CALL TO ORDER
The Regular City Council Meeting was called to order by Mayor
WinJcler ~t 7:CC p.m.

PUBLIC COMMENTS
1. Santa Claus, wished the Council and the Community a Merry
Christmas and a Happy New Year. He also complimented the
Council on their dedication to the needs of the Community.
2. Larry Knight, 110 W. Graham, requested Council consideration
of his prior request to allow reinstitution of the
Neighborhood Watch Patrol. He commented on a Robbery this
date at pioneer Lumber to emphasize his point.
PRESENTATIONS/CEREMONIALS
A. Proclamation - Jared B. Ferguson, Eagle Scout.
Mayor Winkler read a proclamation honoring Jared Ferguson for
his accomplishments in the achievement of Eagle Scout ranking.
He also presented Jared with a City Pin.

14. Approved public hearing date of December 26, 1989 for the
following:
a. Tentative Parcel Map 24571 = Rancon Realty Fund VI.
A request to subdivide 22.67 acres into 11 parcels
ranging in size from .76 acres to 4.61 acres and
Negative Declaration No. 89-22. The project is located
on the Northwest Corner of Central and Collier Avenue.
b. Development Aqreement = Brighton Homes.
A proposed development agreement with Brighton
Alberhill Associates in connection with a portion of
the Alberhill Ranch consisting of approximately 980
acres generally bounded by Interstate 15, Lake Street,
Coal Road and Nichols Road. The proposed development
agreement provides for a phased, mixed use development
consisting of a minimum of 1,135 dwelling units and
2,722,500 square feet of commercial and industrial
buildings, together with areas for schools, open space
and recreational uses. The environmental impact
report prepared for the Alberhill Ranch Specific Plan
and related matters, which was previously approved by
the City, is proposed to be recertified as adequate
and complete with respect to the development
agreement.

c. Specific Plan 89-3 - Homestead Land Development
(Tuscanv Hills).
The Tuscany Hills Specific Plan includes a total of
2,000 dwelling units as part of a 973 acre project.
Parks, private recreation areas, open space, a
wildlife corridor and lake area comprise approximately
-- 253 acres. An addendum to the previous Environmental
Impact Report (EIR) is included as part of the

Councilman Washburn commented on the importance of these
two items with regard to cleaning up the Community and
mitigating crime problems. He also thanked the people who
have worked with the City to resolve this type of problem.

13. Public Safety Study Update.

Councilman Dominguez advised that he had requested
placement of this item on tonight's agenda. He explained
the need to make strides to improve the our current pOlice
services. He requested that consideration be given to
update of the 1986 Study and following that an election to
determine the Community opinion with regard to City Police
Department vs. Sheriff's Department.
Mayor Winkler commented that a recently appointed
Committee is currently reviewing Public Safety issues, and
stressed the need to involve the Committee in this
process. He invited Tom Thomas, Chairman of the Committee
to discuss the Committee's work thus far.

Mr. Thomas advised that the Committee is currently in a
learning process, having thus far participated in the Ride
Along Program and toured the 911 Facility, the County Jail
Facility and the Sheriff's Department Facility. He
further advised that they are looking at bUdgetary
constraints and realistic approaches to provision of
police services. He commented on the need for positive
input from the residents of the Community and advised that
Channel 3 will be airing 6 public input sessions on the
topic, with dates to be announced.
Mayor Winkler further commented on the Public Safety
Committee and advised that due to recent new information
he has decided to add a member from the Downtown
Business Association as well as the Brookstone Development
Merchants group. He further advised that Dolores Mayhall
had agreed to serve on behalf of the D.B.A. and City
Treasurer Tere Cherveny would be providing suggestions for
the Brookstone representative. Mayor Winkler advised that
in response to recent requests, the City has requested
information from the Joint Powers Insurance Authority with

regard to a Neighborhood Watch Patrol and potential
liabilities. He read the following response from
J.P.I.A.:
Re: Volunteer citizen Patrol
This letter is in response to yours of this date,
subject above. We understand that the citizen Patrol
will be an independent group, not subject to control by
either the city or the county. In view of this fact we
b~lic~J'a it would be un;;;isa for the cit:ito. a.pprove o'r
authorize their activities. To. do so could involve the
city in liability claims arising from alleged negligent
operation of the Patrol.
Also, since auto liability follows ownership of the
vehicles the city should not permit the use of vehicles
or equipment by other than trained and supervised city
employees.

He further clarified the liability factors mentioned in
the letter may be a necessary risk, but he would rather
study all aspects before making that type of commitment.
He thanked the Committee for its work thus far and their
anticipated future participation.
City Manager Molendyk detailed recent upgrades in the
City's Police Services contract with the Sheriff's
Department.

