.62 of unencumbered funds from the Agency's Rancho Laguna Redevelopment Project Area No. I for downtown public parking, and an amount not to exceed $715 to pay for administrative expenses (including filing public notices) to be prorated between the Agency accounts funding the acquisition. The Executive Director, or his designee, is hereby authorized and directed to take all necessary and desirable steps to effectuate the Agreement to Purchase Tax Defaulted Property and to fund the acquisition by the Agency of the properties consistent with this Resolution for and on behalf of the Redevelopment Agency of the City of Lake Elsinore.
