PC October 1, 2013 Item No. 4 Page 1 of 30 PLANNING COMMISSION STAFF REPORT CONSISTENCY ZONING, PHASE III: GPA 2013 -03 & -04, ZC 2013 -03 October 1, 2013 Page 2 of 4 Background The City of Lake Elsinore adopted an update to its General Plan on December 13, 2011. On September 25, 2012, the City Council approved Phase I of the Consistency Zoning Project, for all Commercial and Residential Mixed Use parcels, and all High Density Residential parcels in the City. On April 23, 2013, the City Council approved Phase II of the Consistency Zoning Project for the Business District. Proiect Description The City now proposes to undertake Phase III of the Consistency Zoning Project, bringing the Official Zoning Map of the City into conformance with the adopted General Plan for the East Lake, North Peak and Lake View Districts. Discussion & Analysis Notification and Community Meeting On September 5, 2013, Staff mailed 609 notifications to property owners of the 632 parcels affected by this zone change. There were a handful of duplicative owners. The notification invited property owners to attend a Community Meeting on September 18, 2013 at the Senior Center to meet Staff and hear about the Consistency Zoning Project, to obtain detailed information on the zones proposed, and to voice their concerns and ask questions. The notification /invitation letter is Attachment 4 to this Staff Report. Subsequent to the mailing, Staff received approximately 20 phone and e-mail inquiries and front counter visits. Approximately 25 people attended the Community Meeting, and Staff addressed all questions that were asked. Existing Apartment Buildings Staff spoke with Charles Pearson, owner of the Walnut Grove Apartments on Joy Street. At the Community Meeting, he indicated that he did not want the existing R -3 (High Density Residential) zoning changed on his already constructed and occupied apartments. Staff agrees with Mr. Pearson and recommends that General Plan Amendment No. 2013 -04 include changing the Land Use Designation on his property to HDR (High Density Residential). In a similar instance, Staff is recommending that the Lake View Apartments on Riverside Drive retain its existing R -3 (High Density Residential) zoning, by changing the General Plan Land Use Map to HDR instead of retaining the existing "General Commercial" designation. In both instances Staff believes that existing viable housing should be recognized and supported as the highest and best use of property along Riverside Drive in the Lake View District. PC October 1, 2013 Item No. 4 Page 2 of 30 PLANNING COMMISSION STAFF REPORT CONSISTENCY ZONING, PHASE III: GPA 2013 -03 & -04, ZC 2013 -03 October 1, 2013 Page 3 of 4 Northwest Portion of the Lake View District Phase III covers three "cleanup" changes to the General Plan to recognize existing residential subdivisions and their densities, existing zoning consistent with adjacent properties, and property owned by the Riverside County Parks and Open Space District. These changes are shown on Exhibit `B.' East Lake Specific Plan Boundaries Phase III includes correcting the boundaries of the East Lake Specific Plan from that shown on the General Plan Land Use Map that was adopted in 2011. The General Plan incorrectly shows the developed residential area between Skylark Drive, Corydon, Palomar and Union Streets as outside of the East Lake Specific Plan boundaries. This amendment will correct this error and will change the "Low- Density Residential ", "Medium Density Residential" and "Recreation" land use designations of this property to "Adopted Specific Plan." Zone Change No. 2013 -03 The proposed zone changes to make zoning compatible with the General Plan designations in the East Lake, North Peak and Lake View Districts are shown in five exhibits, 'D' through 'H.' These exhibits indicate existing zoning, the General Plan designation, and proposed zone change only. To view the entire Lake View District proposed zones, please see the overall exhibit for Zoning Consistency Lake View District. All color and enlarged 11 X 17 exhibits are provided as Attachment 3. Environmental Determination The City certified a Recirculated Program Environmental Impact Report (RP -EIR) for the update to its General Plan. The proposed General Plan Amendment Nos. 2013 -03 and 2013 -04 and Zone Change No. 2013 -03 to the City's Official Zoning Map implements the General Plan update, applying appropriate zoning districts compatible with their land use designations. No additional environmental review is required. Recommendation Staff recommends that the Planning Commission take the following action: 1. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has reviewed and analyzed the proposed General Plan Amendments pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §§ 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed General Plan Amendments are consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. SECTION 2. That in accordance with the California Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission hereby makes the PC October 1, 2013 Item No. 4 Page 5 of 30 PLANNING COMMISSION RESOLUTION NO. 2013 - Page 2 of 4 following findings for the approval of General Plan Amendment Nos. 2013 -03 and 2013- 04: 1. The proposed General Plan Amendments will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed General Plan Amendments have been analyzed relative to its potential to have detrimental effects to ensure that the health, safety and welfare of surrounding residents will be protected. b. The proposed General Plan Amendments recognizes viable existing development within the Lake View District, and promotes their continued use. 2. The proposed General Plan Amendments will permit reasonable development of the area consistent with constraints and will make the areas affected more compatible with adjacent properties. 3. The proposed General Plan Amendments would establish land use densities, intensities and usage more in character with the subject properties' location, access, and constraints. a. The proposed General Plan Amendments recognize residential land use densities that are compatible with surrounding development. 4. The proposed General Plan Amendments will not have a significant effect on the environment. a. The proposed General Plan Amendments identify open space and recreational uses and ownerships, and support such uses in the General Plan. SECTION 3. Based upon the evidence presented, both written and testimonial, and the above findings, the Planning Commission hereby recommends approval of General Plan Amendment Nos. 2013 -03 and 2013 -04, and incorporating these amendments into the General Plan as shown on Exhibits `A` thru `C` attached herein. