GRAHAM AVENUE LAKE ELSINORE, CALIFORNIA AUGUST 29, 1989 - ****************************************************************** CALL TO ORDER The Special City Council Meeting was called to order by Mayor Winkler at 7:02 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilman Washburn. ROLL CALL PRESENT: COUNCILMEMBERS: BUCK, DOMINGUEZ, STARKEY, WASHBURN, WINKLER ABSENT: COUNCILMEMBERS: NONE Also present were: City Manager Molendyk, Assistant City Manager Rogers, City Attorney Harper, Administrative Services Director Wood, Community Services Director Watenpaugh, Public Services Director Kirchner, Planning Manager Thornhill and City Clerk Kasad. BUSINESS ITEMS - 1. Developer Fees for Parks and Recreation. City Manager Molendyk detailed the staff report and the calculations which were undertaken to determine the proposed costs, which would be as follow: Single Family Residence Duplexes Triplexes Fourplexes Apartments $1,600 $1,500 $1,500 $1,450 $1,400 Community Services Director Watenpaugh explained that the average costs are based on proposed City facilities and development fees. Councilman Washburn inquired whether we are currently one of the cities with the lowest fees. Community Services Director Watenpaugh advised that based on the comparative fee schedule provided we are one of the lowest, he indicated that the cities included in the schedule were similar in development standards to those of Lake Elsinore. He further indicated that our fees are currently: - Single Family Residences Duplexes Triplexes Fourplexes Apartments $850 $750 $750, $700 $700 Mayor Winkler inquired when these fees were last increased. Community Services Director Watenpaugh indicated that they were reviewed and updated in 1985. PAGE TWO - CITY COUNCIL MINUTES - AUGUST 29, 1989 MOVED BY WINKLER, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE TO ADD RESOLUTION NO. 89-44 TO THE AGENDA. Councilman Dominguez inquired what the population increase from 1985 to present has been. Staff advised that it went from approximately 9,000 to 15,000 in that time period. Councilman Dominguez further inquired when this fee would begin being assessed on the developers. Staff advised that any new applications would be charged at this rate. ..,..j MOVED BY WASHBURN, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO ADOPT RESOLUTION NO. 89-44. RESOLUTION NO. 89-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, HEREBY AMENDING SECTION 4 OF RESOLUTION NO. 85-34, ADOPTED ON MAY 28, 1985, THE PARK CAPITAL IMPROVEMENT FUND PURSUANT TO ORDINANCE NO. 572, REQUIRING THE DEDICATION OF LAND AND/OR THE PAYMENT OF FEES FOR THE ESTABLISHMENT OF PARK AND RECREATION FACILITIES IN THE CITY OF LAKE ELSINORE. 2. city/Park District Relationship i Provision of Future Services: Mayor Winkler detailed previous conversations and joint meetings with regard to City/Park District cooperation and provision of services. He commented on the anticipated assistance to Wildomar which had been anticipated through this cooperation. He also detailed concerns expressed by L.A.F.C.O. with regard to overlapping duties and the potential problems with approval of pending and future annexations. He expressed concern with providing park and recreation services in a manner which is in the best interest of the residents of the City. He commented on the City's ability to maintain existing parks, implement upgrades to existing parks and to negotiate new parks with the developers working in the city. ..... Mayor Winkler advised that he discovered approximately 10 days ago, after j oint City/District discussions with regard to the_ annexations, that the District had written a letter of opposition to the Suncal Annexation at Grand and Skylark. On August 24 the this annexation was continued by L.A.F.C.O. to their meeting of October 5, 1989, noting the above mentioned objection and the "conflict" between the City and the District. He ' expressed concern with not knowing why the District had filed this objection. He further advised that he has met with members of the Park District and that was to be the purpose of tonight's meeting to try to resolve the situation. He suggested that strides be taken to resolve it prior to the L.A.F.C.O. meeting of October 5th so the annexations can proceed. Mayor Winkler stressed the following points with regard to the City/District relations: 1) Problem with overlapping agencies, and the efficiency level which can be provided. He related this to the recent unification of the school districts. 2) Park District unable to finance and maintain the parks. He felt if the City maintains the parks, it should schedule them as well. ..... 