PUBLIC HEARINGS
31. Acquisition of Property for Railroad Canyon Road.
Public Services Director Kirchner explained that this is the
public hearing which will initiate eminent domain proceedings
for necessary properties along Railroad Canyon Road, for the
pending road improvements.

City Attorney Harper advised that he spoke with Mr. Marzicola
this date and explained this step in the process and future
actions which would be occurring. He clarified for Council
that this action is not consideration of appraised values,
this step starts the process only.

Community Development Director Gunderman detailed this
request.
The City Clerk reported no written comments or protests.
Mayor Winkler opened the public hearing at 7:40 p.m. asking
those in favor of General Plan Amendment 88-7 and Zone Change
88-11 to speak. The following person spoke:

applicant requested favorable consideration on this request.
Mayor Winkler asked those in opposition to speak. Hearing no

Low Density Residential (0-6 dwelling units per acre) to High
Density Residential (12-24 dwelling units per acre), and a
Zone Change from R-l (Single-Family Residential) to R-3 (High
Density Residential) for an 18.11 acre parcel located on the
north side of Pottery Street, east of Rancho Street.
Community Development Director Gunderman detailed this
request.
The City Clerk reported no written comments or protests.
Mayor Winkler opened the public hearing at 7:44 p.m., asking
those in favor of General Plan Amendment 88-8 and Zone Change
88-12 to speak. The following person spoke:

Councilman Buck questioned the timing of this project and
commented on the favorable impacts which the improvement of
Franklin Street would bring.
Fred Crowe, was uncertain as to the exact timing, however he
anticipated construction in approximately 2 years.

37. West Lake Elsinore Assessment District Environmental Impact
RePOrt 88-2 = RMG Enqineering/The Keith Companies.
Draft Environmental Impact Report to consider the formation of
the Wc~t La1to Elsinore As~aS3mant Dist~i~t, ~ ~p~~i~l ~i~t~i=~
to provide utilities and related infrastructure improvements
to the study area, as well as related follow-up on residential
development which will be facilitated by the utility and
infrastructure improvements; the project encompasses
approximately 1,127 acres of land generally bounded by
Lakeshore Drive and Mountain Avenue on the north, Machado
Street on the east, Alvarado Street and its extension on the
south, and the Santa Ana Mountains to the West.
This public hearing was taken out of order, because it impacts
items 34, 35 and 36.
Planning Manager Thornhill detailed the plan for improvements
to be completed and advised that while the impacts are
significant the improvements will help to defray that impact.
The City Clerk reported one written comment which read as
follows:
Dear Mayor Winkler and City Council:
-
In reviewing the Environmental Impact Report prepared for
the West Elsinore Assessment District (EIR 88-2) I came
upon several items of concern.
I would first like to bring to your attention mitigation
measures for the fire protection in the area. On page
1-25 Item #6 the report indicates that the fire station
should be fully operational before the issuance of the
loooth Certificate of Occupancy. I would request that
the Council address this further. Past discussions have
indicated the immediate need for a fire station in the
West Lake Elsinore area. I think it would be appropriate
to condition all tentative maps in this area with
specific phasing requirements for the fire protection.
See attached excerpt from EIR 88-2.

Flood control mitigation measures have been one of the
major concerns and issues in regards to development in
this area. On page 3-64 storm drain lines are discussed
and it indicated that "underground portions of line Band
C are sized to carry the runoff generated by a 10 year
storm and that during a 100 year storm event, the
additional flow would be carried in the street section
above the facility." This must be an error, all
underground facilities must be sized to 100 year storm
requirements to meet Riverside County Flood Control
standards.
The material covered in this report is extensive and
takes many hours to review. I strongly urge council and
staff to make themselves very familiar with the
information provided so that if there is a need for
further detail or addition mitigation those items will be
included in Conditions of Approval for all tentative
tract maps in this area.