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has reviewed and analyzed the proposed zone changes pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and finds and determines that the proposed zone changes are consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal Code. SECTION 2. Pursuant to Section 21080 (c) (2) of the California Environmental Quality Act (CEQA), the City Council determines that the Recirculated Program Environmental Impact Report certified for the update to the General Plan is adequate PC October 1, 2013 Item No. 4 Page 12 of 30 PLANNING COMMISSION RESOLUTION NO. 2013 - PAGE 2 of 7 and prepared in accordance with the requirements of CEQA which analyzes environmental effects of the Project. Because Zone Change No. 2013 -01 implements the General Plan with the appropriate zoning districts for development within the East Lake, Lake View and North Peak Districts of the City, no additional environmental review is required. SECTION 3. That in accordance with the State Planning and Zoning Law, the Planning Commission hereby makes the following findings for the approval of Zone Change No. 2013 -03: The proposed zone changes will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed zone changes or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed zone change implements the General Plan adopted December 13, 2011; which was analyzed relative to its potential to have detrimental effects. b. The proposed zone change will eliminate inconsistencies with the adopted General Plan Update. C. The proposed zone change will be beneficial to the public health, safety, comfort and welfare and will improve the property in the neighborhood and the City by allowing a variety of commercial, public /institutional, and residential uses to be established in the East Lake, Lake View and North Peak Districts within the City. 2. The proposed zone change will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. a. The proposed zone change recognizes properties set aside for open space, owned and managed by Riverside County agencies. b. The proposed zone change utilizes R -2 (Medium Density Residential) and R -3 (High Density Residential) zoning as transitional areas between commercial uses and single family residential neighborhoods. 3. The proposed zone changes would implement a land use density, intensity and usage more in character with the subject property's location, access, and constraints consistent with the adopted General Plan and subsequent text amendments to the zoning code. a. The proposed zone change takes into consideration existing development as well as vacant properties. 4. The proposed zone change implements the goals of the East Lake, Lake View and North Peak Districts. PC October 1, 2013 Item No. 4 Page 13 of 30 PLANNING COMMISSION RESOLUTION NO. 2013 - PAGE 3 of 7 a. Floodways are appropriately zoned in accordance with FEMA maps. b. Public uses are appropriately zoned and identified. C. Open space and recreational uses are incorporated as an integral component of the overall community. d. Open space and park system are protected to satisfy the active and passive recreational needs of the community. e. A revitalized and healthy mixed -use corridor is protected along Riverside Drive. f. A greater variety of residential densities and supporting uses are included in the Lake View District. g. Hillsides and sensitive natural habitat are preserved in the North Peak District. 5. The proposed zone changes will not have a significant effect on the environment. a. The potential impacts of the General Plan have been analyzed in the Recirculated Environmental Impact Report (SCH #2005121019) prepared for the City of Lake Elsinore General Plan ( "General Plan EIR') and its related cases which was certified on December 13, 2011, and adequate mitigation measures have been prepared where necessary. Accordingly, the impacts of the proposed zone change have been disclosed, analyzed and mitigated to the extent feasible in the General Plan EIR. A copy of the General Plan EIR is available for inspection in the City of Lake Elsinore Community Development Department, 130 S. Main Street, Lake Elsinore, CA. SECTION 4. Based upon the evidence presented, both written and testimonial and such other matters as reflected in the record, and the above findings, the Planning Commission hereby recommends to the City Council adoption of Zone Change No. 2013 -03, making the following zone changes to the City of Lake Elsinore Official Zoning Map, and as shown in Exhibits 'D' through 'H' attached: East Lake District — Assessor's Parcel No. 373 - 300 -027 from CP Commercial Park to PI Public /Institutional and Assessor's Parcel No. 373 - 300 -028 from CP Commercial Park to R Recreation; As shown on Exhibit 'D.' As we discussed %vben the Walnut Grove Apartments were built (approximately 23 years ago), land must have been zoned R3 or equivalent. There are 63 units on 3.1 acres (approximately 20 units per acre). It should be zoned R3 to make the complex compliant with its zoning and I assume the land we own adjacent to Walnut Grove for the last 25 plus years also has been R3 zoning or equivalent because when Walnut Grove Apartments was built, a sister project was engineered to be built on our land adjacent to Walnut Grove Apartments but due to the economy at that time, it was never built (eve did not own Walnut. Grove Apartments or the land at that time). Our main concern at this time is APN 379131018 (Walnut Grove Apartments) being zoned as R3 to make its improvements compliant with zoning. APN 379131005, APN 379131006, APN 379131015 and APN 379131019 should be left as R3 zoning as it is presently zoned as shown on the Zoning Consistency Plan. The reason we purchased the adjacent land was to allow us to expand the size (number of units) of Walnut Grove Apartments in the future. Based on previous discussions regarding our adjacent land with the Planning Department approximately 3 -5 years ago, Joy Street is a planned 2 -lane road with no major highway frontage and its building improvements are mainly multi - family units and a school which makes our vacant land ideally suited to be improved with more multi- family= units. Because of many factors. its R3 zoning would make it economically feasible to develop it in the future. If you need any further information from me at this time, please let me know.