3) OwnerShip of the facilities (parks) carries the liability and responsibility for them. He feels this is a City obligation. PAGE THREE - CITY COUNCIL MINUTES - AUGUST 29, 1989 4) 5) City is already providing some services. ..... After tax transfer, the City will collect $1400-$1600 per unit while the District would receive only $150 per unit. 6) City has ability to require that development include parks and open space. Janice Smith, Elsinore Valley Girl's Softball, advised that they practice and compete at Butterfield School Park, maintained by the Park District. She expressed concern that the grass is brown, the grading has been poor, and rocks on the playing field. She commented on the danger to the players and that they are lucky injuries have not resulted. He further commented that the Girl's Softball league has been maintaining the infield. Mr. Smith, Board Member of Elsinore Valley Girl's Softball League advised that a realignment of the fence around the playing field had been made, however the rocks had not been removed from the realigned area and no grass seeding had been done. He further advised that they had to call the District to request that the grass be watered; with that it was watered for about tWQ weeks and then it ceased. He expressed concern that the dryness of the ground is allowing the grass to die and rocks to be kicked up. He expressed further 'concern that the trash cans are not being emptied, and their group had to clean up for themselves. ~ Mayor Winkler questioned whether we would want more parks in the County areas, with no means to maintain them, while the City has the means to maintain the parks. He advised that at this point, consideration of deannexation from the park district was the matter of discussion. He further advised that he would still like to meet with the park district to work out alternatives, however, we need to tell L.A.F.C.O. that the City does have the ability to provide and maintain parks. Councilman Washburn advised that he has met and discussed the matter of deannexation with Council, staff and District members. He feels that at this point the City needs to consider the best arrangement for provision of services to City residents. He said that while he hopes for an amiable decision, nonetheless a decision is needed. Councilman Starkey advised that most of the Council has reached agreement on this matter and recommended adoption of the resolution. Councilman Dominguez advised that he is ready to make a decision. MOVED BY DOMINGUEZ, SECONDED BY BUCK TO ADD RESOLUTIONS 89-45 AND 89-46 TO THE AGENDA. Leon Strigotte, advised that he was representing the soccer club of approximately 3,000 members, and they requested that the City look at taking over Parks and Recreation, as they are not satisfied with the services being provided. He commented on the number of participants in their group coming in from the County area, because there are no services being provided to them. Leon Strigotte, further advised that as a resident, he feels that Wildomar has consistently worked to separate itself from the City and doesn't feel we should worry about working to provide them park services, but instead think about our own PAGE FOUR - CITY COUNCIL MINUTES - AUGUST 29, 1989 residents. He feels that the City has kept up with it's population increase and associated need for services, and the County residents need to fight their own battles. Councilman Buck concurred with Mr. Strigotte, and stressed the need to be concerned with our own residents. Mayor Winkler agreed that action needs to be taken for the best interest of our own Community, and two agencies fighting is not ~ healthy for the City or Community. He expressed further concern with the Park District's objection filed with regard to the annexation and requested that they reconsider that position. He suggested that the City's provision of services would relieve a burden that is currently on the Park District. Community Services Director Watenpaugh detailed the parks currently being planned and conceptually considered. Mayor Winkler commented on the agreement now in place with the School District and its impact on park facilities. Councilman Starkey commented that while we will not specifically be serving Wildomar, the new park being provided by Suncal will surely be utilized by Wildomar residents as well. Mayor Winkler expressed willingness to work with the wildomar representatives where possible. Charley Johnson, President of the Recreation & Park District Board, agreed that further joint discussion is necessary to review concerns on both sides as well as other alternatives. Councilman Washburn commented that there is always room for reconsideration. ... Mayor Winkler expressed the need to communicate the City's position to L.A.F.C.O. as soon as possible. Mike McGee, Pardee Development, requested that the City transmit its decision to L.A.F.C.O. as soon as possible to prevent further delay of their project. MOVED BY DOMINGUEZ, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO ADOPT RESOLUTION NO. 89-45, AND DIRECT STAFF TO PURSUE APPLICATION WITH L.A.F.C.O. RESOLUTION NO. 89-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DETERMINING TO DETACH FROM THE LAKE ELSINORE RECREATION AND PARK DISTRICT (ORTEGA TRAILS) . MOVED BY WASHBURN, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO ADOPT RESOLUTION NO. 89-46. RESOLUTION NO. 89-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, INITIATING A PROPERTY TAX TRANSFER BETWEEN THE CITY __ OF LAKE ELSINORE AND THE LAKE ELSINORE RECREATION AND PARK DISTRICT (ORTEGA TRAILS). Mayor Winkler requested a meeting with the Park District, as a committee or with the full board; staff to organize. He suggested that the delay of Cottonwood Hills Annexation be mitigated.