Mayor Winkler asked those in opposition to speak. Hearing no
one, the public hearing was closed at 7:57.
Councilman Washburn commented on the need for this assessment
district to ensure necessary infrastructure improvements. He
questioned item #10 on Page 10 relating to and the designation
of not significant. Planning Manager Thornhill advised that
under C.E.Q.A. regulations it is not significant.
Councilman Washburn inquired whether the comments returned had
been incorporated in this document. The.Consultant advised
that they were included by reference only at this point, but
would incorporated in the final document. He further inquired
about the mitigation monitoring plan and if this was a new
requirement. Staff confirmed that it is a new requirement.
Councilman Washburn questioned if the park facilities time
frame of five years was realistic. Staff confirmed if the
mining operations are concluded in 3-1/2 years as anticipated
the five year time frame is accurate.
Councilman Washburn questioned the timing/phasing of the fire
station and if it could be sooner than proposed. John
Mandrell, representing RMG Engineering, advised that once the
bonds are sold the funding would be available, however the
1000 home recommendation came from the County Fire Department.
Planning Manager Thornhill clarified that this is only the
E.I.R. and the fire station issue could be resolved at the
hearing for the Assessment District.

City Attorney Harper further clarified that the Flood Control
Improvements would be required to meet standards of the
Riverside County Flood Control District.

TO CERTIFY THE E.I.R. WITH THE FIRE STATION TIMING TO BE CHANGED
FROM THE 1000TH TO THE 500TH CERTIFICATE OF OCCUPANCY.
34. General Plan Amendment 89-10 and Zone Change 88-11 - Marinita
Development.

Specific Plan and Floodplain/Floodway to Low Density
Residential (0-6 dwelling units per acre); to pre-zone the
property to R-l (Single Family Residential); and approval of
Tentative Tract Map 24213 for a single-family subdivision of
160 lots on 56.9 acres of land generally located northwesterly
of Machado Street at the terminus of princo Street.
Planning Manager Thornhill detailed this request and advised
that negotiations were ensuing to maintain the 25 foot
easement for recreational trail discussed earlier.

concerns previously expressed by the surrounding homeowners
which have been mitigated. He further commented on the
dedication of easements for the recreational trail and offered
to answer any questions from Council.
Larry Truman, representing Butterfield Engineering, advised

Produce Stand. He requested that the conditions be changed to
allow the owner access to Grand Avenue until the time building
permits for a home are issued.

Community Development Director Gunderman advised that the
access request had been discussed and it was felt that too
many traffic circulation and safety problems existed.
Councilman Washburn inquired where the recreation trail would
be on the map. Planning Manager Thornhill advised that it
had not been included in the plan because it would most likely
end up on the adjacent property.
Mr. Jim Withrow, owner of Lot 6 further requested Council
consideration of the Grand Avenue access request and detailed
his proposed operation and the constraints placed on him by
the County.
Councilman Dominguez requested that staff work with Mr.
withrow to allow his operation until development occurs.
Community Development Director Gunderman advised that this
matter could be addressed in a Conditional Use Permit process

54. Mr. Solis' Complaint.
Community Development Director Gunderman advised that this
item had been referred to this meeting for a report from
staff. He explained that the fees paid by Mr. Solis were in
accordance with ordinances in effect at the time of
construction. He further explained that there was a period of
time when those fees were inadvertantly not collected, there
is not a provision in the ordinance to allow for that
collection after the fact. He advised that a letter
confirming this information will be sent to Mr. Solis.

55. Ordinance No. 876 - Urgency Ordinance for the expansion of the
East Floodplain Planning Area to include the following areas:
1) Certain properties located between Lakepoint Park and the
San Jacinto River and between Lakeshore Drive and the
moratorium area as described in Ordinance No. 838, and 2)
Certain properties located southerly of Cereal Street and
bounded by Corydon Road on the southeast and the City Limits
on the Southwest, and the moratorium area on the west.
Mayor Winkler inquired, since the affected area does not
involve his property, is it advisable to vote on this
Ordinance. City Attorney Harper recommended that he not
participate in this matter.
City Manager Molendyk explained the areas that had
inadvertantly been deleted from the ordinance. He reminded
Council that this item would come back for a public hearing on
the regular ordinance.

an immediate threat for adverse impact elements of

City Manager Molendyk requested a joint executive session
regarding potential litigation and property acquisition following

CITY COUNCIL COMMENTS
Councilman Starkey commented on the City Christmas Tree at the
intersection of Main/Graham and his hope that it will be an annual
event. He further commented on the work being done at the T & S
Development center to lower the manhole covers. He reminded the
public of the Chamber of Commerce New Year's Eve Party with the
theme Glitz, Glitter and Glamor at the Community Center.
Councilman Buck thanked all of the volunteers for their work on
the Christmas Parade.
Councilman Washburn thanked the students at Machado School for
their letters requesting a bike trail around the Lake; and
requested that staff write a response from the Mayor.
Mayor Winkler advised that S.A.W.P.A. had made the decision to
condemn 157 acres of the property owned by Crater Acres; and when
he receives formal notification, copies will be available for
review in the City Clerk's Office.
