ROLL CALL PRESENT: COUNCILMEMBERS: BUCK, STARKEY, WASHBURN, WINKLER ABSENT: COUNCILMEMBERS: DOMINGUEZ Also present were: City Manager Molendyk, Assistant city Manager Rogers, city Attorney Harper, Administrative Services Director Wood, Community Services Director Watenpaugh, Public Services Director Kirchner, Planning Manager Thornhill, Special Projects Engineer Keith and City Clerk Kasad. PUBLIC COMMENTS ,-. Deborah Morris Russ, 16501 Mountain Street, expressed concern with heavy motorcycle traffic on mountain street and the response time of the Sheriff's Department. She suggested that possibly the traffic problems could be mitigated through use of stop signs at each intersection, posted speed limit signs at the entrance to the street and increased response from the Sheriff's Department. Mayor Winkler advised that he would be holding a Police Committee__ meeting on Saturday, August 26, 1989 at 9:00 a.m. at City Hall and invited Mrs. Russ to participate. Don SOlis, 21783 Via Cordova, expressed concern with street patch work done recently at Riverside Drive and Lincoln Street, and suggested that Council consider pursuing more permanent repairs. PRESENTATIONS/CEREMONIALS None. CONSENT CALENDAR MOVED BY WASHBURN, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE CONSENT CALENDAR AS PRESENTED. - 1. Noble Company (CL #89-13). I ..J 6. Rejected and referred to Claims Administrator the Claim submitted on behalf of Kathleen Harris (CL #89-15). 7. Approved Construction Inspection Services Contract with BSI Consultants for the Summerhill & Tuscany Developments. Approved a budget increase to account 4412-200 (Engineering _ professional/technical services) in the amount of $170,000 to be offset with an increase in revenue from the encroachment permits, Account 3230. 8. Approved Acquisition of Computer Software for Processing of Assessment District Documentation, from FRA'Services Inc., at a cost of $9,900 to be passed through to '1915 Act Assessment District' . 9. Employees Health Insurance Plan - Resolutions 89-35 and 8 9-36. It was discovered that Resolution Nos. 89-35 and 89-36 had already been used, so the appropriate numbers are 89-42 and 89-43. Approved Employees Health Insurance Plan with Public Employees Retirement System and Adopted Resolution Nos. 89-42 and 89-43. -' RESOLUTION NO. 89-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE~ CALIFORNIA, ELECTING TO BE SUBJECT TO PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT ONLY WITH RESPECT TO MEMBERS OF A SPECIFIC EMPLOYEE ORGANIZATION AND FIXING THE EMPLOYER'S CONTRIBUTION AT AN AMOUNT GREATER THAN THAT PRESCRIBED BY SECTION 22825 OF THE GOVERNMENT CODE. RESOLUTION NO. 89-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ELECTING TO BE SUBJECT TO PUBLIC EMPLOYEES' MEDICAL AND HOSPITAL CARE ACT AND FIXING THE EMPLOYER'S CONTRIBUTION AT AN AMOUNT GREATER THAN THAT PRESCRIBED BY SECTION 22825 OF THE GOVERNMENT CODE. 10. Final Approval of Parcel Map 24099. Approved Staff Recommendations to: 1) Approve the final map, subject to the City Engineer's acceptance as being true and correct. ....J 2) Authorize the City Clerk to sign said map and arrange for recordation. 3) Accept the dedication of Underground Water Rights and record with final map. Approved Staff Recommendations to: 1) Approve the final map, sUbject to the City Engineer's acceptance as being true and accurate. ..... 2) Authorize the City Clerk to sign said map and arrange for recordation. 3) Accept dedication of Underground Water Rights and record with final map. 4) Accept dedication of a portion of Laguna Avenue offsite for additional travel lanes and authorize City Clerk to record document. 12. Final Approval of Tract Map 17413-1,3,4, & 5 - Tuscany Hills. Approved Staff Recommendations to: 1) Approve the final map, subject to the City Engineer's acceptance as being true and accurate and subject to approval of City Attorney of indemnification and acquisition agreement for off site drainage facilities. 