HomeMy WebLinkAboutCC Reso No 2009-06 n n n RESOLUTION NO. 2009-06 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, IN SUPPORT OF AN EXEMPTION TO THE CONSUMER PRODUCT SAFETY IMPROVEMENT ACT FOR THE OFF- HIGHWAY VEHICLE INDUSTRY WHEREAS, the Consumer Product Safety Improvement Act (CPSIA) was signed into law on August 14, 2008 with the goal of protecting children from harmful substances, and WHEREAS, Section 101 (a) of this law requires that all children's products meet new, stringent lead standards which have been determined to apply to existing inventories, and WHEREAS, the CPSIA has significantly affected the off-highway vehicle industry, and WHEREAS, the Consumer Product Safety Commission (CPSC) has interpreted the CPSIA to apply to engines, brakes, wheels,. tires and suspension parts on off- highway vehicles, and WHEREAS, because of this interpretation, the parts must be tested and meet the lead standards since children six years of age or older may be exposed to lead, and WHEREAS, the law allows for exclusions for inaccessible components and authorizes the CPSC to grant exemptions, and WHEREAS, to date, the CPSC has not granted exemptions for the off-highway vehicle industry, and WHEREAS, this has caused economic hardships due to huge inventories of products which present no health risks to children to be rendered illegal for sale, and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, COUNTY OF RIVERSIDE, STATE OF CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the City Council supports exemptions by the Consumer Protection Safety Commission of certain sections of the Consumer Product Safety Improvement Act as it relates to inaccessible components of off-highway vehicles that may contain lead, SECTION 2. That the City Council has determined the lack of an exemption by the Consumer Product Safety Commission for the inaccessible n In D CITY COUNCIL RESOLUTION NO. 2009-06 Page 2 of3 components of off-highway vehicles that may contain lead has created an economic hardship for the off-highway industry, SECTION 3. This Resolution shall take effect from and after the date of its passage and adoption.