2) Authorize City Clerk to sign said map and arrange for recordation. ..... 3) Accept dedication of Underground Water Rights and record with final map. 13. Accepted Grant Deeds for the Purpose of Street Right of Way Dedication for Single Family Residence at 805 Sumner (Mitchell) and 402 Sumner (Carsey). 14. Accepted Quitclaim Deeds for Water Rights relating to various Single Family Residences from David and Cindy Abshier, Darrell R. and Charlotte Jean Carsey, Robert W. and Carol J. Lynn and Mark T. and Terri D. Mitchell. 15. Accepted Notice of Completion for the 1989 Resurfacing Project. 16. Approved Public Hearing Date of September 12, 1989 for the following: a) Zone Code Amendment 89-2 = City of Lake Elsinore. An Amendment to Chapter 17.54 and 17.56 relating to permitted uses in the Commercial Manufacturing District (C-M) and the Limited Manufacturing District (M-l) relating to permitted uses in the C-M and M-l Zone Districts. b) Tentative Parcel Map 24751 = Brookstone Development, Inc. .---. A request to subdivide 9.67 acres into 37 parcels, located at the southeast Intersection of Collier and Central Avenues. MAYOR PRO TEM DOMINGUEZ ARRIVED AT 7:06 P.M. PUBLIC HEARING 31. Summerhill Bridge Assessment District Hearing and Confirmation. PAGE FOUR - CITY COUNCIL MINUTES - AUGUST 22, 1~89 Gene Nazarek, Bond Counsel, explained the steps preceding this public hearing. The City Clerk reported no written comments or protests. Milo Keith, Special Projects Engineer, detailed the project and advised that the bridge had been required as a condition of approval of the affected tracts. He advised that there is no opposition to the proposed assessment district. Mayor Winkler opened the public hearing at 7:11 p.m., asking those persons interested in this project to speak. Hearing no one, the public hearing was closed at 7:11 p.m. Gene Nazarek advised that a proposal had been received for purchase of the bonds from Wulff, Hansen and Company and detailed the interest rates and terms. He further advised that Council should adopt all resolutions attached except that relating to changes and modifications, since there were none. ... MOVED BY WASHBURN, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO APPROVE STAFF RECOMMENDATIONS TO AUTHORIZE THE FILING OF A NEGATIVE DECLARATION AND ADOPT RESOLUTION NOS. 89-37, 89-38, 89-39, AND 8~-4l. RESOLUTION NO. 89-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, RIVERSIDE COUNTY, CALIFORNIA, ACCEPTING A PROPOSAL FOR PURCHASE OF BONDS AND MAKING OTHER DETERMINATIONS (ASSESSMENT DISTRICT NO. 89-1). RESOLUTION NO. 89-38 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, RIVERSIDE COUNTY, CALIFORNIA, CONFIRMING THE ASSESSMENT, ORDERING THE IMPROVEMENTS TO BE ACQUIRED, AND APPROVING THE ENGINEER'S REPORT (ASSESSMENT DISTRICT NO. 89-1). RESOLUTION NO. 89-39 ... A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, RIVERSIDE COUNTY, CALIFORNIA, OVERRULING AND DENYING PROTESTS AND MAKING CERTAIN FINDINGS IN A SPECIAL ASSESSMENT DISTRICT (ASSESSMENT DISTRICT NO. 89-1). RESOLUTION NO. 89-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, RIVERSIDE COUNTY, CALIFORNIA, PROVIDING FOR THE ISSUANCE OF BONDS UNDER THE IMPROVEMENT BOND ACT OF 1915; DESIGNATING FISCAL AGENT; AND MAKING OTHER DETERMINATIONS (ASSESSMENT DISTRICT NO. 89-1). BUSINESS/DISCUSSION ITEM 51. Graham/Spring Streets Traffic Control. Public Services Director Kirchner advised that discussion of .~ the Traffic Engineer's recommendation relating to this intersection had been requested. He further advised that pursuant to concerns, the LETS buses would be making right turns only at this intersection, and RTA has advised that they will also limit drivers to right hand turns in this area. He suggested that with these changes the problems may be mitigated. PAGE FIVE - CITY COUNCIL MINUTES - AUGUST 22, 1989 - Councilman Dominguez expressed concern with excessive speed in this area. He suggested that in light of the new bus information the recommendations of the traffic engineer be approved, with staff to review the situation at a later date. Councilman Washburn requested that staff review the potential of removing one parking space in front of the Chamber building to improve visibility. MOVED BY DOMINGUEZ, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE TO CONCUR WITH THE RECOMMENDATIONS OF THE TRAFFIC ENGINEER AND CONTINUE TO REVIEW THIS AREA, AS WELL AS THE POSSIBILITY OF REMOVING ONE PARKING SPACE. Councilman Buck suggested that traffic enforcement in this area be increased to help prevent the excessive speed. BUSINESS ITEMS 52. Second Readinq = Ordinance No. 861. Relating to Alberhill Ranch Zone Change. MOVED BY DOM~NGUEZ, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO ADOPT ORDINANCE NO. 861. ORDINANCE NO. 861 - AN ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA, REZONING APPROXIMATELY 2,667 ACRES GENERALLY BOUNDED BY I-15 TO THE NORTH, TERRA COTTA ROAD/NICHOLS ROAD TO THE SOUTH, EL TORO ROAD TO THE EAST, AND ROBB ROAD/LAKE STREET TO THE WEST AS SHOWN IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FROM SEVERAL LAND USE DESIGNATIONS TO THE SPECIFIC PLAN AREA ("SPA") ZONING DISTRICT (ZONE CHANGE 89-8, LONG BEACH EQUITIES, INC.) AND ADOPTING THE ALBERHILL RANCH SPECIFIC PLAN, INCLUDING FLOOR AREA RATIOS. MOVED BY BUCK, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE TO ADOPT ORDINANCE NO. 862. - ORDINANCE NO. 862 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ADOPTING THE ALBERHILL RANCH SPECIFIC PLAN; AND CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT 89-9 WITH FINDINGS OF FACT AS TO ENVIRONMENTAL IMPACTS AND STATEMENTS OF OVERRIDING CONSIDERATIONS. CITY COUNCIL COMMENTS Councilman Starkey questioned the status of the new Del Taco at four corners. Planning Manager Thornhill advised that they are having difficulty obtaining permits from Caltrans to tunnel under Highway 74 for water lines. Councilman Starkey inquired whether staff had made a determination with regard to request received from an Eagle Scout for use of the Community ce~ter. Community Services Director Watenpaugh advised that it was felt that all fees could in fact be waived except the $50 cleaning fee. Councilman Starkey advised that he would pay the $50 fee to allow the boy use of the Center. Councilman Dominguez requested that staff trim the Pepper Tree at the corner of Avenue 1 and Mill Street. Councilman Washburn commented on recent nuisance abatement proceedings and advised that the program is beginning to work, and that the City will pursue all problem areas, particularly cars parked on front lawns. Councilman Starkey commented on graffiti which appeared at Machado Park over the weekend and the quick work of City staff to remove it. He advised that the City is working to eliminate graffiti and is not willing to put up with this continuing problem. .... Mayor Winkler commented on the West End Assessment District discussed in a recent Study Session, and the future amenities it will provide, including a park, fire station, improved drainage and the extension of Grand Avenue. Mayor Winkler requested that staff review Mountain Road for possible measures to mitigate the traffic concerns. Mayor Winkler also requested that this evening's meeting be adjourned to Tuesday, August 29 at 7:00 p.m., for the purpose of discussing: 1) Developer Fees for Parks and Recreation; and 2) Relationship between the City and the Parks District and future City provision of Services. He further requested that the Recreation and Park District members be invited to attend. THE CITY COUNCIL MEETING WAS RECESSED AT 7:54 P.M. THE CITY COUNCIL MEETING RECONVENED AT 8:01 P.M. .....
